На слушаниях в суде ЕС по иску миллиардер Алишера Усманова о снятии санкций, последний указан в судебных документах, как «житель Ташкента». Усманов всячески дистанцируется от России и Владимира Путина, пытаясь доказать, что он вовсе не кремлевский олигарх, а некий узбекский богач, который вел бизнес в РФ. Пока это ему не помогло. Зампред первой инстанции Суда ЕС Марк ван дер Вуде 27 июня отказал Алишеру Усманову в обеспечительных мерах – приостановлении действия нормативных правовых актов ЕС о персональных санкциях до момента вынесения судом решения по существу. И это не все неприятности Усманова. По данным Rucriminal.info , в Лондоне, наконец, обратили внимание на российских горняков, которые считают, что стали жертвой Усманова.



Горняки указывают, что лишились своих акций ГОК в ходе принудительного выкупа, который был сделан структурами Усманова по ценам далеким от рыночных. Оценку проводила компания «Гориславцев и Ко. Оценка», которая исходила из того, что официальная выручка ГОКа составила менее 1 миллиарда долларов. Однако, как утверждают заявители, в реальности выручка была занижена минимум в три раза. В целях налоговой оптимизации продукция по заниженным ценам продавалась офшорам Усманова (BGMT и FMC ltd.), а те уже сбывали ее по рыночным ценам. В результате реальная выручка ГОКа составляла не менее 3 млрд долларов. « Недавно в наше распоряжение попал пакет документов, сформированных на территории английского права бывшими сотрудникам А.Б. Усманова (досточтимый Лорд Дэвид Оуэн в том числе), которые безусловно и полностью подтверждают в/у информацию, а именно: концентрацию прибыли ОАО «Лебединский ГОК» в офшоре (ст. 199 УК РФ) через который шли все экспортные поставки продукции предприятия ОАО «Лебединский ГОК»», - рассказали горняки. В России они отчаялись добиться справедливости. Более того, представители «Металлоинвеста» назвали горняков «преступниками» и пообещали их «преследовать». В результате горняки в начале лета обратились к Борису Джонсону и этому обращению, а также приложенному к нему большому количеству подтверждающих документов, дали ход. However, that unpleasant conversation, which partly struck the goalkeeper of the Torpedo team, sunk into his soul. And we see everything I remembered just on the eve of the replay, because again I had to fight with Dynamo Tbilisi, now directly for gold medals. And this is much more responsible than the calendar duel of the championship.

... In the lobby of the Tashkent hotel, where the Torpedo team lived on the eve of the replay, Anzor was literally attacked by strangers, apparently Dynamo fans: “We will do everything for you: we will buy a car, a luxurious house, we will bring pretty girls, just skip the balls, please. In such a situation, instead of Kavazashvili, they put Eduard Shapovalenko at the gate.

- We started great, led 1:0, Valka Ivanov showed miracles of technique. But even in the first half, he pulled the back of the thigh and was forced to replace. SPARTAK'S "AGREEMENT"

- Сегодня президенты клубов, бизнесмены, работающие на команды, договариваются о фиксированном результате по телефону, либо при личных встречах, так было и, вероятно, будет, если не начнем наводить порядок, - с горечью и решимостью в голосе констатирует знаменитый голкипер Анзор Кавазашвили. – Уже давно назрела необходимость создать при РФС независимую структуру, которая будет подчиняться только бюро футбольного ведомства, а не исполкому. Потому что в его состав входят, как правило, послушные, беспомощные, непрофессиональные люди. Туда вошли бы уважаемые всей страной специалисты, - к примеру, юристы, завершившие карьеру футболисты, судьи, тренеры. Смелые, честные, решительные, прекрасно знающие изнанку большого футбола, люди. Их следует наделить полномочиями решать: был «договорняк», или нет. Разумеется, решения будут приниматься после просмотров «странных» матчей, мнений разных специалистов, и так далее. Еще можно работать в тесном контакте с МВД, - попытаться внедрить своих людей в ряды «теневиков». Если требуется в определенных случаях, то и прослушку установить. Даже стоит в некоторых эпизодах провоцировать представителей команд взять деньги, и на их передаче задержать футбольных взяточников. Как это делается сотрудниками правопорядка в других сферах жизни. Футбол разве исключение из правил?

- Не боюсь ли «раскручивать» мафиози от футбола? Будьте спокойны – не боюсь! Как не боятся и мои коллеги, друзья – Евгений Ловчев, Александр Бубнов, другие замечательные игроки, тренеры. Они готовы хоть сейчас этим заняться. Предлагал я это делать еще прежнему президенту РФС Колоскову, позднее Мутко, - ни должной реакции, ни тем более решительных действий от них не дождался. А почему, спрашивается, нельзя было ввести в упомянутую мной структуру молодых ребят – Смертина, Онопко, других футболистов их поколения? Приличные, честные, знающие специфику большого футбола, мастера.

Болельщики иногда спрашивают: «Наверное, никому из чиновников ваши предложения по оздоровлению футбола просто не нужны, никто из них не заинтересован в чистоте популярной игры?»

- Действительно, складывается такое впечатление, - продолжает Анзор Кавазашвили. – По-моему, руководители футбола не созрели для борьбы с негативом, а пора бы уже начать действовать. Знаете, почему они этого не делают? Да потому, что не хотят для себя лишней головной боли, мечтают спокойно, без проблем жить, никого, не дай бог, не обидеть. Представьте, начнут, все-таки, дергать околоспортивных «жучков», какая шумиха может подняться! Встанут на защиту своих команд мэры городов, губернаторы регионов. Мол, что это вы нас незаслуженно обижаете? Очень не хочется чиновникам футбольного союза портить отношения. Игра в России агонизирует? Ничего, стерпится. По такому принципу живут функционеры.

В РФС просто боятся профессионалов, во всяком случае, боялись. В бытность руководителем Колоскова исполком этой организации безропотный, почти бессловесный, из его состава постепенно изгонялись люди деятельные, смелые.

- За торжество справедливости в нашем футболе могу горло перегрызть, не страшны мне возможные угрозы, шантаж, - утверждает популярный мастер. - Я через это в свое время прошел. И не сломался. Как не поймут чиновники: даже за попытку очистить наш чемпионат от дельцов, потомки наверняка благодарили бы. А так сто процентов проклянут – за малодушие, равнодушие.

Безусловно, многое, если не все, зависит от нас. От нынешнего руководства РФС. Если бы они не испугались, поддержали ветеранов футбола в борьбе с негативом, да еще снабдили бы их орудием этой борьбы, цены бы им не было. Есть ли хоть призрачная надежда на перемены в отечественном первенстве? Легендарный вратарь все же рассчитывает на лучшее.



ДЕВОЧЕК ЗА… ПРОПУЩЕННЫЕ МЯЧИ



1964 год, переигровка за звание чемпиона страны между тбилисским «Динамо» и столичным «Торпедо», на финише первенства обе команды набрали одинаковое количество очков. И выявляли сильнейшего в «золотом» матче в столице Узбекистана Ташкенте.

- Но еще задолго до этого поединка мы играли в середине сезона с теми же тбилисцами на их поле, и уступили – 1:3, - вспоминает Анзор Амберкович. – По ходу встречи я пропустил один из мячей в дальний от себя угол, удар коварный, все было в динамике, отразить не представлялось возможным. Уже по окончании матча слышу от нашего знаменитого форварда Валентина Иванова: мол, зачем я специально «пенку» пустил. Опешил от такого заявления партнера. «Валя, как тебе не стыдно подозревать меня в таких вещах?» - только и сказал я. Впрочем, списал на горячность ту реплику Иванова, он и в самом деле был иногда чрезмерно эмоциональным.

Однако тот неприятный разговор, отчасти поразивший голкипера торпедовцев, запал ему в душу. И зримо вспомнился как раз накануне переигровки, ведь снова предстояло биться с тбилисским «Динамо», теперь непосредственно за золотые медали. А это куда ответственнее, чем календарный поединок чемпионата.

…В холле ташкентской гостиницы, где жили торпедовцы в преддверии переигровки, Анзора буквально атаковали незнакомцы, видимо, поклонники «Динамо»: «Мы для тебя все сделаем: машину купим, дом роскошный, девочек симпатичных привезем, только пропусти мячики, пожалуйста. Нам нужна победа». Анзору слышать это – как нож в сердце. Противно до слез. Едва разместились москвичи в своих номерах, как вратаря побеспокоил охранник отеля: дескать, к вам сестра родная приехала.

- Выхожу в холл, смотрю, совершенно незнакомая тетя стоит, просьба аналогичная той, что была несколькими минутами раньше. Так повторилось раз пять. Мне это донельзя надоело, просто взбесило, - делится Кавазашвили.

Тогда вратарь торпедовцев решил поговорить с уважаемым Аркадием Вольским, болельщиком «Торпедо» со стажем, тогдашним партийным секретарем «ЗИЛа». Он, разумеется, не мог пропустить важную встречу своей команды, прилетев вместе с ней в Ташкент. Да и, по сути, Вольский воспринимался Анзором как отец духовный, игроки нередко делились с партийным боссом своими переживаниями. А здесь тем паче сложилась необычная, даже непростая ситуация.

- Так и так, Аркадий Иванович, пристают ко мне незнакомые люди вот с такой, очень даже настойчивой просьбой, - вспоминает Анзор Амберкович. – Я, конечно, невзирая ни на что, играть буду. Однако не подумайте ничего плохого обо мне, если пропущу. Ведь в футболе всякое бывает. И, если вы мне не верите, то стоять не смогу без доверия…

Тренеры, руководители клуба посовещались с Вольским, решили согласиться с доводами Анзора: давление на него оказали сильнейшее до начала «золотого» матча, психологически вратарь был подавлен. В такой ситуации вместо Кавазашвили поставили в ворота Эдуарда Шаповаленко.

- Мы начали здорово, вели 1:0, Валька Иванов чудеса техники показывал. Но еще в первом тайме потянул заднюю поверхность бедра и вынужденно заменился. Без него выиграть сложно такой поединок. Тут еще Датунашвили стал забивать один за другим мячи чуть ли не с отметки углового. В общем, - 1:4. А в 1965-м мы уже всех громили, ни о какой переигровке речи быть не могло. Безоговорочно стали чемпионами страны.



СПАРТАКОВСКИЙ «ДОГОВОРНЯК»



Неприятные чувства испытал Анзор, выступая в другом столичном клубе – «Спартаке». По словам самого вратаря, в составе «красно-белых» он столкнулся с явлением купли-продажи матча в первый и в последний раз.

- Играли в Одессе с «Черноморцем». Медали уже не светили, а хозяевам позарез нужны очки, чтобы обезопасить себя от вылета из высшей лиги, - вспоминает Анзор Амберкович. – Вижу, наши защитники явно не в своей тарелке: то Иванов ногу неестественно поднимет, и мяч со свистом летит в мои ворота, то Абрамов почти беспрепятственно пустит соперника на ударную позицию. Я все подчищаю, отражаю. Поле разбухло от нескончаемого дождя, месиво страшное. Соперники давят, нагнетая нешуточное напряжение. Вот бывший наш форвард, перешедший в Одессу, Женя Евлентьев, выбегает один на один со мной, и бьет с носка, - беру. Он подбегает и буквально орет: «Ты что делаешь, Анзор?» Встаю с газона, и с некоторым удивлением отвечаю: «Мяч ловлю, а что?» «Не можешь пропустить, тебе разве никто ничего не сказал?» - продолжал биться в истерике Евлентьев. «Кто и что должен был сказать?» - соперник сразу осекся, видимо, ему стало неловко за свою неуместную тираду.

В перерыве, по дороге в раздевалку, Анзор спрашивает незадачливых партнеров: «Вы что, игру продали?». Вратаря пытались разуверить. В раздевалке Николай Петрович ходил задумчивым, Никита Павлович Симонян, похоже, тоже никак не мог понять, что часть его подопечных, возможно, сдала игру сопернику, договорившись о «нужном» результате еще до начала матча. Где-нибудь в гостинице или при встрече в злачном месте…

Анзор стал журить партнеров, призывать их: давайте соберемся, нельзя столько непростительных, детских ошибок допускать. Старостин поддержал вратаря: мол, играть надо всерьез, эта команда нам по силам, и так далее.

- Однако эти призывы прозвучали, словно глас вопиющего в пустыне, их мало кто услышал, - рассказывает Анзор Амберкович. – Во втором тайме тоже самое продолжилось. Наши пускают на убойные позиции даже защитников «Черноморца». До поры, до времени все беру. До конца игры три-четыре минуты. По правому краю влетает в штрафную площадь Евлентьев, защитники расступаются, он выбегает со мной один на один. Пытаюсь сократить угол, перекрыть для него ворота. Но отразить удар с близкого расстояния не могу. 0:1. После такого «упорного» поединка «разговор по душам» откладывать не стал, очень резко говорил с партнерами, все-таки, пользовался авторитетом в команде. Конфликта не было, все понимали – я прав. Сидели в раздевалке с опущенными головами. Повторюсь, на моей памяти это единственный «договорняк» в составе «Спартака».



ХОХМА. ОТ ДОГОВОРНОЙ НИЧЬЕЙ?



Теперь, после серьезной отповеди Анзора Амберковича в адрес своих партнеров (все равно очень им любимых), стоит расслабиться. Байка по-своему замечательная. О том, как не нужно готовиться к футбольным матчам, чего стоит категорически избегать, и с кем, может быть, никогда не надо общаться накануне игр.

Прилетают московские торпедовцы, в составе которых выступал и Анзор Кавазашвили, в Кутаиси на матч со своими одноклубниками. Из родного голкиперу Батуми повидать родного сына и брата приезжают мама Анзора и чуть ли не все его родственники. Что тут сказать, соскучились, чувства легко понять. Навезли всякой вкуснятины: хачапури, жареных поросят, кур, домашнего винца. Словом, машину, на которой все это и доставили, доверху набили потрясающей едой. Заур, родной брат Анзора, отнес съестное в ресторан гостиницы. Сама игра одноклубников из Москвы и Кутаиси начиналась в тот же вечер – в шесть по местному времени. Брат предлагает Анзору: «Позвони вратарю кутаисцев, Роини, пусть приедет, посидит с нами».

Роини - давний приятель Анзора, можно сказать, вместе выросли в Батуми. «Как же он приедет, ведь сегодня игра, Роини сейчас на сборах с командой», - урезонивал брата Анзор. Позвонили, Роини, все-таки, приехал. И началось пиршество!

Стол буквально ломился от еды, на часах – двенадцать дня. По маленькому кусочку поросенка, курочки, по глоточку вина. Как признался сам Анзор Амберкович, стоит только соблазниться, и трудно себя остановить. Тем более, в день матча Кавазашвили всю свою карьеру по традиции обходился чашечкой кофе и маленькой шоколадкой. Но, бывали и редкие исключения.

- Живот тогда просто разбух, пища-то весьма тяжелая, - смеется вратарь. – Выходим вечером играть, все мои родственники сидят на трибуне, переживают за обе команды, за меня в особенности. Опростоволоситься в их глазах, конечно, не хотелось. Ведь за мной давно укрепилась слава классного, профессионального голкипера. Бьют мне – пропускаю. Согнуться не могу – полный еды живот не пускает. Вроде мячик рядом летит, - сместись, руку подставь, прыгни, наконец. Ан нет. И друг мой, Роини, из кутаисского «Торпедо» тоже ничего не может поделать. Ему бьют – он пропускает, мне – я вроде «пенку» не ловлю. Так и сыграли, представьте, - 3:3. Хохма. «Договорняк»? Нет! Просто согнуться не могли. Стало для меня уроком на всю оставшуюся футбольную жизнь. Больше никогда себе близко не позволял…

By order of the latter, a real hunt was arranged for the record.



Even in the morning of the day when the shooting took place on Rochdelskaya, a meeting was scheduled between Kim and representatives of the designer Fatima Misikova. To protect the interests of Kim, the people of Kenes Rakishev singled out detective Fenechkin. After listening to the restaurateur girl, he said that a civil law dispute was not his specificity and advised him to record all the events on a dictaphone. In the midst of the conflict, Zhanna Kim called the detective and asked him to drive up. In the restaurant, she gave Fenechkin a record of what happened before the shootout. Kim's mistake, in fact, became the only clue to understanding the truth in this story. From the conversations that took place between the participants in these events and were preserved on record, it becomes clear that the conflict was at the level of a dispute between business entities and nothing would have happened if the lawyer Eduard Budantsev had not taken out a weapon. Representatives of Kenes Rakishev understood that the audio recording could destroy the script they had built, and the hunt began for her. Rakishev's people invited the detective to meet at the Ukraine Hotel. This is what he himself says in his testimony in court. At the hotel, he was told that he had to give the audio file, but he refused. After that, the detective was searched, but nothing was found: Fenechkin did not live at the place of registration. From Zhanna Kim's message to the 02 service, it follows that the reason for calling the police was the presence of PSC employees on the veranda, and not what was happening inside the restaurant. To the question of operator 02, Zhanna Kim says that negotiations are underway regarding repairs, that no one is demanding anything, people on the street are not armed, someone is asking her to go outside. In the Presnensky Court, the audio recording was compared with the video cameras and it was found that some time before the call to service 02, the following dialogues took place between the persons participating in the negotiations. Dialogue No. 1. Zhanna Kim says to the security guard of the Elements restaurant, “Don't worry about anything. They just said something to them, and now we will answer them and that's it. Now the fighters from my boss will fly up. Everything is all right. (In this dialogue Zhanna Kim means Kenes Rakishev, the fighters - Budantsev and company.) In the Presnensky Court, when comparing the video recording with the audio recording made by Zhanna Kim, it was established that the conversation with the operator of the “02” service was carried out in the presence of a police officer of the GNR OMVD Presnensky Karikh, at the time of being on the veranda of the restaurant, while on the veranda at the moment there were already no employees of the private security companies of the indicated Zhanna Kim in a message to the operator "02". Literally ten minutes before Zhanna Kim's call to the "02" service, the police officers checked the documents and verbally interrogated the employees of the private security company and did not reveal any violations in their actions. After that, the employees of the private security company got into their cars, which had state. rooms and drove away from the restaurant. At the same time, the conversation between Zhanna Kim and the police officer was recorded on a dictaphone. From the conversation between the police officer and Zhanna Kim, it follows that there are no grounds for detaining the employees of the private security company and they were lawfully on the veranda, guarding the people inside the restaurant, they did not have weapons. There were no other dialogues between Zhanna Kim and employees of the Presnensky police department. However, in her testimony prior to the issuance of the audio recording, Zhanna Kim claimed to the investigator that she had informed the SNR officers about the extortion being committed against her and asked them to take action, to which the officers replied, “Can we leave?” In subsequent testimony, Zhanna Kim added unreliable information about the presence of weapons in the private security company.



All dialogues between Kim Zhanna and Budantsev inside the restaurant do not contain information about the commission of illegal actions against her. A dialogue was recorded between Budantsev, Kostrichenko and Zhanna Kim. Budantsev turns to Jeanne Kim "Well, what?" "We are this, from the Criminal Investigation", "We are the Criminal Investigation". In this dialogue, Budantsev informs Kim Zhanna that he and Kostrichenko are police officers. Which does not correspond to the version of Budantsev and Kim Jeanne that he was her lawyer. A similar conversation was recorded in the VIP room, where Budantsev and his company, together with security officer Shakirov, are checking documents. So Budantsev introduced himself as an employee of the Moscow Criminal Investigation Department and shows a certificate of a police officer, after which he and Kostrichenko begin to check the documents of people in the restaurant. At the same time, their further testimony seems completely illogical, according to Budantsev and Kostrichenko, illegal actions against Kim Zhanna and his company continued, and the detective Shakirov was inactive.

Jeanne Kim also lied about the private detective Fenechkin. In her primary testimony, Zhanna Kim does not indicate the fact of contacting the detective at all, and did not inform the investigator about the presence of an audio recording of the conversations. And to the direct question of the investigator, she answered that she had turned for help only to Budantsev, with whom she had an agreement to provide legal assistance. About Fenechkin, Zhanna Kim remembered only when the latter, contrary to the requests of Kenes Rakishev's comrades, gave out an audio recording of conversations in the Elements restaurant, and during interrogation told the truth about what was happening in the restaurant. At the same time, Zhanna Kim informed the investigator, “.... Why Anton (Fenechkin) came at that very moment, I don’t know, I can only say I didn’t call him, didn’t ask him to come. Anton asked if I had an audio recording of the ongoing conversation, to which I explained that I had the recording, after which Anton told me to give him the recorder. Further, Zhanna Kim began to assert that Fenechkin was present during conversations with police officers, in which she and Budantsev and his comrades asked to take measures to suppress extortion, but the officers were inactive. Fenechkin categorically rejected these allegations of Kim Zhanna, Peter Cherchintsev supported his testimony, informing the court that this was a lie invented by Budantsev.



At the same time, it is not clear why, in the presence of serious disagreements in the testimony of Kim Zhanna and Fenechkin, there was no confrontation between them at the stage of the investigation. Also It is not clear why the investigators did not confront Kim Zhanna and detective Shakirov, there were very significant discrepancies in their testimony. At the trial in the Presnensky court, the testimony of Zhanna Kim was refuted by the details of telephone conversations. Zhanna Kim and Fenechkin called up on the afternoon of December 14, 2015, met near the building of the Presnensky Department of Internal Affairs, where Fenechkin suggested Zhanna Kim write a statement, but she refused. And in the evening Zhanna Kim called Fenechkin more than six times and asked to drive to the restaurant, their conversation was recorded on a dictaphone.

It was necessary to discredit the testimony of the police officers of the detective of the Ministry of Internal Affairs Khamovniki Romashkin, the detective of the Ministry of Internal Affairs Presnensky Shakirov and the district police officer Zinatullin, it was not the task to imprison the employees of the GNR (they had no influence on the murder case), although they were the first to arrive on a call and had to take all necessary measures and bear the corresponding responsibility. However, as we see, justice in the Presnensky court was selective. It was Romashkin, Shakirov and Zinatullin who became eyewitnesses to the murder and the main witnesses for the prosecution of Budantsev, and also insisted that no illegal actions had taken place in the restaurant.

A Rucriminal.info source reported that in May 2016, Budantsev's accusation was strengthened by new articles, the case was taken to the Investigative Committee of Russia and they planned to involve Kenes Rakishev as an accomplice to the murder. Zhanna Kim was ready to change her testimony and tell the truth (respectively, not in favor of Budantsev). Petr Cherchintsev also wanted to tell the truth about the events in the restaurant at the investigation stage. These plans were prevented by the detention of the leadership of the Moscow Investigative Committee, and the subsequent discrediting of the employees of the Russian Investigative Committee.

A very interesting legal assessment of what is happening in the restaurant was described in the verdict by judge Vasyuchenko “... During the trial, it was established that there were disagreements between Kim Zh, on the one hand, and Misikova F.T., regarding issues of payment for repair work carried out in the restaurant” Elements, as well as on the quality of these works. The position of Kim J was that she, in her opinion, completely produced Misikova F.T. Payment for all construction work carried out in the Elements restaurant. In connection with the poor-quality performance of part of the work, Misikova F.T. owed her (Kim Zh.) money. The position of F.T. Misikova, in turn, was that Kim Zh did not pay for part of the work done by her, which she (Kim Zh) had to pay directly to the persons who directly carried out these works. These circumstances are confirmed by an audio recording of conversations, the content of which was not disputed by any of the participants in the process.

From the protocol of the inspection of the video recording dated 05.10.2017, it follows, “... that at 21:47. 07 sec, at the moment when Kostrichenko, Cherchintsev approached the doors of the VIP room, Shakirov at 21 o'clock. 47 min. 07 seconds, taking his hat, he went to the exit from the restaurant hall, that is, just at the moment the conflict began to develop ... ".

Having studied the materials of the criminal case, it is clear that the conflict began only after detective Shakirov left the restaurant, at that time Budantsev and his company wanted to go into the VIP room where the negotiations were taking place. The guards of the persons participating in the negotiations asked Budantsev “Who are you?” Budantsev, without answering, tries to enter the VIP room, he is blocked by security. At this moment, a personal conflict also begins between Cherchintsev and the negotiator. Zhanna Kim, being in the VIP room, is silent (after all, she thinks that Budantsev and the company are police officers). From the testimony of the lawyer Petrosyants, (represented the interests of Zhanna Kim), it follows that Budantsev invites everyone to go out into the street. Further, according to CCTV cameras and testimonies of witnesses on the veranda, Cherchintsev and Romanov are sorting out the relationship, Budantsev stands aside, does not enter into dialogues with anyone. At some point, Budantsev, in violation of the law on weapons, takes out a pistol with the words "I will shoot everyone!" and points the barrel at people. After that, the staff of the private security company tried to calm him down. But, Budantsev starts to shoot. As a result, two people were killed, eight seriously injured.

Thus, the court established that there was a civil law dispute in the restaurant, and the conflict began on the basis of a sudden personal hostile relationship. The court itself did not establish any raider seizure, or extortion, let alone the inaction of police officers. It turns out that the verdict was issued despite the obvious absence of corpus delicti in the actions of the police officers and only on the basis of the testimony of the interested parties, which were refuted during the trial. The materials of the judicial investigation of the Presnensky Court are a ready-made criminal case against Budantsev, Rakishev and the company. The question remains why it was not a just sentence, but the higher authorities approved it, and who benefited from it?

The editorial source said that in discredit officers of the Main Directorate of the Ministry of Internal Affairs of Moscow and the Investigative Committee for Moscow participated in the police station and acted in sync with the protection of Budantsev, instead of fixing traces of crimes committed by Budantsev and his company, helping to protect employees, they falsified documents, conducted searches at a private detective , in order to find an audio recording, they tried to frame the detective by the RSD of the Internal Affairs Directorate for the Central Administrative District of Moscow, persuaded the witnesses to slander.

During the proceedings on the events on Rochdelskaya, the Investigative Committee was divided into two camps, some openly sided with Rakishev and Budantsev, while others established the objective truth, for which they paid. Как Кошелек Назарбаева ушел от ареста в России за кровавую бойню

Два человека убито, восемь тяжело ранено.



Редакция Rucriminal.info продолжает публиковать наиболее интересные материалы уголовного дела о бойне на Рочдельской улице – записи и показания фигурантов. Например, большую роль сыграла аудиозапись переговоров в ресторане «Элементс», произошедших перед самым конфликтом. Запись сделала хозяйка ресторана Жанна Ким и вокруг этой записи, как выяснил Rucriminal.info, разгорелись страсти, как в шпионских фильмах. На этой записи было не только слышно, что в «Элементс» не было жесткой «разборки», как это представляли Жанна Ким и адвокат Эдуард Буданцев, но называлось имя и фамилия реального виновника печальных событий – бизнесмена из Казахстана Кенеса Ракишева, известного, как «кошелек Назарбаева». По приказу последнего за записью была устроена настоящая охота.



Еще утром того дня, когда произошла перестрелка на Рочдельской, была назначена встреча между Ким и представителями дизайнера Фатимы Мисиковой. Для защиты интересов Ким люди Кенеса Ракишева выделили детектива Фенечкина. Выслушав девушку-ресторатора, он сказал, что гражданско-правовой спор – это не его специфика и посоветовал записать все события на диктофон. В самый разгар конфликта Жанна Ким позвонила детективу и попросила его подъехать. В ресторане она передала Фенечкину запись того, что происходило перед перестрелкой. Ошибка Ким, по сути, стала единственной зацепкой для понимания правды в этой истории. Из разговоров, которые велись между участниками этих событий и сохранились на записи, становится понятно, что конфликт был на уровне спора хозяйствующих субъектов и ничего бы не произошло, если бы адвокат Эдуард Буданцев не достал бы оружие. Представители Кенеса Ракишева понимали, что аудиозапись может разрушить построенный ими сценарий и за ней началась охота. Люди Ракишева пригласили детектива для встречи в гостиницу «Украина». Об этом он сам говорит в своих показаниях в суде. В гостинице ему сообщили, что надо отдать аудиофайл, но он отказался. После этого у детектива провели обыск, но ничего не нашли: Фенечкин проживал не по месту прописки. По словам источника rucriminal.info, Ракишев был готов заплатить за запись крупную сумму денег. После очередного отказа сотрудники УСБ УВД по ЦАО Москвы совместно с Жанной Ким и представителями Ракишева попытались провести оперативные мероприятия в отношении Фенечкина.



Публикуем расшифровку переговоров Жанны Ким и оператора службы «02» ГУ МВД по г. Москве разговор состоялся 14.12.2015 года примерно в 20 часов 30 минут.

10. Ж-Ну в общем у нас без опознавательных знаков машины приехали стали по периметру ресторана вышли люди. Мы разбираемся по поводу ремонта, а это люди видимо люди с ремонта не знаю. У нас здесь частная собственность.

11. О-Ну они что то требуют? Они выгнали посетителей? Что они хотят вообще?

12. Ж-Они требуют чтоб мы вышли на улицу.

13. О-Все да? А посетители у Вас тоже есть? Нет?

14. Ж-Да. Посетителей не просят выйти на улицу, а просят всех нас выйти на улицу.

Из сообщения Жанны Ким в службу 02 следует, что поводом для вызова сотрудников полиции явилось нахождение на веранде сотрудников ЧОП, а не происходящее внутри ресторана. На вопрос оператора 02, Жанна Ким сообщает, что идут переговоры по поводу ремонта, что никто ничего не требует, люди на улице не вооружены, кто-то просит выйти ее на улицу. В Пресненском суде были сопоставлены аудиозапись с видеокамерами и было установлено, что за некоторое время до звонка в службу 02, между лицами участвующими в переговорах состоялся следующие диалоги. Диалог № 1. Жанна Ким говорит охраннику ресторана Элементс « Ничего не переживай. Им че-го то наговорили просто, а сейчас мы им ответим и все. Сейчас еще подлетят бойцы от шефа моего. Все все нормально. (под шефом в данном диалоге Жанна Ким подразумевает Кенеса Ракишева, бойцы - Буданцев и компания.) Диалог № 2 «Жанна Ким задает вопрос подрядчику— А люди уйдут с террасы. Можно это сделать? (Имея ввиду сотрудников ЧОП находящихся на веранде). В ответ ей на ухо шепчет ее муж Денис Ким «Не, не пусть стоят. Пусть стоят. Жанна Ким отвечает, Денису Ким- А, (да?). Денис Ким в ответ Жанне Ким— «Нам же лучше чтобы они стояли» (имея ввиду ЧОП находящийся на веранде). При этом в ходе диалогов имеющихся на записи подрядчики говорили Жанне Ким, что на веранде находится ЧОП и осуществляет их охрану, и если они ее напрягают они готовы дать команду ЧОП сняться.



Источник редакции Rucriminal.info, сообщил, что возможность силовой акция в отношении подрядчиков со стороны людей Ким Жанны не исключался, а чем они были предупреждены заранее, поэтому на встречу они взяли с собой ЧОП, информация была, что на переговорах Жанну Ким будут представлять чеченцы. (данная информация подтвердилась, чеченцы действительно были на встрече). Команда Буданцева в Москве давно известно, оказанием услуг по силовым захватам предприятий, выбивание долгов, активное сотрудничество с чеченским и Таганским ОПГ. Среди клиентов Буанцева Василий Анисимов, Кенес Ракишев, Алишер Усманов. Один из последних захватов предприятие ООО «Завод оргсинтез Ока» находящиеся в Нижегородской области г. Дзержинск, пострадавший Евгений Никулин до сих пор не может добиться возбуждения уголовного дела. Активы предприятия были записаны на активного участника перестрелки Костриченко, давление на потерпевшего оказывал лично Буданцев в помещении адвокатского бюро «Диктатура закона. Такой же силовой метод ими был реализован и в ресторане Элементс.



В Пресненском суде при сопоставлении видеозаписи с аудиозаписью производившейся Жанной Ким установлено, что разговор с оператором службы «02» проводился в присутствии сотрудника полиции ГНР ОМВД Пресненский Карих, в момент нахождения на веранде ресторана, при этом на веранде в данный момент уже отсутствовали сотрудники ЧОП указанных Жанной Ким в сообщении оператору «02». Буквально за десять минут до звонка Жанны Ким в службу «02» сотрудники полиции проверили документы и устно опросили сотрудников ЧОП и каких либо нарушений в их действиях не выявили. После чего сотрудники ЧОП, сели в свои машины на которых имелись гос. номера и отъехали от ресторана. При этом разговор Жанны Ким и сотрудника полиции был записан на диктофон. Из разговора сотрудника полиции и Жанны Ким следует, что оснований для задержания сотрудников ЧОП нет и они правомерно находились на веранде, осуществляя охрану лиц находящихся внутри ресторана, оружия при них не было. Иных диалогов Жанны Ким и сотрудников ГНР ОМВД Пресненский зафиксировано не было. Однако в своих показания данных до выдачи аудиозаписи, Жанна Ким утверждала следователю, что она сообщила сотрудниками ГНР о совершаемом в отношении нее вымогательстве и просила принять меры, на что сотрудники ответили «А можно мы уедем?» В последующих показаниях Жанна Ким еще добавила недостоверную информацию о наличии у сотрудников ЧОП оружия.

Все диалоги между Ким Жанной и Буданцевым внутри ресторана не содержат информации о совершении в отношении нее противоправных действий. Зафиксирован диалог между Буданцевым, Костриченко и Жанной Ким. Буданцев обращается к Жанне Ким «Ну че?» «Мы это, с розыска уголовного», «уголовного розыска мы». В данном диалоге Буданцев сообщает Ким Жанне, что они с Костриченко сотрудники полиции. Что не соответствует версии Буданцева и Ким Жанны, о том что он являлся ее адвокатом. Аналогичный разговор зафиксирован в помещении ВИП комнаты, где Буданцев со своей компанией вместе с оперуполномоченным Шакировым проверяют документы. Так Буданцев, представился сотрудником Московского уголовного розыска и показывает удостоверение сотрудника полиции, после чего он и Костриченко начинают проверять документы у лиц, находящихся в помещении ресторана. При это их дальнейшие показания кажутся совсем не логичными, по утверждению Буданцева и Костриченко противоправные действия в отношении Ким Жанны и его компании продолжались, а оперуполномоченный Шакиров бездействовал.

Врала Жанна Ким и в отношении частного детектива Фенечкина. В своих первичных показаниях Жанна Ким вообще не указывает факт обращения к детективу, и не сообщила следователю о наличии аудиозаписи переговоров. А на прямой вопрос следователя отвечала, что обращалась за помощью только к Буданцеву, с которым у нее заключено соглашение на оказание юридической помощи. Про Фенечкина, Жанна Ким вспомнила только тогда, когда последний вопреки просьбам товарищей Кенеса Ракишева, выдал аудиозапись разговоров в ресторане Элементс, и на допросе сообщил правду о происходившем в ресторане. При этом Жанна Ким сообщала следователю, «....Почему Антон (Фенечкин) пришел именно в этот момент я не знаю, могу только сказать я ему не звонила, прийти не просила. Антон спросил есть ли у меня аудиозапись запись происходящего разговора, на что я пояснила, что запись у меня есть, после чего Антон сказал, чтобы я передала ему диктофон». Далее Жанна Ким, начала утверждать, что Фенечкин присутствовал при разговорах с сотрудниками полиции, в которых она и Буданцев и его товарищи просили принять меря для пресечения вымогательства, но сотрудники бездействовали. Фенечкин данные утверждения Ким Жанны категорически отверг, его показания поддержал Петр Черчинцев, сообщив суду, что это ложь, придуманная Буданцевым.



При этом непонятно почему при наличии серьезных разногласий в показания Ким Жанны и Фенечкина еще на стадии следствия очную ставку между ними не проводили. Также непонятно почему следователи не провели очную ставку между Ким Жанной и оперуполномоченным Шакировым, в их показания были очень существенные расхождения. На процессе в Пресненском суде показания Жанны Ким, были опровергнуты детализациями телефонных переговоров. Ким Жанна и Фенечкин созванивались днем 14.12.2015 года, встречались возле здания ОМВД Пресненский, где Фенечкин предложил Жанне Ким написать заявление, но она отказалась. А вечером Жанна Ким более шести раз звонила Фенечкину и просила подъехать в ресторан, их разговор был записан на диктофон.

Источник редакции Rucriminal.info сообщил, что данное поведение Жанны Ким, объяснимо. Необходимо было дискредитировать показания сотрудников полиции оперуполномоченного ОМВД Хамовники Ромашкина, оперуполномоченного ОМВД Пресненский Шакирова и участкового Зинатуллина, задачи посадить сотрудников ГНР не стояло ( они не как не влияли на дело по убийству), хотя они первые прибыли по вызову и должны были принять все необходимые меры и нести соответствующую ответственность. Однако, как мы видим правосудие в Пресненском суде было избирательным. Именно Ромашкин, Шакиров и Зинатуллин стали очевидцами убийства и основными свидетелями обвинения Буданцева, а также настаивали о том, что каких либо противоправных действий в ресторане не происходило.

Источник Rucriminal.info сообщил, что в мае 2016 года обвинение Буданцева усилилось новыми статьями, дело забрали в Следственный комитет России и планировали привлечь Кенеса Ракишева, как пособника убийству. Жанна Ким была готова поменять показания и рассказать правду (соответственно не в пользу Буданцева). Петр Черчинцев также хотел еще на стадии следствия рассказал правду, о событиях в ресторане. Данным планам помешало задержание руководства СК Москвы, и последующая дискредитация сотрудников СКР России.

Очень интересную правовую оценку происходящему в ресторане описала в приговоре судья Васюченко «...В ходе судебного следствия было установлено, что между Ким Ж, с одной стороны и Мисиковой Ф.Т, существовали разногласия, касающиеся вопросов оплаты ремонтных работ, произведенных в ресторане «Элементс», а также по вопросам качества данных работ. Позиция Ким Ж, заключалась в том, что она, по ее мнению, полностью произвела Мисиковой Ф.Т. Оплату всех строительных работ, произведенных в ресторане «Элементс». В связи с некачественным выполнением части работ Мисикова Ф.Т, была должна ей (Ким Ж.) денежные средства. Позиция Мисиковой Ф.Т, в свою очередь, заключалась в том, что Ким Ж, не оплатила часть произведенных у нее работ, которые она (Ким Ж) должна была оплатить напрямую лицам, непосредственно производившим данные работы. Данные обстоятельства подтверждаются аудиозаписью разговоров, содержание которой ни оспаривал никто из участников процесса.

Из протокола осмотра видеозаписи от 05.10.2017 года следует, «...что в 21 час 47 мин. 07 сек, в тот момент, когда Костриченко, Черчинцев подошли к дверям ВИП комнаты, Шакиров в 21 час. 47 мин. 07 сек, взяв шапку, направился к выходу из зала ресторана, то есть как раз в момент начала развития конфликта...».

Изучив материалы уголовного дела ясно, что конфликт начался только, после выхода из ресторана оперуполномоченного Шакирова, в это время Буданцев со своей компанией хотел зайти в ВИП комнату, где проходили переговоры. Охрана лиц, участвовавших в переговорах спросила у Буданцева «Вы кто?» Буданцев, не отвечая пытается зайти в ВИП комнату, его блокирует охрана. В это момент между Черчинцевым и участником переговоров также начинается личный конфликт. Жанна Ким, находясь в помещении ВИП комнаты молчит(она ведь думает, что Буданцев и компания это сотрудники полиции). Из показаний адвоката Петросянц, (представлял интересы Жанны Ким) следует, что Буданцев предлагает всем выйти на улицу. Далее согласно камерам видеонаблюдения и показания свидетелей на веранде выясняют отношения Черчинцев и Романов, Буданцев стоит в стороне, в диалоги ни с кем не вступает. В какой то момент Буданцев в нарушение закона об оружии достает пистолет со словами « Я буду стрелять всех!» и наводит ствол на людей. После чего сотрудники ЧОП пытались его успокоить. Но, Буданцев начинает стрелять. Результат два человека убито, восемь тяжело ранено.

Таким образом судом установлено, что в ресторане был гражданско-правой спор, а конфликт начался на почве внезапно возникших личных неприязненных отношений. Ни рейдерского захвата, ни вымогательства тем более бездействия сотрудников полиции сам суд не установил. Получается, что приговор был вынесен не смотря на очевидность отсутствия состава преступления в действиях сотрудников полиции и только на основании показаний заинтересованных лиц, при этом опровергнутых в ходе судебного разбирательства. Материалы судебного следствия Пресненского суда готовое уголовное дело в отношении Буданцева, Ракишева и компании. Остается вопрос почему был вынесен не правосудный приговор, а вышестоящие инстанции его утвердили, и кому это было выгодно?

Источник редакции сообщил, что в дискредитации сотрудников полиции участвовали сотрудники ГУ МВД г. Москвы и СК по г. Москве и действовали они синхронно с защитой Буданцева, вместо того чтобы фиксировать следы преступлений, совершенных Буданцевым и его компанией, помогать защитить сотрудников, они фальсифицировали документы, проводили обыски у частного детектива, с целью отыскания аудиозаписи, пытались подставить детектива силами ОСБ УВД по ЦАО г. Москвы, склоняли свидетелей к оговору.

В ходе разбирательства по событиям на Рочдельской, Следственный комитет разделился на два лагеря одни встали откровенно на сторону Ракишева и Буданцева, а другие устанавливали объективную истину, за что и поплатились. К сожалению, отсутствие института единоначалия в Следственном комитете России, а также предоставление недостоверной информации ее Председателю, привели к таким печальным последствиям для всей службы так и к дискредитации всего правоохранительного блока России.
