The firms of Chaplin Yu.K., Chaplin N.Yu., Chaplina T.V. made a request that the land plots are not included in the boundaries of the State Forest Fund, to the director of FL "Moslesproekt" FSBI "Roslesinforg" Netbalsky N.K. (headed for 15 years - son-in-law of the President of the RSPP Shokhin A.N.), who concluded that the land plot is not listed in the forest register, then the director of the Zvenigorod branch of the State Institution of the Moscow Region "Mosoblles" (all lands surrounding the Rublevskie forests of the Moscow Region) Chirkun M.V. made an ACT that the specified land plots are not the State Forest Fund. Then the Chaplin firms submitted a package of documents to the administration of the Odintsovo District of the Moscow Region and registered the applicant's rights to lease land plots with subsequent redemption for +- 50,000 -200,000 rubles, depending on the area of ​​the land plots.

After registering the land plots in the category of land of populated areas, the land plots were sold at a price of 3 to 10 million US dollars and more, and in fact they sold federal property of the Russian Federation, by forging forest maps, forest tablets, taxation characteristics and descriptions, plans for afforestation of forest plots.

Over 20 years, more than 1,000 such cases of sale of land plots, registered by forgery by the Chaplin and officials of the Forestry Department of the Moscow Region land plots from the lands of the State Forest Fund. The same thing was done on many sections of the State Forest Fund of the Moscow Region, which are indicated in the applications addressed to the heads of law enforcement agencies.

Instead of terminating the lease agreement for auction forest plots with the tenant, Eximart LLC, due to multiple violations of the terms of the agreement, misuse of plots, transfer of forest plots for use by third parties, without the consent of the owner - the Russian Federation, the KLH MO, contrary to the regulations, an illegal order of the KLH MO dated 10/31/2017 No. 27 was issued P-1856 "On approval of design documentation of a forest plot" for the division of forest plot K№ 50:20:0010336:358 for the formation of 5 (five) new forest plots.



Sovetnikov I.V., Chaplin N.Yu., Kazimir E.Yu., Pomozova A.L., Kapitalinin D.Yu. approved design documentation and issued illegal orders of the KLH MO for bribes, despite unprecedented violations by the lessee OOO Eksimart of the legislation of the Russian Federation, which they covered up and assisted in the positive approval of numerous divisions of forest plots with the subsequent transfer of lease rights to auction forest plots of the State Forest Fund to third parties, illegal approval of positive conclusions of the state examination of projects and documentation for OOO Eksimart.

Sovetnikov I.V. personally prepared all, literally all, draft texts of letters for Eximart LLC to the KLH MO and handed them over to Uspensky E.A., who sent them to the responsible person for processing and submitted them personally to the KLH MO.

Since at that time, investigative actions were taking place against the former heads of the KLH MO Ovtsinov V.G., Migunov A.V., Gorodnichy O.E., Trunov E.S., and the current deputy of the KLH MO Prokopchenko A.V., Sovetnikov I.V. asked each member of the organized criminal group to separately maintain strict confidentiality, Uspensky E.A. to issue a power of attorney from Eximart LLC to represent interests.

Upon completion of the next stage, Uspensky E.A. personally handed over in cash to Sovetnikov I.V. the next advance payment of 1 million US dollars for the new stage of the roadmap implementation.

Due to the high risks of initiating a criminal case in order to cover up the illegal actions of the organized criminal group, Sovetnikov I.V. instructed Pomozova A.L. prepare in advance a draft text of the statement of claim from Eximart LLC to the KLH MO in the Arbitration Court of Moscow Region on recognizing as illegal the decision to refuse to conclude lease agreements for the formed forest plots with cadastral numbers: 50:20:0010336:32840, 50:20:0010336:35033, 50:20:0010336:35034, 50:20:0010336:35035, 50:20:0010336:35037 from the forest plot with K№ 50:20:0010336:358, provided on the basis of Agreement No. 50-0568-04-05-0515 for the lease of a forest plot concluded as a result of the auction dated 03.12.2008 (parent forest plot): on the obligation of the KLH MO to conclude agreements on the terms of Agreement No. 50-0568-04-05-0515 for the lease of a forest plot dated 03.12.2008.

Before filing the claim, Sovetnikov I.V. carried out all the necessary preparatory activities, prepared fictitious grounds for filing a claim for Eximart LLC, personally prepared the texts of letters dated 20.04.2018, with additions by a letter dated 08.10.2018, which, after execution, Uspensky E.A. submitted to the KLH MO with an application for the execution of lease agreements without holding auctions in relation to each of the newly formed forest plots.

Sovetnikov I.V., together with the Deputy of the Federal Forestry Agency Vinokurova A.O. more than a year, developed a criminal scheme and all the legal nuances of interaction with the courts, to implement the plan to conclude forest lease agreements by assignment of rights, without holding auctions.

At the same time, all forest plots of the State Forest Fund with cadastral numbers, for which long-term lease agreements were concluded, provided by auction, illegally and irretrievably disappeared from the cadastral records of Rosreestr, due to multiple divisions, numerous assignments to newly formed forest plots with new cadastral numbers and registration actions in Rosreestr.

Pomozova A.L., prepared the text of the statement of claim for Eximart LLC to the KLKH MO and handed it over to Sovetnikov I.V., who made his own adjustments, after which in December 2018, Pomozova A.L. from her e-mail: Apomozova@gmail.com sent a draft claim to the e-mail: yspenskii-jena@mail.ru to Uspenskii E.A. for execution and submission to the Arbitration Court of the Moscow Region.

In connection with the end of the calendar year, the pre-New Year bustle and the need for urgent signing of the claim by Eximart LLC against KLKH MO for filing in court, Uspenskii E.A. forwarded to many technically related persons, a draft statement of claim prepared by Pomozova A.L. for execution and submission to the Arbitration Court of the Moscow Region. In the history of the file, as well as in the properties of the document, the author of the document was listed as Pomozova Alina Leonidovna, which after the filing of the application was noted by the technical specialist accompanying the filing of the claim. In order to add realism to the future trial, Sovetnikov I.V., who by that time had already agreed with the “right people” in the Arbitration Court of the Moscow Region on a positive court decision, asked Uspensky E.A. to find a reliable lawyer who would have to “strictly read out the position of Eximart LLC in the court session according to the piece of paper that Pomozova A.L. would give, and so that there would be no amateur performance.” Uspensky E.A. turned to an old acquaintance, lawyer Khokhlov B.B., who had previously participated with him in the team, who agreed to go sit in, create a theatrical show in the trial under the power of attorney from E "Ksimart".

By these planned illegal actions, by prior conspiracy, Sovetnikov I.V., Chaplin N.Yu., Vinokurova A.O., Dmitriev K.A., Branovitsky I.S., Kazimir E.Yu., Pomozova A.L., Goroshansky N.A., Kapitalinin D.Yu., Uspensky E.A. caused damage to the national interests of the Russian Federation and the Federal Budget on an especially large scale.

Considering the Committee's refusal to be illegal, in accordance with the instructions of Sovetnikov I.V., Eximart LLC on 24.12.2018 applied to the Arbitration Court of the Moscow Region to declare illegal the decision of 03.12.2018 No. ref-25700/26-14 on the refusal to conclude lease agreements for the formed forest plots with cadastral numbers: 50:20:0010336:32840, 50:20:0010336:35033, 50:20:0010336:35034, 50:20:0010336:35035, 50:20:0010336:35037 from the forest plot with cadastral number 50:20:0010336:358, provided on the basis of Agreement No. 50-0568-04-05-0515 for the lease of a forest plot dated 03.12.2008, on the obligation of the KLH MO to conclude on the terms of Agreement No. 50-0568-04-05-0515 for the lease of a forest plot dated 03.12.2008.

Since the first letter of the KLH MO dated 03.12.2018 No. iskh-25700/26-14, prepared by Sovetnikov I.V., did not take into account all the risks of the legal process of Eximart LLC and there is a possibility that the Arbitration Court of the Moscow Region will refuse to satisfy the claims against the KLH MO, Sovetnikov I.V. prepared additions to the previously sent letter as amended on 11.12.2018 No. iskh26488/26-14, KLH MO and forwarded it to Uspensky E.A.

09.01.2019, the statement of claim of Eximart LLC against KLH MO was accepted for consideration by the Arbitration Court of the Moscow Region, case No. A41-105699/2018.

Pomozova A.L. entrusted the preparation of a response to the statement of claim of Eximart LLC against KLH MO to her authorized person-employee Prisakar A.A. The Arbitration Court of the Moscow Region satisfied the statement of claim in favor of Eximart LLC. The Tenth Arbitration Appeal Court court, the Arbitration Court of the Moscow District in case No. A41-105699/18 left the decision unchanged, the cassation appeal of the KLH MO was dismissed.

In the court hearings, the KLH MO was represented by Prisakar A.A., Malyshev E.S., authorized persons-employees of Pomozova A.L., who were openly instructed to act in favor of the plaintiff, Eximart LLC. Therefore, all documentary evidence and arguments for the response to the statement of claim, responses to the appeal and cassation appeal were initially drawn up in favor of Eximart LLC on the personal instructions of Sovetnikov I.V., directed against the interests of the Russian Federation.

Pomozova A.L. prepared all responses from the plaintiff, Eximart LLC, incl. on the appeal and cassation appeal of the defendant KLKH MO and transferred them for approval to Sovetnikov I.V., who made adjustments, then sent them to Uspensky E.A. for processing and filing with the Arbitration Court of Moscow Region, the Tenth Arbitration Court of Appeal, the Arbitration Court of Moscow District.

"Sovetnikov I.V., Chaplin N.Yu. organized a criminal community, which includes receiving bribes, acting as an intermediary in the transfer of bribes from entrepreneurs, civil servants and politicians.

The organized criminal community carries out its activities against the national interests of the Russian Federation, causing damage to the Federal budget, more than 300 billion rubles per year.

The organized criminal group under the leadership of Sovetnikov I.V., Chaplin N.Yu. has been operating for +- 15 years, receiving cash from illegal activities, in particular, for resolving certain issues related to professional activities in the field of forestry, property and other relations, providing mediation in resolving other interrelated issues and organizing the transfer of bribes on an especially large scale.

Sovetnikov I.V., Chaplin N.Yu. put the receipt of bribes on stream as part of an organized interrelated group of persons, and established tariffs for personal enrichment for patronage in resolving issues of professional activity, including: coordinating project documentation, passing state examination of projects, obtaining rights to lease forest areas of the State Forest Fund, without holding auctions, and other necessary approvals.

Chaplin N.Yu. uses his official position, as well as the political influence of his father, Chaplin Yu.K., born 02.02.1955. and his many years of experience as a professional solver of "delicate corruption issues", was able to organize the appointment of persons under his control to the personal composition of the commission for conducting state examination of projects of the Forestry Committee of the Moscow Region (hereinafter referred to as the FC MO). Who acted exclusively in the interests of the OPS participants, influenced the adoption of collegial decisions, and carried out the instructions of Chaplin N.Yu. In connection with this, only those projects that were approved by the OPS participants during internal approval, after receiving cash, passed the positive approval of the state examination of projects. His influence on the decision-making by the commission in the FC MO has not changed to this day, despite the numerous criminal cases initiated against officials of the FC MO.



Only one example below can be used to assess the scale of the illegal activities of the OPS under the leadership of Sovetnikov I.V., Chaplin N.Yu. and other persons involved in illegal actions involving officials. In the spring of 2017, the CEO of the Russian Direct Investment Fund, K.A. Dmitriev, contacted the Governor of the Moscow Region, A.Yu. Vorobyov, with a personal request for assistance in dividing the auction forest plot of the State Forest Fund with K№ 50:20:0010336:358 for the purpose of formalizing the transfer of lease rights for 7 forest plots of the State Forest Fund from Eximart LLC to actual land users, which were previously transferred without formalizing land legal relations, on which third parties carry out economic activities, a 3-5 meter fence was installed, objects were placed without approval, in connection with which disagreements periodically arose with the district foresters of the Zvenigorod branch of the State Institution of the Moscow Region "Mosoblles". The Governor of the Moscow Region, A.Yu. Vorobyov, instructed the Chairman of the KLH MO, I.V. Sovetnikov. resolve the issue of dividing the auction forest plot of the State Forest Fund with K№ 50:20:0010336:358. In turn, Sovetnikov I.V. worked out the order of the Governor of the Moscow Region Vorobyov A.Yu., and refused Dmitriev K.A., in resolving the issue of dividing the land plot provided through an auction from the State Forest Fund with K№ 50:20:0010336:358 in accordance with the current legislation, citing the impossibility of circumventing in a legal way: the Forest Code of the Russian Federation, the Land Code of the Russian Federation, the Civil Code of the Russian Federation and other Federal Laws, Resolutions of the Government of the Russian Federation, orders of the Prosecutor General's Office of Russia to the Ministry of Natural Resources of Russia, Rosleskhoz, territorial administrations of Rosleskhoz "on the elimination of violations, incl. related to the assignment of lease rights to land plots granted through auctions or competitions to third parties with multiple divisions and loss of legal grounds for the return of plots from the State Forest Fund, non-receipt of payments to the Federal Budget. Previously, the oligarch Branovitsky I.S. had experience in transferring bribes, for a commission, in coordinating project documentation in the KLKH MO, including the transfer of lease rights to auction forest plots of the State Forest Fund, for his business partners and high-ranking government officials, through intermediaries, including Uspensky E.A., who is a trusted person of Sovetnikov I.V., who was closely connected in other "forest affairs", in the transfer of bribes that Sovetnikov I.V. accepted personally from him.

The oligarch Branovitsky I.S. contacted Uspensky E.A., who, after a detailed conversation with Sovetnikov I.V. and agreeing on the cost with Chaplin N.Yu., announced the final amount of 4 million US dollars, turnkey in 4 stages, including the organization of the "necessary positive" court decision of the Arbitration Court of the Moscow Region.

Uspensky E.A. announced to the oligarch Branovitsky I.S. from Sovetnikov I.V. the terms of services for supporting the activities of the road map:

1. 100% advance payment of amounts with reference to the stages of the road map;

2. also at what stage problems and irreversible risks may arise that must be accepted;

3. also that 100% will have to go to the Arbitration Court of the Moscow Region to reduce the risks for the decisions taken by the KLKH MO on auction forest areas, which in the future can be canceled by order of the supervisory authorities: the Prosecutor General's Office of Russia, Rosleskhoz. This decision will create a criminal scheme of interaction in the future and will open the possibility of continuing to divide auction forest plots of the State Forest Fund in a calm manner, without regard for law enforcement and supervisory authorities.

Oligarch Branovitsky I.S. did not immediately give an answer, citing that the amounts of the bribe must be agreed upon with Dmitriev K.A. and other interested parties, the actual land users of the forest plots of the State Forest Fund.

Dmitriev K.A., having received the cost of services and the stages of the roadmap from Sovetnikov I.V., transferred to him through the oligarch Branovitsky I.S., having administrative and political influence in the state authorities of the Russian Federation, turned to the top management of the Ministry of Natural Resources of Russia for assistance in resolving the above-mentioned personal issues.

The top management of the Ministry of Natural Resources of Russia instructed Rosleskhoz, Vinokurova A.O., to work out the personal request of Dmitriev K.A. for the division of the auction forest plot of the State Forest Fund with K№ 50:20:0010336:358, for the purpose of formalizing the transfer of rights to lease forest plots to actual land users.

Vinokurova A.O., the above-mentioned instruction of the Ministry of Natural Resources of Russia, reported to Sovetnikov I.V., who became “furious” and began calling Uspensky E.A., demanding an urgent meeting, at which he announced that if “Dmitriev K.A. will go from office to office with this request, the issue will be exposed with a negative position of the Federal Forestry Agency and the Forestry Department of the Moscow Region, and he will be able to do everything possible so that the issue is “finally drowned” and can never be resolved by anyone, among other things, Eximart LLC will be brought to administrative responsibility for transferring auction forest plots without the consent of the Forestry Department of the Moscow Region for use by other persons, all fences and structures will be dismantled, illegal improvement of forest plots, his “exclusive vegetable garden with flower beds”, everything will be brought into compliance with the Forest Code of the Russian Federation and other regulations, and the lease agreement for forest plots will be terminated.” Uspensky E.A. conveyed the specified tough position of Sovetnikov I.V. to the oligarch Branovitsky I.S. and Dmitriev K.A. stopped further actions to promote his request with the top management of the Ministry of Natural Resources of Russia and the Federal Forestry Agency. As a result, the amount of the bribe of 4 million US dollars for his services, which Sovetnikov I.V. announced through Uspensky E.A. to the oligarch Branovitsky I.S., was agreed upon, and ultimately amounted to 6 million US dollars, taking into account the intermediary services of the oligarch Branovitsky I.S., Uspensky E.A. and other persons involved in illegal actions. After the transfer of an advance payment of 1 million US dollars in cash to Dmitriev K.A. through the oligarch Branovitsky I.S. then to Uspensky E.A. to the bribe-taker Sovetnikov I.V. in June 2017, together with Chaplin N.Yu., Kazimir E.Yu., Pomozova A.L., Goroshansky N.A., Kapitalinin D.Yu., Uspensky E.A. started implementing the activities of the pre-agreed roadmap to resolve a set of issues of auction forest plots of the State Forest Fund in the interests of Dmitriev K.A., oligarch Branovitsky I.S. - a representative of other interested parties - actual land users of forest plots of the State Forest Fund, Eximart LLC for 4 million US dollars."
