For the third year now, a criminal case has been going on against two former employees of the State Traffic Safety Inspectorate of the Ministry of Internal Affairs of Russia, Babyninsky, accused of a serious crime, namely, taking a bribe as part of a group of persons by prior agreement. According to the investigation, the subject of the bribe was ... a refrigerator worth 13,000 rubles, purchased by a friend of one of the accused for the needs of the district department. By the way, a friend is also sitting in the dock for bribing an official. It's no secret that our bodies accept sponsorship with great pleasure. And no one has a desire to initiate criminal proceedings against sponsors. But not in this case. In this case, in order to “cut the stick” and increase the performance, the officials of the Investigative Department of the Investigative Committee of the RF Investigative Committee for the Kaluga Region and the operational-search unit of the internal security department of the Ministry of Internal Affairs for the Kaluga Region acted synchronously and amicably. In order for a criminal case to develop, the investigator had to forge the record of the interrogation and the signature of the witness, adding there sufficient facts to select a preventive measure in the form of taking one of the defendants into custody and bringing charges. Colleagues and employees of the Ministry of Internal Affairs supported by conducting an internal check in relation to the defendant and his immediate superior. Having come up with nothing better than replacing the text of a real explanation with the text of a falsified interrogation, without even bothering to correct spelling errors and punctuation marks. True, the signatures here were more similar than in the protocol of interrogation. When all these machinations came to light, the criminal case was already in court, and the replicated false interrogation was scattered as evidence and formed the basis for the decisions of at least two courts. And now, again, the officials of the Ministry of Internal Affairs and the Investigative Committee stood shoulder to shoulder, fighting off the obvious facts in the form of handwriting studies conducted in independent institutions and testimonies. Yes, within the framework of the audit, two handwriting examinations were assigned to the employee of the ORC SB, one at the ECC of the Ministry of Internal Affairs for the Kaluga Region, where signatures from a fake interrogation and another explanation were taken as free samples, in which, as it turned out later, the signatures were also forged , though this time without distorting the text. The second examination was appointed at the FEL of the Ministry of Justice for the Kaluga Region, where an expert with experience since 2008. violated all possible rules for conducting such examinations, including the instructions of the Ministry of Justice. And just like colleagues from the ECC, she made a conclusion in accordance with the task or request.

Один за дачу взятки, а дугой за ее получение.



Уже третий год идёт разбирательство по уголовному делу в отношении двух бывших сотрудников ОГИБДД МО МВД России Бабынинский обвиняемых в тяжком преступлении, а именно в получении взятки в составе группы лиц по предварительному сговору. По мнению следствия, предметом взятки явился …холодильник стоимостью 13000 руб, приобретенный приятелем одного из обвиняемых для нужд райотдела. Кстати, приятель тоже сидит на скамье подсудимых за дачу взятки должностному лицу. Ни для кого ни секрет, что наши органы с большим удовольствием принимают спонсорскую помощь. И ни у кого не возникает желания возбуждать уголовные дела в отношении спонсоров. Но не в этом случае. В данном случае, для того, чтобы «срубить палку» и повысить показатели, должностные лица Следственного отдела СУ СК РФ по Калужской области и оперативно-розыскной части собственной безопасности УМВД по Калужской области действовали синхронно и дружно. Чтобы сложилось уголовное дело следователю пришлось подделать протокол допроса и подписи свидетеля, внеся туда достаточные факты для избрания меры пресечения в виде заключения под стражу одному из фигурантов и предъявления обвинения. Поддержали коллег и сотрудники УМВД проведя служебную проверку в отношении фигуранта и его непосредственного начальника. Ничего не придумав лучше, как заменив текст реального объяснения на текст сфальсифицированного допроса, даже не потрудившись исправить орфографические ошибки и знаки препинания. Правда подписи здесь были более похожи, чем в протоколе допроса. Когда все эти махинации выплыли наружу, уголовное дело уже находилось в суде, а растиражированный фальшивый допрос разлетелся в качестве доказательства и лег в основу решений как минимум двух судов. И вот теперь, снова плечо к плечу встали должностные лица УМВД и СК, отбиваясь от очевидных фактов в виде почерковедческих исследований , проведенных в независимых учреждениях и свидетельских показаний. Да, в рамках проведения проверки в отношении сотрудника ОРЧ СБ было назначено аж две почерковедческих экспертизы, одна в ЭКЦ УМВД по Калужской области, где в качестве свободных образцов были взяты подписи с фальшивого допроса и еще одного объяснения, в котором как оказалось позже также подделаны подписи, правда на этот раз без искажения текста. Вторая же экспертиза была назначена в ЛСЭ Минюста по Калужской области, где эксперт со стажем работы с 2008г. нарушила все какие можно правила проведения подобных экспертиз, включая инструкции Минюста. И также, как и коллеги из ЭКЦ сделала вывод в соответствии с поставленной задачей или просьбой.

Создается ощущение, что в области, а особенно в городе Калуга это сложившаяся практика , когда сажая на скамью подсудимых заведомо невиновного человека, органы, которые должны стоять на страже интересов законности, дружно отмазывают своих коллег, которые по совместительству являются кому-то из них друзьями, родственниками и т.д.
