Why are the victims of the raider seizure sitting in a pre-trial detention center?
Raiders become victims and, through corruption, arrange a "sweet life" for opponents in the pre-trial detention center. Read the Rucriminal.info investigation with wiretapping materials.
How did it all start?
In 2013, the domestic manufacturer of household chemicals Best Clean (the main company in the B&B group) had legal disagreements with suppliers. For help, the owners of the company, Alexander Balakhovsky and Yakov Bosinzon, were advised to turn to lawyer Dionisy Zolotov.
Zolotov himself introduced himself as a relative of the head of the Security Service of the President of Russia, Viktor Zolotov, and a friend of the chairman of the Investigative Committee of Russia, Alexander Bastrykin. Zolotov argued that friends could initiate any criminal case at his request. The lawyer even traveled by car with diplomatic plates.
At that moment, the entrepreneurs did not yet know that they had met an already convicted swindler and swindler, who previously bore the name Denis Tumarkin. The incredible opportunities that Zolotov spoke about impressed the entrepreneurs, and the owners of Best Clean agreed to cooperate with him.
Since September 2013, shortly after meeting Zolotov, unreasonable inspections of the Internal Affairs Directorate for ZAO Main Directorate of the Ministry of Internal Affairs of Russia for Moscow began in the office of Best Clean LLC and at the production site. Against this background, Zolotov convinced businessmen that for 1 million US dollars he could protect the company from law enforcement checks. But already a few weeks after the fraudster received the money, security officials from the neighboring Southwestern District again came to the company's offices.
When asked by the owners of the company why this happened, Zolotov replied that it was no longer the police, but the Investigative Committee, which means that the amount for protection would now be different. In addition to another 2 million US dollars, Zolotov demanded that a 30% stake in the business of Balakhovsky and Bosinzon be transferred to him.
They won't touch their own people, explained Zolotov.
A few days after the transfer of money, Zolotov, together with Bosinzon and the general director of Best Clean, Savoskin, came to Marat Tambiev, the investigator of the Investigative Department for the South-Western Administrative District of the Main Investigative Directorate of the Investigative Committee of the Russian Federation for Moscow. The investigator apologized for the searches and handed over all the previously confiscated items.
After that, Zolotov provided a number of telephones to Balakhovsky and Bosison in case he was unavailable. People from the list, which included high-ranking representatives of the structures of the Ministry of Internal Affairs, the Investigative Committee and the prosecutor's offices, allegedly could solve all the problems instead of him. Marat Tambiev with his personal mobile phone was also on this list.
Recall that the FSB officers detained the head of the investigative department for the Tverskoy district in Moscow, Marat Tambiev, while receiving a bribe on an especially large scale.
(The loud detention of the investigator of the UK: bribes and participation in raiding anticorr.media/gromkoe-zaderzhanie-sledovatelya-sk-vzyatki-i-uchastie-v-rejderstve/)
In January 2014, Zolotov became one of the founders of Best Clean LLC, having drawn up a contract for the sale of a 30% stake in the authorized capital for 5 million rubles. As a result, it turned out that Zolotov paid for the acquisition of the share with the money transferred to him by Balakhovsky earlier. In fact, the real payment for the sale of the share, as Balakhovsky and Bosinzon say, did not occur.
In May 2014, Zolotov proposed the creation of a B&B holding. The agreement on the creation of the holding says that Balakhovsky was the chairman and the majority shareholder. Zolotov's role was reduced to business security. However, already in June, inspections by the investigator Marat Tambiev began again against the company.
In such a situation, Zolotov convinced Balakhovsky and Bosinzon that the company's assets should be transferred to other legal entities that did not arouse the interest of the security forces, and for this process he presented them with his authorized representative Igor Burkovsky. As a result, trademarks and equipment were withdrawn from Best Clean LLC, selling them to IP Duvidovich K.G.
To speed up the rescue of the holding, Zolotov decided to become the CEO of Best Clean and took office on August 5, 2014. But a few days later, on August 11, he was detained on charges of fraud.
Taking advantage of the situation, Burkovsky decided to take Zolotov's place. First, he told the owners of the company that Zolotov was a common fraudster who himself initiated the first checks of the company by paying Tambiev. Burkovsky also told a story about how a disguised general came to the factory in order to act out the idea of Zolotov's participation in protecting the company. Then he convinced them that he would save the business and themselves from possible detention. But for this they had to leave the Best Clean and donate their shares in the company to his trustee.
Burkovsky took over contact with Zolotov, who was placed in a pre-trial detention center. As he told Balakhovsky, Zolotov agreed and signed all the papers through lawyers.
Later it was discovered that back in July 2014, a new charter for Best Clean LLC was registered with the tax service, allegedly approved by Balakhovsky, Bosinzon and Zolotov. To remove the director, according to the new charter, is possible only by unanimous decision of all the founders.
In fact, the protocol announcement of the founders of the company about the adoption of a new version of the charter was falsified, which was confirmed by the examination conducted by Znatoki LLC in September 2021. As the experts established, the version of the new charter contradicted the Russian legislation on limited liability companies, which made it null and void. By the way, the investigation refused to conduct a handwriting examination of this protocol, despite the fact that the prosecution constantly refers to its norms.
Nevertheless, at that moment, Burkovsky convinced Balakhovsky and Bosinzon to donate their 70% stake in Best Clean to G.V. Antipov, an affiliate of him.
In January 2015, the remaining trademarks of the company were transferred to Duvidovich. At the same time, Burkovsky guaranteed that he had signed all the contracts with Zolotov through a lawyer.
In September, Antipov, as the owner of the company, replaced Zolotov as general director, forging the minutes of the general meeting of participants in Best Clean LLC. For example, the minutes indicate that Zolotov was present at the meeting, although at that time he was in a pre-trial detention center.
Even then, realizing that the founders of Best Clean saved the trademarks, Antipov filed a complaint with the police against Balakhovsky and Bosinzon on the fact of fraud and illegal withdrawal of property. But he was denied a criminal case due to the lack of corpus delicti.
In May 2016, the Arbitration Court of the Moscow Region established the relationship between Antipov and Zolotov and Burkovsky, and declared the donation agreements for shares to Antipov invalid.
When Balakhovsky and Bosinzon returned their shares, Olesya Kaplistaya was appointed to the position of general director. By this time, Zolotov's term of office had already expired.
During the management of the company by Zolotov and Antipov, the activities of Best Clean were suspended, there was no money in the company's accounts, and no tax returns were filed. This situation led to the fact that Best Clean LLC was unable to fulfill its obligations to counterparties in a timely manner. As a result, Best Clean LLC was declared bankrupt in July 2017, and the company was liquidated in April 2018.
But back in January 2017, the owners of the companies achieved the initiation of a criminal case against Burkovsky for an attempted raider takeover of Best Clean LLC. Today, the case is suspended due to the search for the accused.
Subsequently, the Hungarian company BellaBenBalur acquired the rights to trademarks from IP Duvidovich, which had previously been transferred to him from Best Clean. Then B&B Production Company LLC entered into license agreements for the use of these trademarks.
old friend
When Zolotov was released from prison in May 2019, he went to the police with a statement about fraud. According to his statement, during his directorship, 13 trademarks were the main assets. But then they were fraudulently stolen and reissued to BellaBenBalur. Zolotov believes that Savoskin, Balakhovsky and Bosinzon forged documents on the transfer of exclusive rights to trademarks to Duvidovich without his knowledge. And he, as a member of the company with a 30% share, suffered damage of more than 50 million rubles.
The accusation was based on the conclusion of an expert from PRIMAUDIT Consulting Group LLC, according to which the investigation estimated the damage from the sale of finished products using trademarks at 3.5 billion rubles. Accordingly, a 30% share of this amount amounted to more than 1 billion rubles.
In addition, Zolotov believes that his removal from the post of CEO was illegal, as was the appointment of Olesya Kaplista to this position.
Defenders of the victims note that the owner of the trademarks was originally Best Clean LLC, and not Balakhovsky, Bosinzon or Zolotov. Accordingly, only Best Clean LLC can be considered a victim in a criminal case.
The defense also refers to an expert assessment of the cost of exclusive rights to trademarks, conducted by Consulting Group Territory LLC. Their total cost was only 13 million rubles. And a 30% share in the authorized capital of Best Clean as of December 2013 is 8.8 million rubles.
The figure of 35 billion for trademarks raises huge doubts. How did the investigation approach the assessment - did it calculate the cost of all products ever released under this sign?
A fraud case was opened against Balakhovsky, Bosinzon and Savoskin. The accused are also charged with trademark infringement, patent infringement, money laundering and abuse of power. When all three were detained and placed in a pre-trial detention center, colossal pressure began on them.
Extortion as a target of persecution
First, according to Balakhovsky, Zolotov demanded that 4 billion rubles be transferred to him for the termination of the criminal prosecution initiated by him. Then this amount decreased to 2 billion, and then to 600 million rubles.
In case of non-payment of funds to Zolotov, the owners of the company were threatened to expand the circle of defendants, to involve Balakhovsky's daughter Tatyana, son Mikhail and employee Olesya Kaplistaya in the case.
According to Balakhovsky, in June 2021, in the Butyrka pre-trial detention center, where he Unfortunately, Zolotov threatened him in the presence of investigator Kirill Arkharov that he would organize a transfer to Matrosskaya Tishina, where he would be met in such a way that he would give back not only the money, but also rewrite the entire business. Moreover, Arkharov, according to Balakhovsky, watching what was happening, only said "shut your mouth and listen to what people say."
Later, 71-year-old Balakhovsky was placed under house arrest due to a serious health condition. According to Balakhovsky, Zolotov convinced him that with his capabilities he would create unbearable conditions for the accused in any of the pre-trial detention centers in Moscow.
After Zolotov’s words that he decides which cell to put in and who to keep in the punishment cell, Bosinzon was first transferred to the cell, where, according to the lawyer, he was threatened with physical violence, conveying greetings from Zolotov, and then they placed him in the punishment cell. The involvement of Zolotov and his lawyer Pavel Vlaskin in influencing the lives of the convicts is proved by an audio recording of the conversation between Vlaskin and lawyer Balakhovsky.

A: - Well, with Yasha, of course, you are also great there, you are revving, of course, it’s cool about the fact that he is.
Q: - Well, why does he not follow the rules of the regime? (The lawyer has not yet said "punishment cell", and Vlaskin has already expressed his awareness)
A: - Well, what about Yasha? As I understand it, they closed him in a punishment cell.
Q: - Well, the punishment cell, of course, he violates the regime, he is in the punishment cell, that's why.
…
Q: - As far as I understand, he is now kept where life prisoners are kept.
A: - Okay?
Q: - Or tuberculosis patients, some kind of ***, there the camera said *** *** that everything is dripping there, rusty racks, wet floors.
According to Balakhovsky, lawyer Vlaskin even showed him drafts of procedural documents on bringing his daughter Tatyana as a defendant and putting her on the wanted list. The purpose of Tatyana's persecution is simple - to suppress the will of her father.
Vlaskin and the lawyer Balakhovsky warned about this:

Q: - Now one of these days, one of these days, just so you understand, summonses will fly through lawyers to his children. Tanya and Misha. Warn me. Tanya and Misha will receive summons for interrogation. Didn't come twice, drive ***. Once again they did not come - an advertisement for the wanted list. And that's it. That is, there, damn it, the guys got such a move that you can’t stop them.
In conditions of hopelessness, Balakhovsky went to negotiate with Vlaskin. He told him that the 600 million rubles that Zolotov demands from him is the minimum amount, since at least 200 million rubles of them will be paid to the “Arkharovites” participating in the investigation of the criminal case. Vlaskin also confirmed in a conversation with a lawyer that the term "Arkharovtsy" refers to investigators involved in the Balakhovsky case.

A: - Well, this is the main Arkharovian, he will be loyal, he is aware of everything in general, like sweets, how would I think so too?
B: - Well, of course, well *** strange.
A: - All right.
Q: How to stop the process?
…
Q: Naturally everyone is interested, everyone is interested. Believe me. They still want to drink tea with sweets.
A: - Well, sweets, of course, sweets, of course, they want to get by the New Year
B: They want to. And in order to get sweets, you need to do everything beautifully. Here they are sitting now - scratching their turnips. And at a very high level they scratch their turnips, believe me.
…
V. - When we are now talking about 600 [million rubles], of which, believe me, 200 will only scatter to you-know-who, there are a lot of mouths, as you say to hell with Arkharovites.
In addition, the names of Boris Lavrenev and Sergei Yarosh, deputy heads of the Main Investigative Directorate of the Investigative Committee of the Russian Federation for Moscow, were also named as recipients for the transfer of funds. Allegedly, it was they who supported Zolotov and Vlaskin. We hope the investigation will find out whether this is true.

Q: – … There are moments when people are afraid, you know.
A: - Mmm
Q: - You read in the UK there, what was going on?
A: - Well, this is there, well, this is when this Drymanov, Loma ... this one was, well, yes, there was a case.
B: - Well, no, what, right now. what are you. Lavrenev, Borya Lavrenev ***. They were persecuted about them, about the management of M, the deputy head of M-ki Oleg was removed under this *** there. Understand. And we have support from there.
Ah, got it.
Q: They all seem to have survived. Well you understand anybody once again now is not loaded.
Also, from the conversation of lawyers, we can conclude that the criminal case apparently has a customized character.

Q: – Therefore, I’m saying that you need to explain the situation to people again, say you will get a deadline, no one will receive a condition, no one will go on parole without compensation for damage. Well, it's all a myth. People will rot for 8-10 years in prison, *** they need it. Even in this status, in the status of wool - this is about Yasha. Grandfather, grandfather will load well yo on n yat, he will leave for six.
…
Q: - In any case, whatever one may say, we'll take a yard anyway, we'll take a yard anyway. Not only that, we will destroy his business. He will be destroyed. They won't be able to carry on with it. And on top of that, they will go far, far away for several years.
…
A: - Well, look here, the situation is such that the investigator, now the investigation period for them, the period of detention is approaching six months.
Q: - Yes, yes, we are not sure, we know that he will be sent already instructions have been given to send the case to court, no one will hold it for a year
A: - Well, wait, so the examination has not even been carried out yet
Q: - Well, they will conduct an examination, Lord, well, I'm not telling you that they will send him now, I think at the beginning of the year he will be sent to court, the examination will be done in two months, well, two, in two months they will conduct an examination. You yourself understand who will do the examination, and what it will be like.
A: - Well, let's see, but who do we want the Ministry of Justice to see her through.
Q: - Well, you are the Ministry of Justice, and we will order it, the investigation will order it from itself in the investigation in the Investigative Committee, that's all, why do we need the Ministry of Justice.
Balakhovsky argues that in response to objections that these are civil law relations, and not a criminal offense, Zolotov answered Balakhovsky that he would not be able to demand as much money in the framework of a civil process as he could demand in a criminal case. And the goal of the criminal prosecution is precisely to induce the payment of at least 600 million rubles.
Zolotov's side is also confident in the inevitability of a guilty verdict, as Vlaskin told the lawyer.
Audio recording #5. “Conversation between Vlaskin and a lawyer” (A - lawyer, B - Vlaskin)

Q: - Do you understand if there is a verdict, yes guilty, and it will be a billion percent, what will he do with it?
A: - I don’t know, listen, well, everything depends on the decision of the court, what will be written there, you yourself understand.
Q: - Well, you understand that we are imprisoned to write as it should.
A: - Well, listen to the question here, they will also write such a question, they will not write it.
Q: - Well, listen, you are going empty, and we are going with good fuel, that's the difference.
Confidence to lawyer Zolotov is also added by information about the receipt by the investigator of the necessary testimony from witnesses in the case.

Q: - Today, Kirill will be interrogating, he will be interrogating, the opera guys also went there to talk with him, before he comes in, so that he gives the necessary testimony, the same as Duvidovich, I can tell you his last name if you are interested, he is over there now on interrogation.
A: Also, what about these, like her, trademarks?
V: Well, of course, of course, if you're interested, I'll tell you your last name now. He was also pulled today, and not only will he be interrogated, but I say, the guys have come to talk with him, “to agitate for the Soviet government.”
A: Mm.
Q: Duvidovich is now completely under us *** now, completely. On the 20th in court, he will give evidence, those that we need. This is so for you, behind-the-scenes information.
According to Balakhovsky, Zolotov assured him that after the transfer of the money, the persecution would stop, and Burkovsky, who is now on the wanted list, would be guilty of everything.
Wanting to save his loved ones, Balakhovsky agreed to Zolotov's conditions and transferred him the initial 50 million rubles with the purpose of the payment "loan repayment", although he never took any loan from him. It was necessary to indicate the presence of a loan in order for the investigator Arkharov to reasonably accept Balakhovsky's petition to remove the arrest from his accounts, Vlaskin told the lawyer. Also, Zolotov had to tell during interrogation that he gave a loan to Balakhovsky.

Q: - Do you know why, don't tell yet, do you know why they still want to confront him? It was insisted by the cops themselves, well, the investigators. In this confrontation, Denis will say a phrase, he will say [to the question] “what unites you?” he says “we were united by business earlier, I don’t have hostile relations, I knew it then.”
- "What else unites you?"
- "It also combines a certain loan that was given to me, I will not voice the amount."
He will simply say that there was a loan. This was insisted by the investigators in order to somehow fix that he is, because he says if we unblock the accounts, then *** what kind of loan, that is, it looks like they are now covering their ***.
However, after the transfer of money, the pressure continued, and Bosinzon and Savoskin remained in the pre-trial detention center, despite the fact that Balakhovsky asked Zolotov to release them under house arrest.

B. - I tried to do something for half a year, I have nothing. With such a roof, with such an administrative resource, as you have me at all levels, I pass
Z. - Well, you all ran to where we already went ***, and you run here, that is, I think that you just need to fulfill obligations to each other and that's it. And close the topic. Once and forever.
B. - Well, why are you show me? well, 20 million, well.
Z. - Well, I mean that everything will not be the same to the penny. I trust my man, you trust yours. Everything. and there is no need *** between us anymore, and Yasha will come out, and Savoskin will come out ***, we will let everyone out.
B. - Well, when? well. When are you releasing these guys?
Z. - When everything to the penny will be in my account.
B. - well, what kind of amount can you imagine?
Z. - well ***, I represent.
By the way, Zolotov even said that it was Burkovsky who was guilty of this story, and not Balakhovsky and Bosinzon.

B. - And Sasha [Savoskina] for what? Why is he here?
Z. - Sasha?
B. - I did a stupid thing that I pay for the fact that I met you
Z. - To tell you honestly? Do you want to be honest? -
B. - Well, of course.
Z. - Honestly. Blame *** Burkovsky ***.
Z. - Now, while there is still an opportunity to blame everything on him *** on this Burkovsky. So far, there is such a possibility. We have already interrogated Burkovsky, and Prokofiev is blaming everything on you.
B - Yes, well, I already understood that, they interrogate, what they want to hear, they hear.
Z. - Yes.
B. - And you know it.
Z. – You and I do not live in a state governed by the rule of law.
B. - Mm?
Z. – We do not live in a state governed by the rule of law.
B. - I already understood that.
…
B. - How did you achieve such a resource at all levels, security officials and everywhere?
Z. - Well, how: you come to the FSB *** ***. There are those people who help me all my life, you come there, ***. Like ***. You come ***, write to the Presidential Administration *** and then you have to connect the Prosecutor General ***, the Investigative Committee of Russia *** to remove this *** this *** your program from the air.
B. - That is, at that level you already have your own people, this is some kind of nightmare. Let the guys out.
Z. – I'll release it right next week.
B. - Release it, release it now, release it this week.
Z. – No, no, no.
B. - With such a resource as yours, why should you be afraid, Denis?
Z. - No one will let anyone out, I'll tell you more, we will move on, forward until you fulfill your obligations. I told everyone this.
Today, Balakhovsky has reason to fear for his life and the lives of his children. Vlaskin has already noted that on their part, everyone's nerves are on edge.
Audio recording No. 4 "Conversation between Vlaskin and a lawyer." (A is a lawyer, B is Vlaskin).

Q: - All the evil ones are already just evil, everyone is ready to simply destroy the grandfather. In general, completely, totally destroy
And all?
Q: - He bullied everyone, he bullied everyone, just everyone
…
Q: - When Tatyana is charged and put on the wanted list, then there will be a deep knockout ***.
A: - Well, this is a blow to the children.
Q: Yes, but what do you do?
Also, Bosinzon and Savoskin have every reason to fear for their lives and health. For example, Savoskin even suffered a 45-day coma, and after leaving it, a month later he was sent to a pre-trial detention center. And against Bosinzon, an active information war has been launched on the Internet, discrediting his honor and dignity, which creates a real threat to the life and health of a person in prison.
Vlaskin noted that Zolotov had to spend a lot of money on the conclusion of entrepreneurs in a pre-trial detention center. The extension of his arrest alone cost him about $100,000, Vlaskin told his lawyer.
Audio recording No. 3 "Conversation between Vlaskin and a lawyer." (A - lawyer, B - Vlaskin)
https://t.me/crocurator/13
Q: - If he has 400 [million] left, it will be very good, considering how much he has already spent on this whole case. I think he has already spent at least (shows one finger) dollars like that.
A: - Yeah.
Q: - Well, consider the court already 100 [thousand dollars], one and a half [thousand dollars] lawyers. That's how it took at least everything, because no one wanted to excite.
The owners of the company are sure that all charges against them are unlawful and unfounded in order to extort money under the threat of criminal liability. The presented audio recordings allow us to conclude that the results of the criminal case may well be falsified in order to reach a guilty verdict. The defendants believe that investigators, experts, witnesses and even judges in their case cannot be trusted.
This was proved by Vlaskin himself, who said that now he knows about wiretapping. Before that, the side of the defense of the accused handed over the wiretapping materials to the FSB. But then these materials were transferred to the Moscow Investigative Committee. The question arises, can an investigation be carried out objectively if investigators bring potential criminals up to date on the case? In addition, the names of the leadership of the Moscow Investigative Committee appear in the case file as executors of the order of Tumarkin-Zolotov-Shapiro. Can the investigators of the Moscow Investigative Committee objectively investigate the case? We believe the answer is obvious: it is impossible to leave the investigation to the Moscow Investigative Committee.
Only the heads of law enforcement and supervisory authorities, Alexander Bastrykin, Igor Krasnov and Alexander Bortnikov, will be able to fairly understand this situation, taking the matter under their personal control.
