Всё это осталось красивой ширмой и бутафорией в стиле госкорпорации развития .На деле же бюджетные деньги попросту выводились из ВЭБа под видом разработки стратегий развития транспорта, мастер-планов городских транспортных артерий, перекочевывая из бюджета "друзьям-олигархам" Шувалова.



Одним из якорных получателей госденег от пилорамы Говоруна выступают, в том числе структуры "Трансмашхолдинга" (принадлежит олигархам Бокареву и Махмудову). Заемные деньги ВЭБа успешно перекочевывают в руки олигархов на 20 лет по смешной ставке в 4% годовых и попросту выводятся из РФ или перекладываются в банки для получения процентной маржи, но ни в коем случае не для целевого использования и лишения проблем с изношенным и убитым транспортом по всей стране. Так, городской трамвай в Волгограде так и не дождался денег ВЭБа, и по городу до сих пор ездит убитое советское транспортное наследие, которое в отчётах ВЭБа называют "модернизацией". In April 2023, the Tchaikovsky City Court nevertheless found the former director of the Oscar municipal unitary enterprise, Stanislav Aleksandrovich Korolev, guilty of embezzling 1.3 million rubles from the company’s accounts.

According to the investigation of the department of the Ministry of Internal Affairs of Russia for the Chaikovsky city district, the convicted person, being the director of a limited liability company, using his official position, from May to December 2020, using a bank business card linked to the organization’s current account, paid for goods purchased in stores for own needs.

The court sentenced the culprit to imprisonment for 3 years and a fine of 1 million rubles. The court decided to consider the imposed sentence of imprisonment as suspended.

It can be assumed here that the machinations with the destruction of the Oscar municipal unitary enterprise were covered up by Agafonov’s “big brother” from Perm. В городе Чайковский Пермского края давно было понятно, что криминальные грехи заместителя главы Чайковского городского округа Алексея Валентиновича Агафонова, бывшего начальника Чайковского управления МВД, кто-то покрывает в Перми. Что бы он в Чайковском не творил, все ему сходило с рук. После ареста его старшего брата пазл сложился. Это губернатор Дмитрий Махонин. Подробности – у Rucriminal.info.

Старшего Агафонова 6 октября 2023 года арестовали:

Андрей Агафонов, вплоть до 20 сентября 2023 года возглавлял отдел собственной безопасности (ОСБ) оперативно-поискового бюро (ОПБ) ГУ МВД России по Пермскому краю. 20 сентября Андрей Агафонов был взят под стражу. На другой день, 21 сентября, в его отношении возбуждено уголовное дело. 5 октября подполковник был задержан, 6 октября его отправили под стражу решением Дзержинского районного суда Перми и уволили из полиции «по отрицательным мотивам».

Согласно обвинению, которое предъявлено 9 октября, начальник ОСБ ОПБ Андрей Валентинович Агафонов допустил превышение должностных полномочий из корыстной или иной личной заинтересованности (п. «е» ч. 3 ст. 286 УК РФ). С 23 августа 2022 года по 1 августа 2023-го он через служебные информационные базы собирал персональные данные некоторых граждан и продавал их заинтересованным лицам, полагает следствие.

На суде присутствовал младший брат арестованного Алексей Валентинович Агафонов и предлагал внести залог в размере одного миллиона рублей. Попытался прикрыть старшего, но не сработало.

Судья Наталья Погадаева поддержала прокурорские доводы и оставила Андрея Агафонова в СИЗО до 21 ноября. Обвиняемому грозит от 3 до 10 лет лишения свободы.

Как выяснил Rucriminal.info, было у отца Валентина Агафонова два сына, Андрюша и Алёша. Отец ещё во времена СССР работал начальником УВД Большесосновского района Пермской области. Оба сына пошли служить в полицию, так сказать, по стопам отца. Очень жаль, что влиятельный папаша не привил сыновьям главного качества для службы в органах правопорядка – уважения к законам.

Старший сын Агафонов Андрей Валентинович уже сидит, при этом второго сына – Алексея Валентиновича Агафонова, погрязшего в криминальных привычках и пренебрежении к законам, губернатор Пермского края Дмитрий Махонин планирует посадить…. в кресло главы Чайковского городского округа? К сожалению, это не сказка, это быль про братьев Агафоновых

Младший брат - Агафонов Алексей Валентинович, в настоящее время продолжает работать первым заместителем главы администрации Чайковского городского округа, руководителем аппарата. И, что поражает – губернатор Пермского края рассматривает его кандидатуру в качестве кандидата на конкурс на должность главы Чайковского городского округа вместо уходящего Вострикова Ю.Г. При этом, конечно, Махонин в курсе всех криминальных хвостов этого «конкурсанта».

Криминальные инциденты с участием Алексея Валентиновича Агафонова скрывали, следы заметали. Надеемся, что после потери влияния в органах и ареста старшего Агафонова, вспомнят и про младшего.

А.В.Агафонов был назначен начальником УВД в Чайковский район в 2016 году. Перечислим примеры откровенно криминальных ситуаций, которые были прикрыты, вероятно, его старшим братом.

Незаконно приватизированная муниципальная квартира.

Начальник Чайковского отдела МВД Агафонов А.В. был куплен с потрохами в первые же месяцы службы – глава района Востриков Ю.Г. незаконно передал семье Агафоновых муниципальную трехкомнатную квартиру на улице Азина и позволил в последствии эту квартиру приватизировать, хотя до переезда в Чайковский семья Агафоновых уже имела жилье в собственности. Совершенно незаконная приватизация муниципальной квартиры Агафоновыми осталась никем не замеченной!

Незаконное трудоустройство жены.

Жену Агафонова Наталью в 2017 году глава Чайковского района Востриков Ю.Г. опять же незаконно пристроил на должность директора детской школы искусств в селе Фоки. Проработавшая около 20 лет на посту директора этой школы Лидия Клячина была уволена в феврале 2017 г. без объяснения причин (п. 2 ст. 278 Трудового кодекса РФ). Она обратилась в Чайковскую городскую прокуратуру с требованием проверить законность назначения нового директора на освободившуюся должность. Чайковская городская прокуратура подтвердила доводы Лидии Клячиной. В ходе проверки было установлено, что назначенная директором ДО «Чайковская районная школа искусств» супруга начальника Чайковского отдела МВД Агафонова Н.П. не имеет высшего образования, необходимой справки о наличии или отсутствии судимости, ею также не была пройдена обязательная для этой должности аттестация.



Прокуратура внесла представления главе Чайковского района Юрию Вострикову, а также начальнику Управления культуры и молодежной политики администрации Чайковского района Елене Смирновой о незаконности назначения Натальи Агафоновой. Но скандал прикрыли и Агафонову Н.П так и оставили директором.

Агафонова Н.П. оказалась неспособной руководить детской школой искусств, что ни удивительно. Школу при её директорстве постоянно сотрясают скандалы и конфликты. Большинство опытных педагогов были изгнаны с работы этой «новой метлой». Например, в 2022 году незаконно уволенному педагогу Кудашиной В.В. удалось выиграть суд и получить компенсацию за незаконное увольнение более 300 тысяч рублей. Выплатили из бюджета, Агафонову Наталью прикрыли. Это не единичный пример.

Уголовное дело по заказу.

В 2017 было состряпано на скорую руку уголовное дело против мэра г. Чайковский Третьякова А.В. и его зама Смышляевой Н.В. по поводу незаконной передачи муниципальной квартиры несовершеннолетней дочери Смышляевой. Нет, мы не будем утверждать, что Третьяков и Смышляева – не пытались увести муниципальную квартиру.Пытались, это установлено. Но есть нюансы – квартира Смышляевой была возвращена в муниципалитет, и, несмотря на это, и Третьяков, отец 3-х несовершеннолетних детей, и Смышляева Н.В., - мать несовершеннолетней дочери, оба получили реальные сроки и уже отсидели. Хотим напомнить, что семья Агафоновых в это же время незаконно приватизировала трехкомнатную квартиру и возвращать не собирается. И таких случаев – раздачи муниципальных квартир незаконно в период работы Вострикова главой Чайковского района – десятки, если не сотни. Достаточно вспомнить, что в бывшем военном городке Марковский Чайковского района был раздарен своим и нужным людям целый дом - №11, более 40 отличных квартир. Никто пока не сел.

Дело Третьякова начало развиваться в 2017 году во время дружеской попойки на базе отдыха "Раздолье", принадлежащей Ю.Г. Вострикову и его другу А. А. Гражданкину, с участием начальника УВД Чайковского района А.В.Агафонова. Там и родилась идея устранить мэра города Третьякова. Через возбуждение уголовного дела, единственная цель этого сляпанного на скорую руку дела была – устранить конкурента Вострикова на предстоящих выборах . План мести по Алексею Третьякову, в конечном итоге, они осуществили. Сколько бы Третьяков со Смышляевой не пытались свести дело хотя бы к условному сроку, не получалось. Допускаем, что дело мэра Третьякова «крышевал» старший брат Агафонова.

Скрыта информация о конфликте с инспекторами ГИБДД с участием пьяного Агафонова А.А.

27 февраля 2019 года в Чайковском нарядом ДПС был остановлен автомобиль «Toyota Land Cruiser» номер 777, где в качестве пассажиров находились пьяные заместители главы ЧГО Агафонов А.В. и Герасимов И.Ф. Стоя на боевом посту, сотрудники ГИБДД заметили, что этот автомобиль странными зигзагами передвигался по городу, и нарушал правила дорожного движения, создавая реальную угрозу всем участникам движения. Водитель автомобиля, теневой чайковский предприниматель и друг главы Вострикова, Инкин Александр был сильно пьян. Бывший полицейский Агафонов пытался «отмазать» пьяного водителя, но не вышло. Составили протокол, в который были внесены и замы - Агафонов с Герасимовым, как лица, препятствующие работе инспекторов ГИБДД. История получила огласку, был большой скандал, водитель лишился прав, но оба зама главы ЧГО избежали наказания.

Свидетели рассказывали: «В общем, отважные работники госавтоинспекции начали составлять протокол на дорожного хама, а с заднего сиденья вываливается пьяный в хлам заместитель главы Чайковского городского поселения Алексей Валентинович Агафонов и начинает "пальцы гнуть", то есть "решать вопрос по существу". Но морально устойчивые сотрудники Российской правоохранительной службы вежливо попросили своего бывшего начальника (конечно же, они сразу признали в пьяном пассажире экс- начальника Чайковской полиции А.В. Агафонова ) не мешать работать инспекторам составлять протокол на нарушителя Инкина. Пьяный Агафонов не смирился с развитием событий и начал "включать грозного шефа". Сотрудникам ГАИ ничего не оставалось делать, как занести в протокол и Агафонова, отразив на бумаге его реальное состояние».

По большому счёту, должно было пройти служебное расследование. Случай не должен был остаться без внимания. Но ничего такого не случилось, Агафонова не уволили, инцидент замяли!

Стрелка с криминальным авторитетом



В августе 2020 в соцсетях распространилась информация о бесчинствах странной кампании - заместителей главы Чайковского городского округа Алексея Агафонова и Ивана Герасимова, а вместе с ними и местного криминального авторитета Вячеслава Костромитина в кафе «У Сайфутдина» на территории Воткинского района. Из опубликованных сообщений следовало, что чиновники и недавно отсидевший срок авторитет Костромитин по кличке «Кострома», отобедав, отказались платить по счету. Кроме того, чтобы «поставить на место» владельца, угрожали сжечь кафе. В соцсетях также распространена запись видеокамер, на которой запечатлен визит в кафе этих «высоких гостей». Обвинения были настолько серьезными, что названные чиновники могли бы иметь неприятности в суде.

С вопросом о том, случилось ли все это на самом деле, журналисты обратились к владельцу кафе Сайфутдину Абдурахманову. Предприниматель подтвердил, что он 5 августа обратился в полицию г. Воткинска и написал заявление. И вся описанная в соцсетях история - чистая правда.

Информацию о заявлении предпринимателя подтвердили и в ГУ «Межмуниципальный отдел МВД России «Воткинский». В официальном ответе на запрос сообщается (цитата):

«05.08.2020 года в МО МВД России «Воткинский» обратился Абдурахманов Сайфутдин Зайнитдинович с письменным заявлением о том, что 29.07.2020 года в его кафе, расположенном по адресу пос. Новый ул. Построечная д.29., приехали сотрудники администрации города Чайковский и авторитет по имени Слава, которые угрожали ему и требовали денег».



Заявление Сайфутдина Абдурахманова было зарегистрировано в Межмуниципальном отделе МВД России «Воткинский» №19434 от 05.08.2020 года. Была назначена проверка. Но и это дело замяли и Агафонов продолжил работать в Администрации ЧГО!



Прикрыли пьяные покатушки Фанави Зекрина.

Этот случай тоже остался не расследованным, никто не наказан, Агафонов прикрыл . 6 декабря 2022 года Зекрина Фанави Хайбрахмановича, ректора Чайковского института физкультуры, задержали ночью пьяным за рулем государственной машины марки Ford Kuga черного цвета, принадлежащей институту физкультуры. Машина была отправлена на штрафстоянку, Фанави Зекрин был помещен, в СИЗО. Толпа "лучших людей города" во главе с А.В.Агафоновым полдня кружилась вокруг Чайковской ГИБДД, и вызволила своего человечка! Зекрину все сошло с рук, его даже прав не лишили!

МУП «Оскар» разворовали, обанкротили и продали, никто не наказан

Начиная с 2016 года менее чем за три года, под управлением чиновников администрации Чайковского было уничтожено процветающее ранее предприятие МУП «Оскар». До того как за это предприятие взялась «команда» Вострикова Ю.Г. и Агафонова А.В., оно успешно выполняло работы по контрактам на обеспечение питанием в школах, учреждениях, больницах Чайковского района. Предприятие было финансово устойчивым, имело собственные помещения, производственное оборудование, и коллектив опытных сотрудников. У главы Чайковского возникла «крайняя необходимость» перевести контракты на питание школ и больниц частично ООО «Элиона», частично в частный бизнес самого Вострикова, то есть подгрести доходный бизнес под себя.

В МУП «Оскар» поставили директором племянника Ю.Г. Вострикова – Александра Вострикова, который не имел ни опыта работы руководителем, ни соответствующего образования. С помощью племянника «Оскар» лишили контрактов и начали разворовывать, продавая по дешевке оборудование и материальные ценности. Чтобы прикрыть факты воровства МУП преобразовали в ООО «Оскар» и назначили зиц-директора, под руководством которого предприятие было окончательно уничтожено и обанкрочено.

В апреле 2023 года Чайковский городской суд все таки признал бывшего директора МУП «Оскар» Королева Станислава Александровича виновным в растрате 1,3 млн рублей со счетов предприятия.

По версии следствия отдела ОМВД России по Чайковскому городскому округу, осуждённый, являясь директором общества с ограниченной ответственностью, используя служебное положение, с мая по декабрь 2020 года при помощи банковской бизнес-карты, привязанной к расчётному счёту организации, осуществлял оплату приобретённых в магазинах товаров для собственных нужд.

Суд приговорил виновного к лишению свободы на срок 3 года и штрафу в 1 миллион рублей. Назначенное наказание в виде лишения свободы суд постановил считать условным.

Можно и тут предположить, что махинации с уничтожением МУП «Оскар» были прикрыты «большим братом» Агафонова из Перми. Известно, что осужденный Королев С.А. несколько лет являлся доверенным лицом и личным поверенным в незаконных делишках самого Агафонова Алексея Валентиновича. Именно с его подачи этот проходимец и информатор Алексея Валентиновича и получил не только должность директора МУПа, не имея ни опыта, ни образования, но и возможность беззастенчивого разграбления бывшего ранее богатым предприятия. Если бы не Агафонов, Королев сел бы надолго и заслуженно.

Подобных криминальных историй с участием пьяного Агафонова А.В. в Чайковском вам расскажут десятки. В администрации ЧГО с пьянством вообще беда – сам Востриков постоянно уходит в запои, прикрываясь липовыми больничными. Оба его зама также сильно пьющие люди – и Агафонов А.В. и Герасимов И.Ф.

В Чайковском общеизвестный факт – глава Востриков Ю.Г. и его зам Агафонов А.В. ни во что не ставят прокуратуру, следственные органы, ГИБДД. В Чайковском надеются, что после ареста старшего Агафонова силовики покопаются в криминальных подвигах младшего и вскроют этот гнойник на теле Чайковского. It is not yet clear whether this meeting took place, but soon Cherepennikov showed up at the office on Michurinsky Prospekt. And then there appeared a man whom he called “personal doctor.” However, as the Cheka-OGPU found out, this man was never a doctor and did not have a medical education. This is just an acquaintance of Cherepennikov, who had the opportunity to obtain xenon and helped the businessman use this gas as a procedure for all diseases. At the same time, he made Cherepennikov xenon-dependent. The entrepreneur constantly used this gas, and sometimes organized real “marathons” for a day or two, without parting with the cylinder.

Sources believe that Cherepennikov could have been “dragged” from Turkey to Moscow precisely under the pretext of using xenon.

According to official information, the owner of X Holding in 2020-2021. there was the Yuesem Telecom company of the oligarch Alisher Usmanov. Смерть Антона Черепенникова, который был «мозгом» Цитадели , ИКС-Холдинга, поставляющих оборудование для СОРМ и ГосСОПКА, приобретает все более загадочные очертания. Как выяснил телеграм-канал ВЧК-ОГПУ, точная причина гибели Черепенникова пока не установлена. А человек, который представлялся его личным врачом, таковым не являлся. Он, когда Черепенникову стало плохо, даже не смог провести ему реанимационные мероприятия. Более того этот «врач» сделал Черепенникова ксенонозависимым и бизнесмен потреблял газ в каких-то гигантских масштабах.

Это одна из последний фотографий Черепенникова, она сделана 19 июля 2023 года во время отдыха бизнесмена с супругой в Турции. Накануне, 18 июля, он неудачно нырнул в воду и сломал плечевую головку. В Турции ему сделали рентген, который показал перелом, но лишь рекомендовали носить повязку и пить противовоспалительные препараты. Уже 20 июля Черепенников неожиданно объявил супруге, что ему срочно надо лететь в Москву, поскольку «образовалась» некая очень важная встреча.



Из аэропорта Черепенников отправился в частную клинику на западе Москвы, где всегда лечился. Там ему сделали КТ и сказали, что возможно придется провести операцию. Однако, Черепенников вел себя очень нервно и фактически «сбежал» от врачей, заявив, что у него очень важная встреча, а потом некие «процедуры». Пока не ясно была ли эта встреча, но уже вскоре Черепенников объявился в офисе на Мичуринском проспекте. А следом там появился человек, которого он называл «личным врачом». Однако, как выяснил ВЧК-ОГПУ, врачом этот человек никогда не являлся и не имел медицинского образования. Это просто знакомый Черепенникова, который имел возможность доставать ксенон и помогал бизнесмену употреблять этот газ, как процедуру от всех болезней. При этом сделал из Черепенникова ксенонозависимого. Предприниматель постоянно употреблял этот газ, а иногда устраивал настоящие «марафоны», по сутки-двое, не расставаясь с баллоном.

Источники полагают, что из Турции в Москву Черепенникова могли «вытащить» именно под предлогом употребления ксенона.

Дальше в офисе на Мичуринском начался очередной «ксеноновый марафон», во время которого Черепенников стал задыхаться. Однако, «врач» не сумел провести реанимационные мероприятия и к приезду «Скорой» Черепенников был мертв.

Также известно, что Черепенникова сам или с чей-то подачи принимал какое-то немыслимое количество препаратов. Он лечился сразу от …..шести хронических заболеваний и употреблял целую «охапку» капель, таблеток и т.п.

В конце прошлого месяца официальные СМИ сообщили о назначении Алексея Белова гендиректором «ИКС Холдинг». Белов был представлен как заместитель основателя холдинга Антона Черепенникова.

Бизнесмену было всего 40 лет. В 2024 г. он планировал выйти на IPO, инвестиционная стоимость «Икс Холдинга» оценивали в 300 млрд руб. Неудивительно, что смерть Черепенникова вызвала настоящий шок у всех, кто его знал

Официальные СМИ пишут свои статьи по пресс-релизам, предоставляемым компаниями. Это позволяет вводить в заблуждение участников рынка и обычных читателей. И только внимательное сопоставление фактов позволяет выявить противоречия, которые могут быть попыткой скрыть серьезное преступление.

Алексей Белов до сих пор так и не стал гендиректором ООО «Икс Холдинг», хотя 1 ноября числился руководителем одного из учредителей компании - ООО «ХК Икс», созданного в июне 2022 г. Сейчас гендиректор этой компании – снова Антон Черепенников, он же и учредитель, доля которого принадлежит доверительному управляющему Алексею Шелобокову, назначенному нотариусом, ведущим дело о наследовании.

В «Икс Холдинге» также создан управляющий совет, куда кроме Шелобокова вошли топ-менеджеры «КНС Групп» и «Бюро 1440» Артем Икоев и Сергей Столяров. До 2022 г. Алексей Шелобоков был соучредителем этих компаний, сейчас возглавляет «Бюро 1440» и ГК «Ядро».

По официальной информации, владельцем «Икс Холдинга» в 2020-2021 гг. была компания «Юэсэм Телеком» олигарха Алишера Усманова. В январе 2022 г. Антон Черепенников якобы выкупил холдинг, но стоимость сделки не разглашалась, что заставляло сомневаться в ее совершении.

Если Черепенников выкупил «Икс Холдинг», то у него должны были быть активы на десятки миллиардов долларов, а информация из открытых источников на момент смерти бизнесмена свидетельствовала о том, что на 2020 г. стоимость компаний Антона Черепенникова оценивалась в 231 млрд руб., принадлежащих ему долей – в 30 млрд руб., на конец 2022 г. эти суммы были 44 млн руб. и 22 млн руб. соответственно.

ООО «Икс Холдинг» в течение 2022 г. вышло из капитала компаний «КНС Групп», «Бюро 1440», «ГК Ядро», «Цитадель», «Единый фактор», «Пикта», «Крипттонит» в 2023 г. – из «Гарда технологии», ООО «Бастион» и ООО «Техаргос». Получается, что Антон Черепенников выкупил у олигарха Усманова компанию, а потом начал освобождаться от ее активов. Это выглядит нелогично.

Например, ООО «КНС Групп» с выручкой в 2022 г. 66 млрд руб. и прибылью 7.2 млрд руб. до ноября прошлого года принадлежало ООО «Икс Холдинг», Александру Бакулину, Артему Икоеву, Сергею Столярову и Алексею Шелобокову. То есть, они были партнерами Антона Черепенникова.

Учредителем ООО «ГК «Ядро» Алексей Шелобоков был еще в 2016 г. В 2019 г. соучредителем копании стало ООО «Форпост», принадлежащее ООО «Юэсэм Телеком», в том же году оно стало совладельцем ООО «КНС Групп», а с 2017 г. по 2022 г. входило в капитал ООО «Талмер», сейчас принадлежащее ПАО «Мегафон».

Соучредителями ООО «Талмер» в 2018 г. были несостоявшийся гендиректор ООО «Икс Холдинг» Алексей Белов и ООО «Форпост». С 2017 г. по 2020 г. Белов возглавлял «Талмер». С сентября 2022 г. является гендиректором созданного в том же году ООО «Икс Технологии», которым до ноября того же года владело ООО «Икс Холдинг».

Антон Черепенников долгое время вел бизнес на деньги Алишера Усманова, но потом решил от него уйти. После смерти весь бизнес Черепенникова фактически оказался под контролем людей олигарха, которые вошли в управляющий совет. Очень большой вопрос, кому в результате достанется наследство бизнесмена, если оно еще вообще есть, а не размыто по структурам и людям Усманова.

На сегодняшний день можно констатировать несколько фактов, на которые стоило бы обратить вниманиеАнтон Черепенников потерял почти все свои активы. Сейчас они контролируются людьми олигарха. Алексей Белов, вопреки информации официальных СМИ, почему-то пока не стал гендиректором «Икс Холдинга». И это - неспроста. Возможно, наследники Черепенникова пытаются бороться за свои деньги. Главное, чтобы обошлось без внезапных смертей.

“Without Novikov’s cover, it’s difficult for Judge Safaeva to retain her seat”

On October 31, the six-year term of work of Naili Safaeva, who has headed the 11th Arbitration Court of Appeal since 2017, expired. The current head of the appeal, 46-year-old Nailya Safaeva, was unable to obtain a recommendation from the Higher Qualification Committee for reappointment for another six-year term of office. Creature Novikova



In 2017, Nailya Safaeva headed the 11th Arbitration Court of Appeal, jumping immediately over two steps of the career ladder. For a young judge who worked as deputy chairman of the Arbitration Court of Tatarstan, a promotion could be a transition to the position of head of the same court where she worked. However, having bypassed this step, she immediately headed the court, which verifies acts adopted by arbitration courts of four constituent entities of Russia. What contributed to the sharp rise?

According to sources in the judicial community, Safaeva mainly owes her success to... the current all-powerful chairman of the Moscow Arbitration Court (ACCM) Nikolai Novikov. There are very significant overlaps in the biography of the two judges.



Nailya Safaeva worked as a judge of the Arbitration Court of the Samara Region from 2007 to 2013, when it was headed by Novikov. Then she followed him to Kazan. There Novikov became the chairman of the Arbitration Court of Tatarstan, and Safaeva became his deputy. In 2017, the Higher Qualification Committee approved Nikolai Novikov for the post of Chairman of the Moscow Arbitration Court (ASGM). In parallel with preparations for his transfer, he actively lobbied for Safaeva’s appointment to Samara. And a few months later, the Higher Qualification Commission considered her candidacy for the post of head of the 11th arbitration.



The appointment was not without problems. During the meeting of the HQCC, an anonymous letter was published in which Judge Safaeva was accused of extorting money. They also talked about expensive gifts that colleagues presented to Safaeva. During the meeting, it was established that the organization where the judge’s sister works six times acted as a party to the case in the Tatarstan arbitration court, but it turned out that Nailya Safaeva did not appear in these processes. However, one must understand that the case was considered within the same walls where Judge Safaeva worked, and, as usual, there is always an opportunity to whisper the necessary information to colleagues during a lunch break. As a result, the VKKS nominated her candidacy. Immediately after, in one of the interviews, the judge, who had risen several steps up the career ladder, veiledly thanked her former boss Novikov, mentioning that under his leadership in Tatarstan “it was easier for her to get into the swing of things.”



As time has shown, without Novikov’s broad back, Judge Safaeva found it difficult to hold the chair under her. This year, at a meeting of the High Qualification Board of Judges, many questions arose for her and the court she heads.



Two questions became key. First. Why is there a large percentage of canceled and amended acts in the 11th AAS? The question is quite standard, since this indicator is an indicator of the work of all judges. Nailya Safaeva, in turn, tried to justify herself by the increased workload and staff shortage within the walls of her department.



Second question. Why did the judges of the 11th AAC periodically not take into account the instructions of the cassation when re-examining cases? The head of the court hastened to reassure the members of the HQCC, saying that when she was appointed to the post, there were more than 30 such cases in a year, and now their number has been reduced to five. It was during that period that Nikolai Novikov and Alexander Efanov were the leaders in two key courts - the Samara Region Administrative Court and the 11th Arbitration Court.



We are publishing several indicative canceled decisions for the period that Nailya Safaeva mentioned. These are exactly the acts that Novikov approved and Efanov upheld, while a higher authority overturned their decisions.



1. Volga-Plus LLC applied to the Samara Region Administration (headed by Nikolay Novikov - editor's note) with a statement to the administration of the Federal Registration Service of the region to recognize as illegal the actions expressed in the refusal of state registration of an agreement on the provision of lease of land plots, natural objects on the territory of the Samarskaya Luka National Park dated September 30, 2004, measuring 1 hectare. The company also asked for an obligation to carry out state registration of the agreement on the provision of land plots for lease on the territory of the national park. By the resolution of the Federal Antimonopoly Service dated April 20, 2009, the decisions of the Samara Region Autonomous Court (headed by Nikolay Novikov - editor's note) and 11 AAS (headed by Alexander Efanov - editor's note) were canceled and the application of Volga-Plus LLC was denied.



2. TU of the Federal Property Management Agency for the Samara region appealed to the AS of the Samara region with an application for declaring illegal the refusal of the Office of the Federal Registration Service of the region to state registration of the ownership of the Russian Federation for a real estate object - a land plot of 44 thousand square meters, located in Samara, in the national park, Rozhdestvenskoye forestry, and the obligation to carry out state registration of the ownership of the Russian Federation for a real estate object. By the resolution of the Federal Antimonopoly Service dated May 27, 2009, the decision of the Samara Region Administrative Court (headed by Nikolay Novikov - editor's note) and Resolution 11 of the AAS (headed by Alexander Efanov - editor's note) were cancelled. The claims of the Federal Property Management Agency for the Samara Region were denied.



3. STEX LLC applied to the Samara Regional Administration with a statement to the administration of the Federal Registration Service of the region to recognize as illegal the refusal to state registration of an agreement to lease land plots in the territory of the Samarskaya Luka National Park, concluded between the federal state federal institution National Park " Samarskaya Luka" and LLC "STEX" in relation to a land plot in the national park. By the Resolution of the Federal Antimonopoly Service dated 04/06/2010, the decision of the Administrative Court of the Samara Region (headed by Nikolay Novikov) and Resolution 11 of the AAS (headed by Alexander Efanov) were cancelled, and the case was sent for a new consideration by the Arbitration Court of the Samara Region.



And there are dozens of such canceled decisions that the FAS PO turned down for Efanov and Novikov. Most of them concern the Samarskaya Luka National Park.



The story of the case of “Era” and Podzhabny Island (located on the territory of the Samara Luka National Park - editor’s note) began with an illegal decision made by the Samara Arbitration Court chaired by Nikolai Novikov in the 2010s. It was with him that the epic of squeezing land from the state began.



Despite the fact that during the period of Naila Safaeva there were not many canceled acts, she is reliably aware of the vicissitudes of those cases, since she herself worked under the leadership of Nikolai Novikov in the Autonomous Republic of Samara Region.



One way or another, the VKKS did not support her impulse to remain in a leadership position, even despite the absence of other candidates. Note that Novikov turned out to be more successful than his protégé. Last year, he received a recommendation from the Higher Qualification Committee and extended his powers, despite a series of openly criminal scandals with his subordinates.



In fact: Nikolai Novikov’s acts were canceled many times more often than Safaeva’s acts. However, on October 31, Naila Safaeva’s last day of work expired, and Efanov was disgracedly removed from his chairman’s position. And only Novikov, who led the first instance and made decisions that Efanov left in force, sits in the warm chair of the chairman of the ASGM.



Samara "six"



As a result of checking Efanov’s activities, the Prosecutor General’s Office of the Russian Federation established the fact of his affiliation as chairman of the 6th KSOYu with the Samara LLC Era. In fact, this is a direct confirmation of a conflict of interest in the actions of the judge and his violation of the Code of Judicial Ethics. The story is like this. In 2014-2016, plots in the urban recreation area on Podzhabny Island were taken out through a raider scheme in favor of Era LLC. The co-founder of this company was previously the son of Alexander Efanov, Ivan. Transactions were legalized through the 11th AAS, which at that time was headed by Efanov Sr. At a market price of 4 billion rubles, the land went to Era almost 100 times cheaper - for 46.5 million. According to the audit, Efanov subsequently bought part of the seized land from Era for the construction of a personal estate, also at a price below the market price - 860 thousand . rubles per 0.5 ha. This became one of the grounds for the decision of the Higher Qualification Committee to deprive the judge of his powers and robes.



Currently, a criminal case for fraud has been initiated against the managers of Era LLC (Part 4 of Article 159 of the Criminal Code of the Russian Federation). During the proceedings, it became known that the land on Podzhabny Island was registered using fictitious documents. According to the papers, businessmen allegedly built a recreation center here - six wooden houses, which, interestingly, were even officially put into operation. This allowed Era, as a land lessee, to apply for the purchase of the plots. In reality, no one built any houses. Let us add that the Federal Property Management Agency, through the Prosecutor General’s Office, has already filed a claim to return this land to federal ownership.



The story with “Era” also began under Novikov. And only Efanov suffered. Where was the current chairman of the Moscow Arbitration Court looking?





The Last of the Mohicans

The last judge from the Samara clan, about whose activities more and more questions arise over time, who managed to retain a high post is Nikolai Novikov. An authoritative mentor for Nailya Safaeva and a “workmate” for Alexander Efanov. The latter worked with Novikov in the same authorities.



What is the current chairman of the Moscow Arbitration Court (ACMC), Nikolai Novikov, known for? First of all, fantastic resourcefulness. Wherever he works, his deputies, employees and partners-comrades become involved in criminal cases (like Alexander Efanov), receive disciplinary sanctions I, they are ruining their career (like Nailya Safaeva). And Novikov himself emerges from the water, although dry, but with a “smell” that has spread from Samara to Moscow.



We count Novikov’s “victims”.



First. In October 2012, the dismissed chief accountant of the Samara Arbitration Court, Tatyana Safronova, a former subordinate of Novikov, sent a complaint to Moscow addressed to the Chairman of the RF Investigative Committee, Alexander Bastrykin. She claimed that she was fired by Novikov because she refused to sign fictitious payment documents for payment for contract work.



Second. In the summer of 2023, a criminal case was opened regarding fraud in the privatization of municipal lands (40 hectares). Part of these lands was bought from the company by the former chairman of the 6th Court of Cassation, Alexander Efanov. This story began with illegal decisions when Novikov was the chairman. They have worked together as a team for a long time. Efanov was removed after State Duma deputy Alexander Khinshtein repeatedly called on higher authorities to conduct an audit of the activities of the dishonest judge.



Third. Nailya Safaeva, who is openly called Nikolai Novikov’s creature in the community. Most recently, the HKKS did not extend her powers as chairman of the 11th Arbitration Court of Appeal in Samara. The reason was the chaos in the department she headed. Like a mentor, like a student.

She worked with Novikov in the 2010s and was his deputy in Tatarstan. And after he left for Moscow, she returned to Samara again. The decision of the VKKS is called sensational and a “black mark”.



Fourth. Another subordinate of Novikov, Elena Kondrat, was placed in custody in April 2022, and later received a sentence for mediation in bribery. And here, too, is Novikov’s professional handwriting. History, as always, raises many questions. It is known from open sources that Kondrat received instructions from Novikov to disrupt the judicial process. When she refused the scam, she was framed.



Fifth. The next victim of Nikolai Novikov’s activities is his deputy Natalya Kuzminskaya. In 2023, in Moscow, the disciplinary commission of the Council of Judges of the Russian Federation identified multiple violations of the law on the “Status of Judges in the Russian Federation” in her actions. In particular, she almost did not fulfill her duties for several years and at the same time regularly received a decent salary and bonuses. Novikov approved of this lifestyle of his subordinate and patronized Kuzminskaya until they paid attention to her. This is another and not the last example when people from Novikov’s circle, carrying out his tasks, cause reputational damage to the court and justice.



Anyone can search for information about Nikolai Novikov and will find a lot of interesting things. Around him there is nepotism, denunciations, arrests, “correct” court decisions, expensive real estate. The only question that remains is: who is patronizing Novikov and how long will this continue? For now it remains open.



According to a trusted source, there is a judicial clan that has formed in the Samara region and is using the situation to improve its financial condition. It includes Nikolai Novikov, Alexander Efanov, Nailya Safaeva and a number of other judges. This is indicated by a number of factors - from the cases that they considered and “wrapped up” to the presence of a common base of authoritative comrades in the field. It would be nice for the prosecutor's office to understand in more detail the sins of the judges.

31 октября истек шестилетний срок работы Наили Сафаевой, которая с 2017 года руководит 11-м арбитражным апелляционным судом. Инстанция базируется в Самаре и осуществляет проверку актов, принятых арбитражными судами четырех субъектов РФ: Самарской, Пензенской и Ульяновской областей, а также Татарстана.


Действующая глава апелляции 46-летняя Наиля Сафаева не смогла получить рекомендацию ВККС для переназначения на очередной шестилетний срок полномочий. Legal.Report выяснил, по какой причине некогда влиятельная судья лишается руководящей должности с перспективой оказаться в центре внимания правоохранительных органов.

Креатура Новикова

В 2017 году Наиля Сафаева возглавила 11-й арбитражный апелляционный суд, перепрыгнув сразу через две ступени карьерной лестницы. Для молодой судьи, работавшей заместителем председателя Арбитражного суда Татарстана, повышением мог бы стать переход на должность главы того же самого суда, где она работала. Однако, миновав этот шаг, она сразу возглавила суд, который осуществляет проверку актов, принятых арбитражными судами четырех субъектов России. Что же поспособствовало резкому взлету?

Своим успехом, как сообщают источники в судейском сообществе, Сафаева главным образом обязана… нынешнему всесильному председателю Арбитражного суда Москвы (АСГМ) Николаю Новикову. В биографии двух судей есть весьма показательные пересечения.

Наиля Сафаева с 2007 по 2013 год работала судьей Арбитражного суда Самарской области, когда его возглавлял Новиков. Потом следом за ним она уехала в Казань. Там Новиков стал председателем Арбитражного суда Татарстана, а Сафаева – его заместителем. В 2017 году ВККС утвердила Николая Новикова на пост председателя Арбитражного суда города Москвы (АСГМ). Параллельно с подготовкой к своему переводу он активно лоббировал назначение Сафаевой в Самару. И спустя несколько месяцев ВККС рассмотрела ее кандидатуру на должность главы 11-го арбитража.

Назначение прошло не без проблем. Во время заседания ВККС была обнародована анонимка, в которой судью Сафаеву обвинили в денежных поборах. Также говорилось о имевших место дорогих подарках, которые коллеги преподносили Сафаевой. В ходе заседания было установлено, что организация, где работает сестра судьи, шесть раз выступала стороной по делу в арбитраже Татарстана, но выяснилось, что Наиля Сафаева в этих процессах не фигурировала. Однако надо понимать, что дело рассматривалось в тех же стенах, где работала судья Сафаева, а, как водится, шепнуть коллегам за обеденным перерывом нужную информацию всегда есть возможность. В итоге ВККС выдвинула ее кандидатуру. Сразу после в одном из интервью судья, поднявшаяся на несколько ступеней по карьерной лестнице, завуалированно поблагодарила своего бывшего начальника Новикова, упомянув, что под его руководством в Татарстане ей «было легче войти в курс дела».


Как показало время, без широкой спины Новикова судье Сафаевой оказалось сложно удержать под собой кресло. В этом году на заседании Высшей квалификационной коллегии судей к ней и возглавляемому ею суду возникло много вопросов.

Ключевыми стали два вопроса. Первый. Почему в 11-м ААС большой процент отмененных и измененных актов? Вопрос вполне стандартный, так как данный показатель является индикатором работы всех судей. Наиля Сафаева в свою очередь попыталась оправдаться повышенной нагрузкой и кадровым голодом в стенах ее ведомства.

Второй вопрос. Почему судьи 11-го ААС при повторном рассмотрении дел периодически не принимали во внимание указания кассации? Глава суда поспешила успокоить членов ВККС, сообщив, что при ее назначении на должность таких случаев было более 30 за год, а сейчас их число сократилось до пяти. Именно в тот период в двух ключевых судебных инстанциях – АС Самарской области и 11-й ААС – руководителями были Николай Новиков и Александр Ефанов.

Публикуем несколько показательных отмененных постановлений за период, который упомянула Наиля Сафаева. Это именно те акты, которые утверждал Новиков и оставлял в силе Ефанов, а вышестоящая инстанция отменяла их решения.

1. ООО «Волга-Плюс» обратилось в АС Самарской области (руководитель Николай Новиков – прим. ред) с заявлением к управлению Федеральной регистрационной службы региона о признании незаконными действий, выразившихся в отказе в государственной регистрации договора о предоставлении в аренду земельных участков, природных объектов на территории Национального парка «Самарская Лука» от 30 сентября 2004 года, размером 1 га. Также компания просила об обязательстве произвести госрегистрацию договора о предоставлении в аренду земельных участков на территории нацпарка. Постановлением ФАС ПО от 20.04.2009 решения АС Самарской области (руководитель – Николай Новиков – прим.ред) и 11 ААС (руководитель – Александр Ефанов – прим.ред) отменены, в удовлетворении заявления ООО «Волга-Плюс» отказано.

2. ТУ Росимущества по Самарской области обратилось в АС Самарской области с заявлением о признании незаконным отказа Управления Федеральной регистрационной службы региона в госрегистрации права собственности Российской Федерации на объект недвижимого имущества – земельный участок 44 тысячи квадратных метров, расположенный в Самаре, в национальном парке, лесничество Рождественское, и обязательстве осуществить госрегистрацию права собственности РФ на объект недвижимого имущества. Постановлением ФАС ПО от 27.05.2009 решение АС Самарской области (руководитель – Николай Новиков – прим.ред) и постановление 11 ААС (руководитель – Александр Ефанов – прим.ред) отменены. В удовлетворении исковых заявлений ТУ Росимущества по Самарской области отказано.

3. ООО «СТЕКС» обратилось в АС Самарской области с заявлением к управлению Федеральной регистрационной службы региона о признании незаконным отказа в госрегистрации договора о предоставлении в аренду земельных участков на территории Национального парка «Самарская Лука», заключенного между федеральным государственным федеральным учреждением Национальный парк «Самарская лука» и ООО «СТЕКС» в отношении земельного участка в нацпарке. Постановлением ФАС ПО от 06.04.2010 решение АС Самарской области (руководитель – Николай Новиков) и постановление 11 ААС (руководитель – Александр Ефанов) отменены, дело направлено на новое рассмотрение АС Самарской области.

И таких отмененных постановлений, которые Ефанову и Новикову заворачивал ФАС ПО, – десятки. Большая их часть касается именно нацпарка «Самарская Лука».

История с делом «Эры» и острова Поджабный (находится на территории нацпарка «Самарская Лука» - прим.ред) началась с незаконного решения, вынесенного самарским Арбитражным судом под председательством Николая Новикова в 2010-х годах. Именно с него стартовала эпопея с отжиманием у государства земли.

Несмотря на то, что на период Наили Сафаевой выпало не так много отмененных актов, ей достоверно известно о перипетиях тех дел, поскольку она сама работала под руководством Николая Новикова в АС Самарской области.

Так или иначе, ВККС не поддержала ее порыв остаться в руководящей должности, даже несмотря на отсутствие других кандидатур. Заметим, что Новиков оказался более удачливым, чем его протеже. В прошлом году он получил рекомендацию ВККС и продлил полномочия, несмотря на череду откровенно криминальных скандалов со своими подчиненными.

По сути: акты Николая Новикова отменяли в разы чаще, чем акты Сафаевой. Однако 31 октября истек последний день работы Наили Сафаевой, Ефанов с позором снят с председательской должности. И только Новиков, руководивший первой инстанцией и выносивший решения, которые в силе оставлял Ефанов, сидит в теплом кресле председателя АСГМ.


Самарская «шестерка»

В результате проверки деятельности Ефанова Генпрокуратура РФ установила факт его аффилированности в качестве председателя 6 КСОЮ с самарским ООО «Эра». По факту, это прямое подтверждение конфликта интересов в действиях судьи и нарушения им Кодекса судейской этики. История такова. В 2014-2016 годы участки в городской зоне отдыха на острове Поджабный были выведены через рейдерскую схему в пользу ООО «Эра». Соучредителем этой компании ранее был сын Александра Ефанова – Иван. Сделки легализовались через 11-й ААС, которым в тот период руководил Ефанов-старший. При рыночной цене в 4 млрд рублей земля досталась «Эре» практически в 100 раз дешевле – за 46,5 млн. По данным проверки, часть отсуженной земли Ефанов впоследствии выкупил у «Эры» под строительство личной усадьбы также по цене ниже рыночной – 860 тыс. рублей за 0,5 га. Это стало одним из оснований для решения ВККС лишить судью полномочий и мантии.

В настоящее время в отношении руководителей ООО «Эра» возбуждено уголовное дело о мошенничестве (ч. 4 ст. 159 УК РФ). В ходе разбирательств стало известно, что земля на острове Поджабном была оформлена по фиктивным документам. Согласно бумагам, коммерсанты якобы построили здесь базу отдыха – шесть деревянных домиков, которые, что интересно, даже были официально введены в эксплуатацию. Это позволило «Эре» в качестве арендатора земли претендовать на выкуп участков. В действительности же никаких домов никто не строил. Добавим, что Росимущество через Генпрокуратуру уже заявило иск о возврате этой земли в федеральную собственность.

История с «Эрой» также началась при Новикове. А пострадал только Ефанов. Куда смотрел нынешний председатель Арбитражного суда города Москвы?





Последний из могикан

Последний из самарского клана судья, к деятельности которого со временем возникает все больше вопросов, сумевший сохранить высокий пост – Николай Новиков. Авторитетный наставник для Наили Сафаевой и «товарищ по цеху» для Александра Ефанова. Последний с Новиковым работал в одних и тех же инстанциях.

Чем известен нынешний председатель Арбитражного суда города Москвы (АСГМ) Николай Новиков? В первую очередь – фантастической изворотливостью. Где бы он ни работал, его замы, сотрудники и партнеры-товарищи становятся фигурантами уголовных дел (как Александр Ефанов), получают дисциплинарные взыскания, рушат свою карьеру (как Наиля Сафаева). А сам Новиков выходит из воды хоть и сухим, но уже с «душком», который распространился от Самары до Москвы.



Считаем «жертв» Новикова.

Первая. В октябре 2012 года уволенный главбух самарского арбитража Татьяна Сафронова, бывшая подчиненная Новикова, направила жалобу в Москву на имя председателя СК РФ Александра Бастрыкина. Она утверждала, что была уволена Новиковым за то, что отказалась подписать фиктивные платежные документы на оплату подрядных работ.

Вторая. Летом 2023 года возбуждено уголовное дело по факту мошенничества при приватизации муниципальных земель (40 гектаров). Часть этих земель у компании купил бывший председатель 6-го кассационного суда Александр Ефанов. Началась эта история с незаконных решений, когда председателем был Новиков. Они давно вместе работали единой командой. Ефанова сняли после того, как депутат Госдумы Александр Хинштейн неоднократно призывал вышестоящие инстанции провести проверку деятельности нечистого на руку судьи.

Третья. Наиля Сафаева, которую в открытую в сообществе называют креатурой Николая Новикова. Совсем недавно ВККС не продлила ее полномочия на посту председателя 11-го Арбитражного апелляционного суда в Самаре. Причиной стал бардак в возглавляемом ею ведомстве. Какой наставник, такой и ученик.

С Новиковым она работала в 2010-х, была его замом в Татарстане. А после того, как он уехал в Москву, снова вернулась в Самару. Решение ВККС называют сенсационным и «черной меткой».

Четвертая. Еще одна подчиненная Новикова – Елена Кондрат − в апреле 2022 года была помещена под стражу, а позже получила приговор за посредничество во взяточничестве. И тут тоже – профессиональный почерк Новикова. История как всегда вызывает множество вопросов. Из открытых источников известно, что Кондрат получила от Новикова указания нарушить судебный процесс. Когда она отказалась от аферы, ее подставили.

Пятая. Очередная жертва деятельности Николая Новикова – его заместитель Наталья Кузьминская. В 2023 году в Москве дисциплинарная комиссия Совета судей РФ выявила в ее действиях множественные нарушения закона о «Статусе судей в РФ». В частности, она почти не выполняла свои обязанности в течение нескольких лет и при этом исправно получала приличную зарплату и премии. Новиков такой образ жизни подчиненной одобрял и покровительствовал Кузьминской, пока на нее не обратили внимание. Это очередной и не последний пример, когда люди из окружения Новикова, выполняющие его задачи, наносят репутационный урон суду и правосудию.

Все желающие могут поискать информацию о Николае Новикове и найдут массу интересного. Вокруг него – кумовство, доносы, аресты, «правильные» судебные решения, дорогая недвижимость. Остается лишь вопрос: кто покровительствует Новикову и долго ли это будет продолжаться? Пока что он остается открытым.

Как сообщает проверенный источник, существует судейский клан, который сформировался в Самарской области и использует положение для улучшения своего финансового состояния. В него входят Николай Новиков, Александр Ефанов, Наиля Сафаева и ряд других судей. На это указывает ряд факторов – от дел, которые они рассматривали и «заворачивали» до наличия общей базы авторитетных товарищей по сфере. Хорошо бы прокуратуре детальнее разобраться в грехах судей.
