The second examination was appointed at the FEL of the Ministry of Justice for the Kaluga Region, where an expert with experience since 2008. violated all possible rules for conducting such examinations, including the instructions of the Ministry of Justice. По мнению следствия, предметом взятки явился …холодильник стоимостью 13000 руб, приобретенный приятелем одного из обвиняемых для нужд райотдела. Кстати, приятель тоже сидит на скамье подсудимых за дачу взятки должностному лицу. Ни для кого ни секрет, что наши органы с большим удовольствием принимают спонсорскую помощь. И ни у кого не возникает желания возбуждать уголовные дела в отношении спонсоров. Но не в этом случае. В данном случае, для того, чтобы «срубить палку» и повысить показатели, должностные лица Следственного отдела СУ СК РФ по Калужской области и оперативно-розыскной части собственной безопасности УМВД по Калужской области действовали синхронно и дружно. Чтобы сложилось уголовное дело следователю пришлось подделать протокол допроса и подписи свидетеля, внеся туда достаточные факты для избрания меры пресечения в виде заключения под стражу одному из фигурантов и предъявления обвинения. Поддержали коллег и сотрудники УМВД проведя служебную проверку в отношении фигуранта и его непосредственного начальника. Ничего не придумав лучше, как заменив текст реального объяснения на текст сфальсифицированного допроса, даже не потрудившись исправить орфографические ошибки и знаки препинания. Правда подписи здесь были более похожи, чем в протоколе допроса. Когда все эти махинации выплыли наружу, уголовное дело уже находилось в суде, а растиражированный фальшивый допрос разлетелся в качестве доказательства и лег в основу решений как минимум двух судов. И вот теперь, снова плечо к плечу встали должностные лица УМВД и СК, отбиваясь от очевидных фактов в виде почерковедческих исследований , проведенных в независимых учреждениях и свидетельских показаний. Да, в рамках проведения проверки в отношении сотрудника ОРЧ СБ было назначено аж две почерковедческих экспертизы, одна в ЭКЦ УМВД по Калужской области, где в качестве свободных образцов были взяты подписи с фальшивого допроса и еще одного объяснения, в котором как оказалось позже также подделаны подписи, правда на этот раз без искажения текста. Вторая же экспертиза была назначена в ЛСЭ Минюста по Калужской области, где эксперт со стажем работы с 2008г. нарушила все какие можно правила проведения подобных экспертиз, включая инструкции Минюста. И также, как и коллеги из ЭКЦ сделала вывод в соответствии с поставленной задачей или просьбой.

Создается ощущение, что в области, а особенно в городе Калуга это сложившаяся практика , когда сажая на скамью подсудимых заведомо невиновного человека, органы, которые должны стоять на страже интересов законности, дружно отмазывают своих коллег, которые по совместительству являются кому-то из них друзьями, родственниками и т.д.

Расследованием занимается отдел полиции "Китай-город", который и не скрывает, что действует исключительно в пользу Демидова.

Как мы и предполагали, отмена Тверским межрайонным прокурором Кудрявцевым первого постановления об отказе в возбуждении уголовного дела по данному факту, подписанного начальником ОП Китай-город Вакалом, и назначение дополнительной проверки привело к тому же самому результату - отказ в возбуждении уголовного дела за отсутствием события преступления.

Начальником отдела полиции "Китай-город" Вакалом снова вынесено постановление об отказе в возбуждении уголовного дела по факту подделки документа Демидовым по тому же самому основанию, как и первое - отсутствие события преступления. При этом Вакал пытается всеми силами не выдать заявителю копию постановления (в нарушение ч.2 ст. 145 и ч.4 ст. 148 УПК РФ), чтобы избежать обжалования. И снова Тверская прокуратура не видит в этом ничего плохого. Напомним, что Тверская прокуратура отменила первое постановление ОП Китай-город от 24.06.2022 только после обращения в Прокуратуру Москвы.

Возникают логичные вопросы - Как же может отсутствовать событие преступления при наличии поддельного документа? Почему полиция ОП "Китай-город" не ищет и не изымает саму подделку и дает Демидову возможность ее спрятать и уничтожить? Почему Тверская прокуратура упорно закрывает на это глаза?

В ходе изучения природы такой "дружбы" и лояльности к Демидову и его "команде" со стороны руководства ОП Китай-город выяснилось, что в кабинет Вакалу, а также его заместителю, парк "Зарядье" выделил достаточно современные персональные компьютеры "НР" (моноблоки), которые продолжают стоять на балансе парка "Зарядье". Rucriminal.info полагает, что на этих компьютерах Вакал и пишет свои постановления и отписки на сообщения о преступлениях Демидова. Такое трогательное "шефство" над "нищим" Вакалом взял от имени парка "Зарядье" Эдуард Кононов - заместитель Демидова по безопасности и режиму. Имеются основания предполагать, что не одними компьютерами ограничивается это "шефство". Один этот факт объясняет бездействие Вакала. А может не одними этими двумя компьютерами ограничивается "шефство"? А может Кононов с Демидовым и в Тверскую прокуратуру "заносят подарки" за такую "слепоту" в отношении себя?

Как ранее сообщали ВЧК-ОГПУ и Rucriminal.info, в парке Зарядье имеется выписка из протокола аттестации директора ГАУК г. Москвы "Парк "Зарядье" Ивана Демидова по промышленной безопасности, якобы пройденная им в комиссии Ростехнадзора.

Межрегиональное технологическое управление Ростехнадзора, в лице и.о. руководителя М.А.Чеузова, узнав о ее существовании и проверив ее, установило, что подобную аттестацию не проводило и соответствующий документ не выдавало.

Ростехнадзор подал заявление в УВД по ЦАО ГУ МВД России по г. Москве о преступлении, предусмотренном статьей 327 УК РФ (подделка документов).

Это заявление Ростехнадзора в итоге попало в Отдел полиции по району Китай-город УВД по ЦАО ГУ МВД России по г. Москве (далее - ОП Китай-город), где вынесли отказное постановление.

Однако, Тверской межрайонный прокурор вынес решение об отмене постановления ОП Китай-город об отказе в возбуждении уголовного дела по данному факту в связи с неполным объемом проверочных мероприятий.

Постановлением Правительства Российской Федерации от 22.07.2022 № 1311 "Об утверждении перечня материалов и технологий для производства электронной компонентной базы (электронных модулей) для целей применения пониженных налоговых ставок по налогу на прибыль организаций и тарифов страховых взносов", подписанного председателем правительства Михаилом Мишустиным, были предусмотрены определённые льготы для российской радиоэлектронной промышленности в условиях санкций. Весьма странным образом в перечне материалов и технологий, для производства электронной компонентной базы, проект которого готовили подчинённые Мантурова и Шпака, оказался пункт о льготах для продукции по коду ОКПД2 - 22.21.2 "Трубы, трубки и шланги и их фитинги пластмассовые", не имеющей отношения к радиоэлектронике. Казалось, что явную ошибку можно и нужно быстро исправить. Особенно после яростной критики Минпромторга и его действий со стороны Ассоциация российских разработчиков и производителей электроники (АРПЭ) и её исполнительного директора Ивана Покровского. Но Минпромторг Дениса Мантурова и непосредственный куратор радиоэлектронной промышленности Василий Шпак никуда не торопятся. Через три месяца после подписания постановления в дело вмешивается Совет Федерации в лице Комитета по экономической политике, который, после проведения совещания с представителями радиоэлектронной промышленности, направляет в Минпромторг РФ протокол совещания с указанием на допущенную ошибку и необходимостью её устранения. Документы такого рода всегда направляются министрам с одобрения Валентины Матвиенко. Но проходит ещё три месяца и ничего не меняется. Уже в феврале 2023 года, после того как прошло 7 месяцев со дня принятия постановления, Совет Федерации вновь напоминает Денису Мантурову о необходимости внесения изменений на основе предложений Совета Федерации. Но Мантуров и Шпак в очередной раз всё игнорируют. Совет Федерации, как законодательный орган власти, с его Комитетом по экономической политике и Валентиной Матвиенко для Дениса Мантурова и Василия Шпака не указ.

Остаётся только гадать, как Мантурову удаётся так долго игнорировать Валентину Матвиенко и Совет Федерации, а также кто те "профессионалы" Минпромторга России согласовавшие и подсунувшие Михаилу Мишустину на подпись данное постановление.

И вся эта история всего лишь небольшой штрих к работе Минпромторга России.
