On August 3, Valery Markelov's death certificate was presented to the Moscow City Court by his defense. Zakharchenko, who had lost a lot of weight and was unusually restrained, was brought to the meeting room in person, and his alleged accomplices Viktor Belevtsov and Vasily Kritinin were connected via videoconferencing. Markelov's brother Mikhail acted as the legal representative of Markelov, who declared Valery Markelov's innocence and asked to cancel the verdict.

Kritinin's defense immediately issued a statement about the death of his client's father, as well as the illness of his child. After that, the court proceeded to announce the appeals against the verdict, which the defenders called "inadmissible, unfounded, up to typos copied from the indictment", asking him to cancel and issue an acquittal.

After that, Zakharchenko took the floor. He emotionally spoke about the fact that he was never allowed to get acquainted with the evidence in the case, primarily with the "Platform", where, according to the prosecution, all the "black" cash transactions were reflected, and also questioned the qualifications and impartiality of those who spoke in the Presnensky court witnesses. In the end, he asked to acquit all the accused "due to the absence of a crime event."



State prosecutor Milana Digaeva predictably began to object, noting that no one prevented the defenders and the accused from studying the evidence, calling them exhaustive, sufficient and consistent, and also examined in court to the extent necessary.

She asked that the sentences of Zakharchenko, Belevtsov and Kritinin be left in force, and that the criminal case against Markelov be dropped in view of his death.

The cornerstone requirement of the defenders - the study of the laptop with the "Platform" was rejected by the court, citing the absence of such a need and supporting the corresponding petition of the state prosecution.

Zakharchenko, who started the debate, had to be stopped and, at the request of the presiding judge, “to explain to him the essence of the judicial debate.” “Your honor,” the ex-colonel said after a short break, “following your instructions, I will reduce my 118 arguments to a minimum.” After that, he talked for another half an hour about the fact that he paid for his vacation in Sochi himself, did not receive any bribes, and no one provided evidence to the contrary.

Lawyer Alexander Gofshtein in his speech pointed out that, in accordance with all legislative norms, Markelov's sentence should be canceled, and after that the criminal case against him should be dismissed. Separately, Gofshtein noted the unsubstantiated accusations, their stereotyped, inconsistent, groundless and "absurdity."

In a surprisingly short last word, Zakharchenko asked for "law and justice." To the amazement of those present, who expected that this would not happen until Friday, the judges went into the deliberation room to make a decision.



The troika of the Moscow City Court, chaired by Inna Tardzhumanyan, determined that the criminal case against Markelov should be terminated, the sentence canceled, and the seizure of property removed. The verdict against Dmitry Zakharchenko, Vasily Kritinin and Viktor Belevtsov was upheld.

According to the telegram channel of the Cheka-OGPU, the general director of Evraplace LLC was recorded in the lobby of the Balchug hotel together with Zakharcheko, the latter came to the entrepreneur’s table after a conversation with the “wallet” and former son-in-law of Mikhail Mishustin Yevgeny Udodov, which took place at the entrance to the hotel a couple of weeks before the arrest of the colonel. A conversation between Selyakov and Zakharchenko, during which Udodov was also discussed.



The beneficiary of Evraplace, whose CEO was Selyakov, is businessman Alexander Karmanov - Forbes called him the "king of the state order" (large contracts from Kagprom and Transneft), as well as a producer and co-owner of a TV show on a channel from the Gazprom-Media network.

In addition to Selyakov’s business ties with Karmanov, there is such a moment: the latter instructed Selyakov to deal with one check of the security forces, this instruction came to the mail of lawyer Belevtsov, a friend, countryman and assistant to Zakharchenko.

Selyakov ended up in custody at the end of 2020 on charges of fraud. This case, at least directly, is not connected with the portal site. According to the Cheka-OGPU, the acting general director of the Lotos Shipbuilding Plant wrote a statement to the authorities about a violation of technology during the repair of one workshop of this plant with a loss of about 30 million rubles, and the Investigative Department of the Ministry of Internal Affairs named Selyakov as the beneficiary of the executing company. The latter claims that two months before the initiation of the case, the company that received the state contract itself applied to arbitration with a demand to pay for the work performed.

Selyakov believes that he was ordered and the level of such an “ordinary” case is not at all the SD of the Ministry of Internal Affairs. Another question is what he can tell the investigation.

On March 23, the Presnensky District Court of Moscow continued to consider the case of "billionaire" Colonel Dmitry Zakharchenko. According to the investigation, he received billions in bribes for patronage from the largest contractors of Russian Railways. In January 2022, the court began a detailed examination of the evidence of Zakharchenko's defenders and his alleged bribe givers. The defense also presented its own witnesses, from whose testimony it followed that in the notorious "Platform" (or eb2), where, according to the investigation, illegal financial transactions against Zakharchenko were reflected, there is no direct evidence fixing the facts of the transfer and even the passage of money. In addition, from numerous testimonies, it turned out that people who, according to the investigation, were closely related to each other, in fact, barely knew each other. The “second case of Zakharchenko” has been considered in the Presnensky Court since January 2021, and its participants expect that the verdict could be handed down by the May holidays. The meeting, which began with an hour and a half delay, was not held in the hall that had already become familiar to the participants in the process, but was moved to another, more spacious room: the state prosecutor Milana Digaeva decided to present the testimony of Yevgeny Selyakov (a good friend of Zakharchenko, Viktor Belevtsov and Vasily Kritinin, who are on dock in the present case). Selyakov spoke for a long time about the details of the personal lives of his acquaintances (however, they were of little relevance to the case), all the time emphasizing that the relationship between them was “friendly”, and “I did not have to carry out any orders from them.” A couple of times in the testimony of Selyakov, the names of Motorin and Stankevich surfaced: according to him, he heard about them from one of his comrades. Once he happened to cross paths with Markelov: Selyakov, who was engaged in construction, offered him his services as a contractor, "however, he received a negative answer: we did not meet again."



The meeting was then followed by a break. It was connected with the fact that one of the defendants in the case, the ex-co-owner of the 1520 Group of Companies, Valery Markelov, feels worse every day, which is noticeable even in his appearance: over the past three months he has lost a lot of weight and is obviously weakened. During the meeting, his lawyer asked the judge to give an opportunity to examine the defendant to the doctors of a private ambulance right in the courthouse. The court gave permission for this, provided that an ordinary ambulance was also involved, but the convoy allowed only state doctors to Markelov, referring to the instructions.

After a short break, during which Zakharchenko amused the audience with a story that numerous admirers write letters to him and even propose marriage (a certain Ms. Chichulina, who, as it turned out, wrote about Zakharchenko even to judge Sergei Artemov, was especially persistent), the defense invited Alexey Savitsky (Associate Professor of Moscow State Law Academy, member of the Department of Forensic Examinations). Based on the results of studying the documents of the case (primarily “Platka”), the expert showed that they clearly lack details and documents that would unambiguously prove the fact that money was spent in favor of Zakharchenko or other persons, therefore it cannot be argued that the movement of funds in principle took place . “Even taking into account the fact that we are talking about rough accounting, not a single fact of posting can be established, and the very conclusion of a specialist who studied the database has no scientific or even economic justification,” Savitsky summed up. Then his conclusions were illustrated with various examples from The Playground. Based on this speech, lawyer Zakharchenko asked the judge for a new examination of the financial calculations given in the case (and on the "Platform"). Judge Artemov did not make a decision right away, since the state prosecution represented by Milana Digaeva was not ready for such a turn, promising to express her attitude to the petition next time.



At the end of the five-hour session, the court, to everyone's satisfaction, began interrogating Zakharchenko, whose speech during the entire process was distinguished by figurativeness, not always appropriate length and numerous irrelevant reflections that caused a smile and stable interest of those present. The ex-colonel spoke about his friendship with Avsholum Yunaev (the head of Gazprom Avtomatizatsiya, which, according to the prosecution, paid for Zakharchenko’s vacation in Sochi), saying that he did not receive any bribes from him, did not discuss work issues, and money for a ticket to Sochi during the New Year holidays 2015-2016 returned. In his speech, Zakharchenko called the bankers Chuvilin and Gorbuntsov “duty applicants” and “scammers that cause a negative reaction in any normal person”, suggesting that the court disregard their testimony as mosh ennicheskimi. Markelov, Stankevich and Motorin Zakharchenko called "normal men with whom normal, but not close and not business relations have developed." The owners of GK 1520 - the largest contractor of Russian Railways, who worked under the "roof" of Dmitry Zakharchenko - as it turned out, is related to the very dubious structure for issuing microloans "VIVA Money", which all over Russia makes hundreds of people indebted, who in reality did not take from them never microloans. We are talking about the co-owners of GK 1520 Valery Markelov (formally former), Boris Usherovich and Alexei Krapivin.



Residents of Russian regions massively complain that microcredits are issued for them without their knowledge. So, writes 74.Ru, a resident of Chelyabinsk faced such a situation. Without her knowledge, they took out a microloan from VIVA Money.

Similar cases occurred in the Novosibirsk region, where this company also appeared. As one of the victims told the NGS, someone took 5,000 rubles on her behalf. at 358% per annum in VIVA Money. And the Siberian is not alone.

There are quite a few victims of VIVA Money. The Banki.ru website, according to the agency, describes several stories that occurred from May to December 2021. All of them are similar: a person accidentally finds out that a microcredit has been issued to him. At the same time, different amounts are mentioned: from 3,000 to 11,000 rubles.

The microfinance company Center for Financial Support (CFS) operates under the VIVA Money brand.

The owner of the CFP is the Cypriot offshore Guinford Management Ltd., the largest share (48%) in which belongs to businessman Roman Mironchik, he also heads the board of directors of JSC IFC CFP (VIVA Money). The remaining share is distributed among seven individuals and two more offshore companies.

Pivovar and Uchaev also have 20% each in Sima Farm LLC (Yuryev-Polsky district of the Vladimir region), where 20% belong to Dmitry Maistrenko, a friend and business partner of the same Alexei Krapivin. Of the small co-owners of the offshore, Alexey Pugachev, a friend and business partner of Boris Usherovich and Valery Markelov, is of interest.



Some of the offshore co-owners and top managers of CFP are related to another microfinance company, Finpoint.

There is an opinion on the market that it is Krapivin, Usherovich and Markelov who are the full-fledged co-owners of this microfinance empire. RZD money is not enough.

Dmitry Zakharchenko began his career as an underground billionaire by serving in his position at the GUEBiPK of the Ministry of Internal Affairs of the Russian Federation the interests of a group of bankers, including the owners of Industrial Credit Bank. (At that time, Dmitry Motorin, a companion of Usherovich and Markelov, held the position of deputy chairman of the board in it). Zakharchenko's task was to protect credit institutions from the interest of law enforcement and fiscal departments.

At the same time, all these banks "laundered" gigantic sums for structures that receive billions in contracts from Russian Railways. We are talking about dozens of companies that later became the 1520 Group of Companies. The owners of this structure were Andrei Krapivin, adviser to the head of Russian Railways, Vladimir Yakunin (after his death, his son Alexei became the director), Valery Markelov and Boris Usherovich. Later, bankers, including Dmitry Motorin, actually became one with 1520. And the functions of Zakharchenko have expanded significantly. From now on, he began to monitor security and protected not only banks, but also structures included in "1520" from law enforcement officers and tax authorities.

It is clear that the functions of the "roof" for this entire business, based on the theft of billions of rubles received from Russian Railways, were performed not only by Zakharchenko, there were other "siloviki".

With the active assistance of the management of the Russian Railways of the times of Yakunin, "1520" acquired the service enterprises of the railways, suppliers of products that simply could not be removed from the "chain" of the normal functioning of the Russian Railways. And the number of such enterprises "1520" was constantly growing, and with them the amount of contracts was growing. Moreover, these were such amounts that annually allowed tens of billions, or even hundreds of billions of rubles to be transferred into pockets. It was Colonel Dmitry Zakharchenko who covered the embezzlement through the Ministry of Internal Affairs of the Russian Federation.

In the fall of 2018, all the co-owners of 1520 fled from Russia, except for Markelov and Krapivin. Markelov was arrested as part of the case against ex-employee of the GUEBiPK of the Ministry of Internal Affairs of the Russian Federation Dmitry Zakharchenko. As part of the same case, information about the theft of 300 billion rubles was checked. That is how much the founders of one of the main contractors of the state monopoly GK 1520 - Boris Usherovich, Valery Markelov, Alexei Krapivin and their business partners Dmitry Motorin and Ivan Stankevich borrowed from Russian Railways. All of them (except for Krapivin) are accused of giving in Zakharchenko for general patronage. Boris Usherovich even “shipped” about 15 billion rubles of Russian Railways funds to his friend of his youth and accomplice in the theft from an apartment. In 1988, Usherovich was sentenced by the Perovsky Court of Moscow to one year of probation for several thefts. His accomplice was Vitaly Makarevich. Now Makarevich is the founder of two companies - Setstroyenergo and KPSS - which received contracts for 15 billion rubles from Russian Railways

In early October 2018, the co-owner of 1520 Valery Markelov was arrested for giving bribes to an employee of the GUEBiPK of the Ministry of Internal Affairs of the Russian Federation, Dmitry Zakharchenko. Another co-owner, Boris Usherovich, managed to escape. He was put on the federal wanted list. The third co-owner, Aleksey Krapivin, did not have time to escape. He was at the time of Markelov's arrest in Sochi, and hid there. He was put on the so-called operational wanted list.

As a result, Igor Rotenberg expressed his readiness to purchase a new asset. After that, Krapivin voluntarily appeared in the ICR, gave evidence and remained in the case only as a witness. Since November 2018, he has been known on the market as a consultant to Igor Rotenberg. And Igor Rotenberg himself, as the manager and not the official owner of 1520. It is with him that all issues are resolved.

There were also bonuses for Valery Markelov. Dmitry Zakharchenko testified in his favor. And the banker Vladimir Antonov refused to testify against Markelov. The main thing is that it took a very long time to resolve the issue of the arrest of Markelov's assets, and he managed to withdraw everything from the Russian Federation, with the exception of an apartment, a cottage and an old limousine. His proceeds for a share in 1520 also went abroad.

The property of the third co-owner Boris Usherovich was also decided to be arrested when he was almost gone in the Russian Federation. All managed to get out. With a noticeable delay, Usherovich was put on the international wanted list and arrested in absentia. Now he is trying to resolve issues with the case, since he has a lot of money. Only in London, controlled by him and other ex-co-owners of 1520, the fund manages $ 2 billion.

All the participants in the court session were already so impatient that Zakharchenko from the cage was keenly interested in what the state prosecutor Milan Digaeva had prepared this time.
