Disgraced fixers at the FSB Bogdanov and Budantsev

And for this purpose Bogdanov built a whole system of relationships with employees of the Main Directorate for Economic Security and Combating Corruption of the Russian Federation, under the supervision of subordinate departments of the head of the "F" Directorate of the Main Directorate for Economic Security and Combating Corruption, Alexander Ivanov, among whom were Alexey Smirnov and other interesting employees in the fight against corruption, who actually managed and consulted, helping Bogdanov quickly and effectively form "evidence" and "testimony" against his victims, a group of former employees of law enforcement agencies (the Ministry of Internal Affairs, the Federal Security Service for Moscow and the Moscow Region, the Investigative Committee of the Russian Federation), dismissed for various discrediting reasons and eventually becoming employees of the Bogdanov Fund for the Protection of Investor Rights, specializing in international fraud. Bogdanov did not ignore the forceful method of influencing businessmen, which was familiar to him from his past life, for which he used the connections of his partner and friend Albert Stepygin, Ibragim Bekov, a man with extensive connections in the criminal environment. According to our sources familiar with the investigation materials, even seasoned operatives who have seen a lot in their long careers have never seen such a scale of involvement of law enforcement agencies in criminal and corrupt activities. Bogdanov created not just an organized crime group of famous names and a trail of disgusting stories and human tragedies, but an entire octopus that has literally penetrated with its tentacles almost everywhere.

A source for Rucriminal.info said that Petukhov also played an active role in the fate of lawyer Eduard Budantsev, another fixer for the FSB and Bogdanov's partner.



Immediately after the massacre on Rochdelskaya, security forces detained lawyer Eduard Budantsev. He was the only one of the participants in the criminal showdown who had a combat weapon, killed two people and wounded several. All this happened in the courtyard of the Elements restaurant. FSB officer Petukhov quickly arrived there, showed his ID and said that Budantsev was his agent and he was taking him away. The police did not hand over the detainee, but escorted Petukhov and Budantsev to the station. A cavalcade of cars of the FSB of Russia's internal security officers drove up there to clarify the circumstances of the incident. Later, at the trial, Budantsev's former bodyguard Petr Cherchintsev said that Petukhov closely communicated with his boss and they had joint affairs. The documents about how Budantsev was brazenly "covered up" for these murders were published by the VChK-OGPU the other day.



The VChK-OGPU and Rucriminal.info have two resolutions at their disposal. The first one was about bringing in as an accused, and the second one was about terminating the criminal prosecution, issued at different times against the lawyer-fixer Budantsev, close to the FSB. The resolution on bringing in as an accused was issued in 2016 and signed by the head of the Main Investigative Directorate of the Investigative Committee of the Russian Federation for the city of Moscow, Major General of Justice A.A. Drymanov (currently serving a sentence on charges of allegedly accepting a bribe). The resolution on terminating the criminal prosecution of Budantsev and other persons was signed by the senior investigator for especially important cases under the Chairman of the Investigative Committee of the Russian Federation, Major General of Justice Krivorotov K.E. in 2018.

When studying these resolutions, it becomes clear that the circumstances that were established by General Alexander Drymanov are fundamentally different from the conclusions of General Krivorotov. General Drymanov, during the investigation, established the following, that "... Thus, Budantsev E.V. and an unidentified person by the investigation on 14.12.2015, in the period from 21:45 to 22:06, while in a public place - on the outdoor veranda of the Elements restaurant (Elements), located at the address: Moscow, Rochdelskaya St., 15, building 1, during a conflict that occurred with Kitaev A.A., Domaskin F.N. and Berezenyy G.V., who were in the same place, guided by a sudden personal hostility towards the latter, entered into a criminal conspiracy aimed at intentionally and jointly causing the death of the victims. During the specified period of time, Budantsev E.V. and an unidentified person by the investigation developed a joint plan to commit a of stupidity and distributed criminal roles among themselves. Thus, according to the agreement reached between the accomplices...”

That is, in simple terms, Budantsev and unidentified persons committed a group murder and a number of other criminal offenses.

The editors agree with the conclusions of General Drymanov, they are not subject to doubt and are fully consistent with the materials of the criminal cases.



From the resolution on the termination of the criminal prosecution of Budantsev, signed by investigator Krivorot, it becomes clear how and in what chronological order the significant procedural decisions were made and which officials were behind these decisions. The editorial experts carefully studied this resolution and compared it with the materials of the criminal cases and evidence. Previously, the editors have repeatedly published witness testimony, audio and video recordings from the scene, and expert opinions. The conclusion of the editorial experts is unambiguous, the information presented in the resolution of investigator Krivorot does not correspond to reality, is false and does not agree with the objective evidence in criminal cases.



We will give several examples of obvious inconsistencies. The facts presented in the resolution are refuted by the video recording, audio recording, details of telephone conversations, expert opinions, as well as witness testimony.



From the resolution of investigator Krivorot, "... The investigation established that on 14.12.2015, Budantsev E.V., who is a lawyer of the bar association "Dictatorship of Law" of the Bar Association of the Moscow Region, together with Cherchintsev P.V., and Kostrichenko V.V. in the evening, at the invitation of Kim. Arrived at the Elements restaurant to settle financial claims received by the latter from Misikova F.T. At the same time, Kostrichenko V.V. and Cherchintsev P.V. were armed with limited-damage firearms, and Budantsev E.V. with a short-barreled rifled award firearm, a Beretta 92 pistol"



These statements by the investigator were refuted during the trial:



- Budantsev arrived at the restaurant not at Kim's invitation, but on behalf of the Kazakh oligarch Kenges Rakishev. It has been documented that Budantsev and Kim met at the Elements restaurant on 14.12.2015, and did not know each other before the events. In conversations, Budantsev and the company are called "Fighters from the Chief." (confirmed by an audio recording, details, and witness testimony)



- Budantsev arrived not to settle financial disagreements, but as force support, on behalf of the Kazakh oligarch Kenges Rakishev. (confirmed by audio recording, details and witness testimony) It follows from the case materials that Budantsev did not take part in the negotiations, and did not represent anyone as a lawyer, including Kim Zh. Kim perceived Budantsev as a police officer.

From the investigator's resolution "... While attempting to resolve a financial dispute between Kostrichenko V.V., Cherchintsev P.V. and Budantsev E.V. on one side, Kitaev A.A. and Romanov E.A. on the other side, a conflict arose, during which Romanov E.A. suggested sorting things out on the street. After that, the parties to the conflict continued sorting things out on the veranda of the restaurant, where Kitaev A.A. began to demonstrate his weapon to Budantsev E.V. and other people who arrived with him. In response to these actions, Budantsev E.V. also demonstrated the pistol he had with him to his opponents." - The conflict between those present did not begin because of the resolution of a financial dispute, but on the basis of suddenly arising personal hostility related to the attempt by Budantsev and Kostrichenko to rudely enter the VIP room, without explaining to those present, including the security guards, the motives for their behavior and without introducing themselves. Kim was in the VIP room and was silent, thinking that Budantsev was a police officer.

- During the trial, it was established that it was Budantsev and Kostrichenko who suggested going outside to continue sorting out the relationship.

- The video recording shows that the private security company employee Kitaev did not show the weapon to those present, but only kept his hand on the holster (not prohibited by current weapons legislation).



- The video recording shows that Budantsev did not participate in the conversations on the veranda, he stood to the side, and at some point, without any reason, he pulled a pistol out of his holster and pointed the weapon at those around him, thereby creating a real threat to the people on the veranda. (such behavior is directly prohibited by weapons legislation)

From the investigator's resolution "...... After Budantsev E.V. demonstrated the weapon, on the command of Kochuykov A.N., Sinitsym A.V., Domaskin F.N., Kitaev A.A. and Gonovichev S.D. beat Budantsev E.V., causing the latter moderate bodily harm....." - As established by the judicial investigation, Kochuykov A.N. did not give any commands to the security guards, the guards acted independently on the basis of instructions, after an obvious threat from Budantsev, who took out a pistol and declared "I will shoot everyone!"

From the investigator's resolution I ".....In response to the actions of the attackers, Kostrichenko V.V. used a traumatic weapon against Kitaev A.A., as a result of which the people who were beating Budantsev E.V. stopped beating him and ran away, and Kitaev A.A. began firing shots from a traumatic pistol he had with him in the direction of Kostrichenko V.V. and Budantsev E.V. from a distance of more than five meters. At this time, having freed himself from the grip of Sinitsyn A.V., Budantsev E.V. directed Domaskin F.N., Berezina G.V. and Savichev S.D. towards Kitaev A.A. and, having reduced the distance with them, fired at them at least 7 shots from his Beret 92 pistol.



As a result of the shots fired, Budantsev E.V. inflicted a gunshot wound on Kitaev A.A. and Domaskin F.N., and Berezina G.V. gunshot wound causing serious bodily harm.

The above is fully confirmed by the evidence collected in the case.

-In the chronology of the incident, investigator Krivorot, apparently intentionally did not indicate that the first shots were fired by Budantsev E.V. at his friend Malakaev. The reason is careless or criminal handling of weapons. (Budantsev carries a pistol with the safety catch already removed and a cartridge loaded into the barrel, which is also prohibited by the law on weapons)

-After Budantsev's shots, Kostrichenko used the next weapon, while the video shows that Kostrichenko shoots at Kochuykov's back and at the guards lying on the floor. Kitaev used a traumatic pistol only after shots were fired at him by Kostrichenko and Budantsev.

-Investigator Krivorot, did not indicate in the ruling that the driver Domaskin was killed at the moment when he was dragging the wounded Kitaev away and did not pose any threat to Budantsev. Gonovichev, Berezina, Romanov received gunshot wounds and serious bodily harm, when they did not pose any threat to Budantsev.

Investigator Krivorot did not evaluate the frankly false and inconsistent testimony of Budantsev, which formed the basis for the sentence of the illegally convicted police officers Romashkin, Shakirov, Zinatulin.

The information presented in the decision of investigator Krivorot is completely refuted, calling into question his competence and suggesting his personal criminal interest in concealing objective facts.

Was it possible for investigator Krivorot to issue a knowingly illegal decision without the support of the employees of the Prosecutor General's Office? No! According to our source in the Prosecutor General's Office of the Russian Federation, Budantsev and Kazakh oligarch Kenes Rakishev's evasion of criminal liability through the prosecutor's office, with the support of FSB officers, was ensured by the team of former Prosecutor General of the Russian Federation Chaika and was personally supervised by Deputy Prosecutor General of Russia Viktor Grin.

Grin also actively participated in the fabrication of criminal prosecution of the Investigative Committee of the Russian Federation officers. It was Grin who, having violated procedural jurisdiction, transferred the criminal case against Maksimenko, Drymanov, Kramarenko to the Investigative Department of the FSB of the Russian Federation, controlled by Budantsev's patrons, regarding an alleged bribe from the people of the thief "Shakro Molodoy".



The editorial sources have no doubt that the criminal case against Budantsev will be reopened as soon as his patron from the Central FSB is removed from office, and the officials who ensured Budantsev's evasion of criminal liability will be punished as they deserve.

WANTED FSB fixer Bogdanov

Extortionist's tariff: 1 billion for security forces plus 1.5 billion - just like that



A source from the VChK-OGPU Telegram channel said that FSB officers arrested for extorting bribes of 15 billion rubles from co-owners of the Merlion company may be involved in an equally high-profile case - about extorting 1.5 billion rubles. And soon the real owners of QBF received a proposal from Eduard Budantsev and Yaroslav Bogdanov that the investigation and the FSB would stop at the arrested persons and that this would cost 0.5 billion rubles. But that's not all. They say that 0.5 billion will go to law enforcement. And another 1.5 billion rubles will have to be given personally to Bogdanov, who even had a cession agreement concocted for the corresponding amount. Because the real owners of QBF dragged their feet with the decision, a year after the first arrests, the company's CEO Stanislav Matyukhin and his deputy Vladimir Pakhomov were detained. After that, the price for solving the problem increased from 0.5 billion rubles to 1 billion (this is for the security forces). Plus 1.5 billion for Bogdanov. The prices, as it turned out, are very humane, considering the 15 billion that they extorted from Merlion. According to the VChK-OGPU, the security forces have audio recordings of negotiations with Budantsev and correspondence with him, as well as many documents related to Yaroslav Bogdanov.

As Rucriminal.info already reported, the assignment agreement for the demand from QBF for 1.5 billion rubles was concluded between Yaroslav Bogdanov and the former vice-mayor of Yekaterinburg Ilya Borzenkov, who is the wallet of the former senator of the Federation Council Arkady Chernetsky. It turned out that Borzenkov, wanting to squeeze 1.5 billion rubles out of QBF, hired Bogdanov and Eduard Budantsev from the "Dictatorship of Law" to resolve his issues through the Investigative Department of the Ministry of Internal Affairs of Russia. To do this, Borzenkov even transferred the rights to claim 1.5 billion for only 10 million rubles (famous Ural generosity). Priyl was supposed to be divided. For this, Bogdanov and Budantsev brought in friends from the FSB, the Investigative Department of the Ministry of Internal Affairs of the Russian Federation quickly concocted a case and sent the entire top management of QBF to a pretrial detention center.

Last week, law enforcement officers conducted searches in Bogdanov's offices and home, where many interesting materials were found. Bogdanov himself, as usual, went on the run to Dubai, fortunately his "partners" warned him in time, but Dubai, not London or New York, returns fugitive criminals to Russia in a disciplined manner, and as practice shows, you can't run all your life. There are many examples! And apparently, the current charges brought against Bogdanov are only the beginning of an incredibly large and complex criminal case, which will drag along many interesting names of the powerful of this world (for now). According to the editorial staff of the channel, charges are ahead for corruption (Articles 290, 291), extortion (Article 163) and the creation of a criminal community (Article 210). How Freedom Finance and Timur Turlov withdraw money from officials under the protection of Lubyanka



As Rucriminal.info has learned, there is a criminal group of people operating in Russia that, under the guise of an investment company (IK Freedom Finance LLC), initiates criminal cases against respectable citizens - Russian investors, in fact, takes away funds and withdraws them from Russia. These actions deprive the Russian budget of legitimate money (15% income tax already paid) in favor of members of the criminal group.

This criminal activity involves employees of the Freedom Finance holding and affiliated companies (from the jurisdictions of the Russian Federation, Kazakhstan, Cyprus, Belize, the USA), as well as high-ranking employees of the Investigative Committee of the Russian Federation and the Ministry of Internal Affairs of the Russian Federation.



Comprehensive information on these crimes and ordered criminal cases was provided to the security forces. However, according to the sources of Freedom Finance representatives themselves, they are supervised by the head of Directorate “K” of the FSB of the Russian Federation, Ivan Tkachev, which is why this situation is not allowed to proceed, and they can do whatever they want.

The main beneficiary and owner of the Freedom Finance group of companies is Timur Turlov. Around his company Freedom Finance, Turlov created a whole network of “laundries” and “transit shops”, which includes both Russian and foreign companies (including W-Empirical Holding Corp.)

The criminal activities of Freedom Finance are confirmed not only by information and certificates, but also by a number of criminal cases, in one of which several defendants give a complete breakdown of the criminal activities of Turlov, his accomplices and schemes, but this information is also not given further progress, - patron of Freedom Finance Finance" Tkachev protects his source of income.

He acts in conjunction with another well-known corrupt official in the country - the deputy of the Main Investigative Directorate of the Investigative Committee for Moscow, General Sergei Yarosh (there is information that they are relatives), who personally supervised and signed the documents on the initiation of the criminal investigation. Yarosh, as is known, does not make moves without Tkachev’s approval.

However, judge Kozlova E.A. has no experience or understanding of the essence of brokerage and trading activities on stock exchanges, which witnesses and the allegedly injured party take advantage of by giving deliberately false testimony. Based on these facts of perjury, an appeal to law enforcement agencies is now being prepared.



Rucrimnal.info sources have at their disposal audio recordings of negotiations between the deputy head of security at Freedom Finance, Eliseev, who, before initiating a case, holds a number of meetings with employees of the Ministry of Internal Affairs, the FSB, and a call with a lawyer, based on which it is obvious that the criminal cases are ordered: Eliseev talks about willingness to pay for the initiation of criminal cases, about patronage at the very top of department “K”, and proposes a scheme for initiating cases.



In addition, the above criminal case is not the only one; at least several other similar criminal cases are known. This indicates a systemic situation in which funds seized with the help of Russian intelligence services and money from Russian officials are sent to the United States.

Recently, a detailed letter was sent to the RF Investigative Committee addressed to Chairman Bastrykin outlining all the information about the Freedom Finance fraud and the illegal withdrawal of funds abroad, as well as about the criminal activities of some of his subordinates. However, to date there has been no response. Just as there is no investigation into the criminal actions of Turlov and his company, although there is more than enough evidence and witness testimony.

As Rucriminal.info wrote earlier, the Main Investigation Department of the RF IC is also investigating the case against three employees of the Directorate “M” of the FSB of Russia: Alexei Tsarev, Sergei Manyshkin and Alexander Ushakov. They are accused of a series of crimes, including receiving bribes totaling over 5 billion rubles. It turned out that it was the Directorate M of the FSB of the Russian Federation that was involved in organizing the initiation and lobbying of this case in the Investigation Department of the Ministry of Internal Affairs of the Russian Federation. And soon the real owners of QBF received an offer that the investigation and the FSB will focus on the arrested persons and it will cost 0.5 billion rubles. The proposal came from a trusted representative of the Directorate M of the FSB of Russia, Eduard Budantsev. Due to the fact that the real owners (R.V. Shpakov and others) delayed making a decision, a year after the first arrests (May 2021), the company’s General Director Stanislav Matyukhin and his deputy Vladimir Pakhomov were detained (still under house arrest! ). After this, the cost of solving the problem increased from 0.5 billion to 1 billion rubles.

As it turned out, the real owners of QBF delayed solving the problem; they could not (or did not want) to agree, primarily for several significant reasons:



- the greed and arrogance of the head of QBF, R.V. Shpakov, who has been “on the run” since January 2021. We have already written earlier that he managed to leave the Russian Federation using forged documents, not without the patronage of our law enforcement agencies. He was then and still is confident that he can solve the problem with “little blood loss,” i.e. significantly cheaper than the 1 billion rubles announced by Budantsev. ;



- The Administration of the President of the Russian Federation became involved in this case. One of QBF's clients who invested significant funds was a high-ranking AP official who oversees the department's special projects. After a personal meeting, Shpakov returned only part of the investment to him, stalled for time, promising to return the rest. At some point, it became a matter of principle and a high-ranking client connected an administrative resource. After this, it turned out to be not so easy for Budantsev and Shpakov to “resolve the issue” with the security forces;



- Timur Turlov, the founder and owner of the international investment company Freedom Finance, is also involved in this case. This famous character, who also escaped from the Russian Federation, received Kazakh citizenship in 2022 and renounced Russian citizenship, is worth dwelling on separately.



What does the Kazakh investment banker Turlov and Freedom Finance have to do with it?

In 2018, Timur Turlov’s Freedom Finance company received the “Russian Financial Elite” award as the fastest growing broker. In October 2019, the investment company Freedom Finance became the first financial organization from the CIS to receive a listing on the New York Stock Exchange (NASDAQ) under the ticker FRHC, and the company’s founder and permanent leader at that time, Timur Turlov, became one of the most famous investment bankers in Russia.

Timur Turlov was and is a long-time acquaintance, friend and partner of R.V. Shpakov, with whom the latter began organizing his business back in 2008. The name of Timur Turlov often appears in the materials of the QBF criminal case; former QBF top manager Zelimkhan Munaev has already given numerous confessions (volume 239) (Criminal case No. 42201007754000292, sentenced to 8 years in September 2023 and serving his sentence).

Shpakov turned the situation with the QBF criminal case to put pressure on Turlov with various arguments in his favor, in order to create for him the threat of possible criminal prosecution for previously completed transactions in the event of his capture or, in general, Turlov’s non-cooperation with him.

"Fighters from the Chief"

How Budantsev and Rakishev, controlled by the FSB of the Russian Federation, were scammed from a gang murder

At the disposal of Rucriminal.info and the telegram channel of the Cheka-OGPU, there were two resolutions, the first on the involvement as an accused, and the second on the termination of criminal prosecution, issued at different times against the lawyer-fixer Eduard Budantsev, close to the FSB of the Russian Federation. The decision to prosecute as a defendant was issued in 2016 and signed by the head of the Main Investigative Committee of the Investigative Committee for Moscow, Major General of Justice Drymanov (currently serving a sentence on charges of allegedly taking a bribe). The decision to terminate the criminal prosecution of Budantsev and other persons was signed by Major General of Justice Krivorotov, Senior Investigator for Particularly Important Cases under the Chairman of the Investigative Committee of the Russian Federation, in 2018.



When studying these decisions, it becomes clear that the circumstances that were established by General Alexander Drymanov are fundamentally different from the conclusions of General Krivorotov. General Drymanov, in the course of the investigation, established the following, that “... So, Budantsev E.V. and unidentified by the investigation person 14.12.2015, in the period from 21 h. 45 min. until 22 o'clock. 06 min., being in a public place - on the street veranda of the restaurant "Elements" (Elemente), located at the address: Moscow, st. Rochdelskaya, 15, building 1, during the conflict that took place in the same place Kitaev A.A., Domaskin F.N. and G.V. In the specified period of time Budantsev E.V. and a person unidentified by the investigation, developed a joint plan for committing a crime and distributed criminal roles among themselves. So, according to what was reached between the accomplices ... "

That is, in simple terms, Budantsev and unidentified persons committed a gang murder and a number of other criminal offenses.

The editors agree with the conclusions of General Drymanov, they are beyond doubt and are fully consistent with the materials of the criminal cases.



From the decision to terminate the criminal prosecution of Budantsev, signed by investigator Krivorotov, it becomes clear how and in what chronological sequence significant procedural decisions took place and which of the officials was behind these decisions. Editorial experts carefully studied this decision and compared it with the materials of criminal cases and evidence. Previously, the editors have repeatedly published testimonies of witnesses, audio and video recordings from the scene, and expert opinions. The conclusion of the editorial experts is unequivocal, the information set out in the decision of the investigator Krivorotov is untrue, false and does not agree with objective evidence in criminal cases.



Here are some examples of obvious inconsistencies. The facts stated in the decision are refuted by video recording, audio recording, details of telephone conversations, the conclusion of experts, as well as the testimony of witnesses.



From the decision of the investigator Krivorotov, “.... The investigation established that on December 14, 2015, E.V. evening, at the invitation of Kim. Arrived at the restaurant "Elements" to settle the financial claims against the latter from Misikova F.T. At the same time, Kostrichenko V.V. and Cherchintsev P.V. were armed with firearms of limited destruction, and Budantsev E.V. premium rifled short-barreled firearms Beretta 92 pistol"

These allegations of the investigator were refuted during the judicial investigation:

- Budantsev arrived at the restaurant not at the invitation of Kim, but on behalf of the Kazakh oligarch Kenes Rakishev. It has been documented that Budantsev and Kim met at the Elements restaurant on 12/14/2015, before the events they did not know each other. In conversations, Budantsev and the company are called "Fighters from the Chief." (confirmed by audio recording, detailing and testimony of witnesses)

- Budantsev arrived not to settle financial disputes, but as a power support, on behalf of the Kazakh oligarch Kenes Rakishev. (confirmed by audio recording, details and testimonies of witnesses) It follows from the materials of the case that Budantsev did not take part in the negotiations, did not introduce himself as a lawyer to anyone, including Kim Zh. Kim perceived Budantsev as a police officer.

From the decision of the investigator “... When trying to resolve a financial dispute between Kostrichenko V.V. Cherchintsev P.V. and Budantsev E.V. on the one hand, Kitaev A.A. and Romanov E.A. on the other hand, a conflict arose, during which Romanov E.A. offered to find out the relationship on the street. After that, the parties to the conflict continued to sort things out on the veranda of the restaurant, where Kitaev A.A. began to demonstrate BudaE.V. Ntsev and other who arrived with those persons their weapons. In response to these actions Budantsev E.V. also demonstrated to his opponents the pistol he had with him.

- The conflict between those present did not begin because of the resolution of a financial dispute, but on the basis of a sudden personal hostile relationship associated with an attempt in a rude manner by Budantsev and Kostrichenko to enter the VIP room, without explaining to those present, including security officers, the motives his behavior and without introducing himself. Kim was in the VIP room and was silent, thinking that Budantsev was a police officer.

- During the trial, it was established that it was Budantsev and Kostrichenko who proposed to go out into the street to continue clarifying the relationship.

- The video recording shows that the employee of the private security company Kitaev did not demonstrate weapons to those present, but only keeps his hand on the holster (not prohibited by the current legislation on weapons).



- The video recording shows that Budantsev did not participate in the conversations on the veranda, stood aside, while at some point he unmotivatedly pulled out a pistol from his holster and pointed the weapon at others, thereby creating a real threat to people on the veranda. (such behavior is expressly prohibited by gun laws)

From the decision of the investigator “......After the demonstration of Budantseva E.V. weapons at the command of Kochuykov A.N. Sinitsym A.V. Domaskin F.N. Kitaev A.A. and Gonovichev S.D. subjected to beating Budantseva E.V. causing moderate bodily harm to the latter ..."

-As established by the judicial investigation Kochuykov A.GN. he did not give any commands to the security officers, the guards acted independently on the basis of instructions, after an obvious threat from Budantsev, who took out a gun and declared “I will shoot everyone!”.

From the decision of the investigator “..... In response to the actions of the attackers Kostrichenko V.V. applied against Kitaeva A.A. traumatic weapon, as a result of which those who beat Budantsev E.V. persons stopped beating him and fled, and Kitaev A.A. began to produce in the direction of Kostrichenko V.V. and Budantseva E.V. shots from the traumatic pistol he had with him from a distance of more than five meters. At this time, freed from the capture of Sinitsin A.V. Budantsev E.V. sent towards Kitaev A.A. Domaskina F.N. Berezina G.V. and Savicheva S.D. and, having reduced the distance with them, fired at least 7 shots at them from his Beret 92 pistol.

As a result of the shots Budantsev E.The. caused Kitaev A.A. and Domaskin F.N. gunshot wound incompatible with life, Berezina G.V. gunshot wound that caused serious bodily harm.

The foregoing is fully supported by the evidence collected in the case.

- In the chronology of what happened, investigator Krivorotov, apparently deliberately did not indicate that the first shots were fired by Budantsev E.V. in his friend Malakaev. Cause, careless or criminal handling of weapons. (Budantsev carries a pistol with the fuse already removed and the cartridge sent into the barrel, which is also prohibited by the law on weapons)



-After Budantsev's shots, the next weapon was used by Kostrichenko, while the video shows that Kostrichenko is shooting at Kochuykov's back and at the guards lying on the floor. Kitaev used a traumatic pistol only after being shot at by Kostrichenko and Budantsev.

- Investigator Krivorotov did not indicate in the decision that the driver Domaskin was killed at the moment when he was dragging the wounded Kitaev away and did not pose any threat to Budantsev. Gonovichev, Berezin, Romanov received gunshot wounds and serious bodily harm when they did not pose any threat to Budantsev.

Investigator Krivorotov did not evaluate the frankly false and inconsistent testimony of Budantsev, which formed the basis of the verdict, of illegally convicted police officers Romashkin, Shakirov, Zinatulin.

The information presented in the decision of investigator Krivorotov is completely refuted, casting doubt on his competence and suggesting his personal criminal interest in concealing objective facts.

Was it possible for investigator Krivorotov to issue a deliberately illegal decision without the support of the staff of the Prosecutor General's Office? No!

According to a Rucriminal.info source, Budantsev and the Kazakh oligarch Kenes Rakishev avoided criminal responsibility through the prosecutor's office, with the support of the FSB, was provided by the team of the former Prosecutor General of the Russian Federation Chaika and was personally supervised by the Deputy Prosecutor General of Russia Viktor Grin.

During the hearing, the court compared Budantsev's words with audio and video recordings of the events of that evening, as well as with details of phone calls.

So, for example, at the very beginning of the process, the lawyer announced his arrival at the Elements restaurant after a call from the owner of the restaurant Zhanna Kim. According to him, the girl allegedly asked for help in negotiations with unknown people demanding that she return the debt.

It was revealed in court that there was no such call on the record, and that Kim's conversation was not on the audio recording. The girl recorded the meeting on a dictaphone.

When Budantsev's lie became obvious, he stated that everything seemed to him. It also seemed to him that Kim reported that the amount that extortionists allegedly demanded from her had increased.

In general, one gets the impression that Vasyuchenko wanted to deal with this case according to the law, and tried to find the truth. Maybe that's why instead of the post of chairman of the Kuntsevsky court, for which she was preparing, she was dismissed.

Now it is already obvious that the criminal case, which became the reason for the fourth military war, was fabricated for a specific purpose - to get Budantsev out of harm's way. His patrons are still afraid of publicity, because after the shootout and subsequent power manipulations, Nursultan Nazarbayev called the presidential administration and asked to deal with this story. After that, the country's leadership was given an answer that the situation had been settled. No one reported on the real state of affairs. Nazarbayev's call was caused by the fact that the cover for Zhanna Kim was a businessman from Kazakhstan, Kenes Rakishev, who is also called the wallet of the ex-president of Kazakhstan.

Lies of a lawyer in court are a strong reason to reconsider the events of those days and hold the lawyer-declarer liable for giving false testimony. And in general, if the court made decisions according to the law, it would recognize that there were no grounds for the use of weapons by him, and then Budantsev should have been in the dock on charges of murder.

But the criminal does not tolerate the subjunctive mood. The lie of Budantsev was revealed at the stage of the investigation, but at the direction of the senior investigator under the chairman of the ICR, Konstantin Krivorotov, the case was put on the brakes and stopped. Budantsev remained at large, and Krivorotov received the Order of Courage for "courage and selflessness in the line of duty."

Detained for the murder of Budantsev, he was inside the building of the Trekhgornaya Manufactory, where they were preparing to deliver him to the police department under escort of police officers, when a man in civilian clothes approached the police officers and civilians who were nearby, presented an identity card of an employee of the FSB of the Russian Federation, and publicly stated that Budantsev is his agent and must be released. Lazutin, the deputy head of the CID of the Internal Affairs Directorate of the Central Administrative District, who was at the scene, told Petukhov that Budantsev had been detained on suspicion of committing a gang murder and would be taken to the Presnensky police department. Budantsev prepares a certificate on topics of interest to him (mainly commercial interest), in which he indicates the essence of the issue and traditionally introduces fiction into the certificate regarding persons (businessmen, government officials, law enforcement officers, judges, etc.) who are counteracting him, about allegedly their involvement in organized crime and other defamatory information. Accordingly, no one checks the accuracy of this information, after which certificates are born already signed by the employees of the FSB of the Russian Federation, which in modern Russian reality are a sentence. Thus, Budantsev took possession of a whole number of enterprises, dismissed or sent to jail on a fictitious pretext a number of law enforcement officers who counteracted him.

On this recording, it was not only heard that there was no tough “showdown” in Elements, as Zhanna Kim and lawyer Eduard Budantsev represented, but the name and surname of the real culprit of the sad events was called - a businessman from Kazakhstan Kenes Rakishev, known as " Nazarbayev's wallet. By order of the latter, a real hunt was arranged for the record.



Even in the morning of the day when the shooting took place on Rochdelskaya, a meeting was scheduled between Kim and representatives of the designer Fatima Misikova. To protect the interests of Kim, the people of Kenes Rakishev singled out detective Fenechkin. After listening to the restaurateur girl, he said that a civil law dispute was not his specificity and advised him to record all the events on a dictaphone. In the midst of the conflict, Zhanna Kim called the detective and asked him to drive up. In the restaurant, she gave Fenechkin a record of what happened before the shootout. Kim's mistake, in fact, became the only clue to understanding the truth in this story. From the conversations that took place between the participants in these events and were preserved on record, it becomes clear that the conflict was at the level of a dispute between business entities and nothing would have happened if the lawyer Eduard Budantsev had not taken out a weapon. Representatives of Kenes Rakishev understood that the audio recording could destroy the script they had built, and the hunt began for her. Rakishev's people invited the detective to meet at the Ukraine Hotel. This is what he himself says in his testimony in court. At the hotel, he was told that he had to give the audio file, but he refused. After that, the detective was searched, but nothing was found: Fenechkin did not live at the place of registration. After another refusal, the officers of the Internal Affairs Directorate for the Central Administrative District of Moscow, together with Zhanna Kim and representatives of Rakishev, tried to carry out operational measures against Fenechkin.



We are publishing a transcript of the negotiations between Zhanna Kim and the operator of the service "02" of the Main Directorate of the Ministry of Internal Affairs for Moscow, the conversation took place on December 14, 2015 at about 20 hours and 30 minutes.

From Zhanna Kim's message to the 02 service, it follows that the reason for calling the police was the presence of PSC employees on the veranda, and not what was happening inside the restaurant. To the question of operator 02, Zhanna Kim says that negotiations are underway regarding repairs, that no one is demanding anything, people on the street are not armed, someone is asking her to go outside. In the Presnensky Court, the audio recording was compared with the video cameras and it was found that some time before the call to service 02, the following dialogues took place between the persons participating in the negotiations. Dialogue No. 1. Zhanna Kim says to the security guard of the Elements restaurant, “Don't worry about anything. They just said something to them, and now we will answer them and that's it. Now the fighters from my boss will fly up. Everything is all right. (In this dialogue Zhanna Kim means Kenes Rakishev, the fighters - Budantsev and company.) Dialogue No. 2 “Zhanna Kim asks the contractor a question— And people will leave the terrace. Can it be done? (Referring to the employees of the private security company located on the veranda). In response, her husband Denis Kim whispers in her ear, “Don't, don't let them stand. Let them stand. Zhanna Kim replies, to Denis Kim-A, (huh?). Denis Kim in response to Zhanna Kim - “It’s better for us that they stand” (referring to the private security company located on the veranda). At the same time, during the dialogues available on the recording, the contractors told Jeanne Kim that there was a private security company on the veranda and guarded them, and if they strained her, they ready to give the command to the private security company to withdraw.

Budantsev's team in Moscow has long been known for providing services in the forceful seizure of enterprises, knocking out debts, active cooperation with the Chechen and Tagansky organized crime groups. Buantsev's clients include Vasily Anisimov, Kenes Rakishev, Alisher Usmanov. One of the latest takeovers is the enterprise OOO Zavod orgsintez Oka, located in the Nizhny Novgorod region, Dzerzhinsk, the victim Yevgeny Nikulin is still unable to initiate a criminal case. The assets of the enterprise were recorded on the name of an active participant in the shooting Kostrichenko, pressure on the victim was personally exerted by Budantsev in the premises of the law office Dictatorship of Law. They implemented the same forceful method in the Elements restaurant.

In the Presnensky Court, when comparing the video recording with the audio recording made by Zhanna Kim, it was established that the conversation with the operator of the “02” service was carried out in the presence of a police officer of the GNR OMVD Presnensky Karikh, at the time of being on the veranda of the restaurant, while on the veranda at the moment there were already no employees of the private security companies of the indicated Zhanna Kim in a message to the operator "02". Literally ten minutes before Zhanna Kim's call to the "02" service, the police officers checked the documents and verbally interrogated the employees of the private security company and did not reveal any violations in their actions. After that, the employees of the private security company got into their cars, which had state. rooms and drove away from the restaurant. At the same time, the conversation between Zhanna Kim and the police officer was recorded on a dictaphone. From the conversation between the police officer and Zhanna Kim, it follows that there are no grounds for detaining the employees of the private security company and they were lawfully on the veranda, guarding the people inside the restaurant, they did not have weapons. There were no other dialogues between Zhanna Kim and employees of the Presnensky police department. However, in her testimony prior to the issuance of the audio recording, Zhanna Kim claimed to the investigator that she had informed the SNR officers about the extortion being committed against her and asked them to take action, to which the officers replied, “Can we leave?” In subsequent testimony, Zhanna Kim added unreliable information about the presence of weapons in the private security company.



All dialogues between Kim Zhanna and Budantsev inside the restaurant do not contain information about the commission of illegal actions against her. A dialogue was recorded between Budantsev, Kostrichenko and Zhanna Kim. Budantsev turns to Jeanne Kim "Well, what?" "We are this, from the Criminal Investigation", "We are the Criminal Investigation". In this dialogue, Budantsev informs Kim Zhanna that he and Kostrichenko are police officers. Which does not correspond to the version of Budantsev and Kim Jeanne that he was her lawyer. A similar conversation was recorded in the VIP room, where Budantsev and his company, together with security officer Shakirov, are checking documents. So Budantsev introduced himself as an employee of the Moscow Criminal Investigation Department and shows a certificate of a police officer, after which he and Kostrichenko begin to check the documents of people in the restaurant. At the same time, their further testimony seems completely illogical, according to Budantsev and Kostrichenko, illegal actions against Kim Zhanna and his company continued, and the detective Shakirov was inactive.

Jeanne Kim also lied about the private detective Fenechkin. In her primary testimony, Zhanna Kim does not indicate the fact of contacting the detective at all, and did not inform the investigator about the presence of an audio recording of the conversations. And to the direct question of the investigator, she answered that she had turned for help only to Budantsev, with whom she had an agreement to provide legal assistance. About Fenechkin, Zhanna Kim remembered only when the latter, contrary to the requests of Kenes Rakishev's comrades, gave out an audio recording of conversations in the Elements restaurant, and during interrogation told the truth about what was happening in the restaurant. At the same time, Zhanna Kim informed the investigator, “.... Why Anton (Fenechkin) came at that very moment, I don’t know, I can only say I didn’t call him, didn’t ask him to come. Anton asked if I had an audio recording of the ongoing conversation, to which I explained that I had the recording, after which Anton told me to give him the recorder. Further, Zhanna Kim began to assert that Fenechkin was present during conversations with police officers, in which she and Budantsev and his comrades asked to take measures to suppress extortion, but the officers were inactive. Fenechkin categorically rejected these allegations of Kim Zhanna, Peter Cherchintsev supported his testimony, informing the court that this was a lie invented by Budantsev.



At the same time, it is not clear why, in the presence of serious disagreements in the testimony of Kim Zhanna and Fenechkin, there was no confrontation between them at the stage of the investigation. Also It is not clear why the investigators did not confront Kim Zhanna and detective Shakirov, there were very significant discrepancies in their testimony. At the trial in the Presnensky court, the testimony of Zhanna Kim was refuted by the details of telephone conversations. Zhanna Kim and Fenechkin called up on the afternoon of December 14, 2015, met near the building of the Presnensky Department of Internal Affairs, where Fenechkin suggested Zhanna Kim write a statement, but she refused. And in the evening Zhanna Kim called Fenechkin more than six times and asked to drive to the restaurant, their conversation was recorded on a dictaphone.

It was necessary to discredit the testimony of the police officers of the detective of the Ministry of Internal Affairs Khamovniki Romashkin, the detective of the Ministry of Internal Affairs Presnensky Shakirov and the district police officer Zinatullin, it was not the task to imprison the employees of the GNR (they had no influence on the murder case), although they were the first to arrive on a call and had to take all necessary measures and bear the corresponding responsibility. However, as we see, justice in the Presnensky court was selective. It was Romashkin, Shakirov and Zinatullin who became eyewitnesses to the murder and the main witnesses for the prosecution of Budantsev, and also insisted that no illegal actions had taken place in the restaurant.

A Rucriminal.info source reported that in May 2016, Budantsev's accusation was strengthened by new articles, the case was taken to the Investigative Committee of Russia and they planned to involve Kenes Rakishev as an accomplice to the murder. Zhanna Kim was ready to change her testimony and tell the truth (respectively, not in favor of Budantsev). Petr Cherchintsev also wanted to tell the truth about the events in the restaurant at the investigation stage. These plans were prevented by the detention of the leadership of the Moscow Investigative Committee, and the subsequent discrediting of the employees of the Russian Investigative Committee.

A very interesting legal assessment of what is happening in the restaurant was described in the verdict by judge Vasyuchenko “... During the trial, it was established that there were disagreements between Kim Zh, on the one hand, and Misikova F.T., regarding issues of payment for repair work carried out in the restaurant” Elements, as well as on the quality of these works. The position of Kim J was that she, in her opinion, completely produced Misikova F.T. Payment for all construction work carried out in the Elements restaurant. In connection with the poor-quality performance of part of the work, Misikova F.T. owed her (Kim Zh.) money. The position of F.T. Misikova, in turn, was that Kim Zh did not pay for part of the work done by her, which she (Kim Zh) had to pay directly to the persons who directly carried out these works. These circumstances are confirmed by an audio recording of conversations, the content of which was not disputed by any of the participants in the process.

From the protocol of the inspection of the video recording dated 05.10.2017, it follows, “... that at 21:47. 07 sec, at the moment when Kostrichenko, Cherchintsev approached the doors of the VIP room, Shakirov at 21 o'clock. 47 min. 07 seconds, taking his hat, he went to the exit from the restaurant hall, that is, just at the moment the conflict began to develop ... ".

Having studied the materials of the criminal case, it is clear that the conflict began only after detective Shakirov left the restaurant, at that time Budantsev and his company wanted to go into the VIP room where the negotiations were taking place. The guards of the persons participating in the negotiations asked Budantsev “Who are you?” Budantsev, without answering, tries to enter the VIP room, he is blocked by security. At this moment, a personal conflict also begins between Cherchintsev and the negotiator. Zhanna Kim, being in the VIP room, is silent (after all, she thinks that Budantsev and the company are police officers). From the testimony of the lawyer Petrosyants, (represented the interests of Zhanna Kim), it follows that Budantsev invites everyone to go out into the street. Further, according to CCTV cameras and testimonies of witnesses on the veranda, Cherchintsev and Romanov are sorting out the relationship, Budantsev stands aside, does not enter into dialogues with anyone. At some point, Budantsev, in violation of the law on weapons, takes out a pistol with the words "I will shoot everyone!" and points the barrel at people. After that, the staff of the private security company tried to calm him down. But, Budantsev starts to shoot. As a result, two people were killed, eight seriously injured.

Thus, the court established that there was a civil law dispute in the restaurant, and the conflict began on the basis of a sudden personal hostile relationship. The court itself did not establish any raider seizure, or extortion, let alone the inaction of police officers. It turns out that the verdict was issued despite the obvious absence of corpus delicti in the actions of the police officers and only on the basis of the testimony of the interested parties, which were refuted during the trial. The materials of the judicial investigation of the Presnensky Court are a ready-made criminal case against Budantsev, Rakishev and the company. The question remains why it was not a just sentence, but the higher authorities approved it, and who benefited from it?

The editorial source said that in discredit officers of the Main Directorate of the Ministry of Internal Affairs of Moscow and the Investigative Committee for Moscow participated in the police station and acted in sync with the protection of Budantsev, instead of fixing traces of crimes committed by Budantsev and his company, helping to protect employees, they falsified documents, conducted searches at a private detective , in order to find an audio recording, they tried to frame the detective by the RSD of the Internal Affairs Directorate for the Central Administrative District of Moscow, persuaded the witnesses to slander.

During the proceedings on the events on Rochdelskaya, the Investigative Committee was divided into two camps, some openly sided with Rakishev and Budantsev, while others established the objective truth, for which they paid. Unfortunately, the absence of the institution of unity of command in the Investigative Committee of Russia, as well as the provision of false information to its Chairman, led to such sad consequences for the entire service and to the discrediting of the entire law enforcement bloc of Russia.
