Telegram channel VChK-OGPU and Rucriminal.info continue to talk about the corruption schemes of PJSC MOEK, organized by the protege of the Rotenberg clan - Dzhambulatov Zaurbek Islamovich. The activities of his team of former security officials led to a catastrophic situation with the condition and functioning of heating networks in the capital. At the same time, the key participants of the organized criminal group became billionaires and acquired real estate in the West.




On the one hand, the scheme is conceived in such a way that there is no injured party: developers naively believe (or rather, this is how intermediaries explain it to them) that they saved money by implementing a reduction in the cost of the contract, but at the same time committed commercial bribery of officials of PJSC MOEK. On the other hand, even schoolchildren understand that developers are simply being scammed, because after excluding the volume of work on the reconstruction of heating networks from the connection agreements, newly built residential buildings stand for decades, are provided with heat and without performing the re-laying excluded from the agreements. Therefore, the injured party No. 1 - the beneficiaries of the developers - people or organizations that directly invest in the construction of housing. At the same time, hired officials of the developer organizations also make money on this, screwing in their small %, like, for example, Andrey Bagayev (Donstroy).




Injured party No. 2 - according to the classics, these are ordinary people who buy real estate more expensive than it actually is, since the costs of reducing the cost of connection agreements and, accordingly, for commercial bribery of officials of OOO "TsTP MOEK" are included by the developers in the cost of square meters of housing.




Injured party No. 3 - PAO "Gazprom". If all reconstructions and relocations of heating networks were carried out in accordance with the issued offers of connection agreements, then the capitalization of PAO MOEK would regularly grow by the value of the constructed networks, increasing the value of PAO MOEK - an asset of PAO Gazprom. But work on the reconstruction of heating networks is excluded from the offers of connection agreements (the concluded agreements no longer contain volumes for reconstruction) for a monetary reward and instead the capitalization of Rotenberg and Dzhambulatov grows. The economic damage to PAO Gazprom is easy to calculate and it amounts to more than 50 billion rubles over 10 years.




Injured party No. 4 - PAO MOEK. When Dzhambulatov's OPS was in power, PAO MOEK became the personal "oil rig" of Dzhambulatov and Rotenberg and, naturally, all the money is pumped out of the company. Employees' salaries are not growing, there is no career growth, materials and equipment are purchased at inflated prices through shell companies, and all liquid real estate and movable property is sold through Dzhambulatov's structures.

Injured party No. 5 - clients of Bers Dzhambulatov's Misty Group LLC, who use the services of a business financed by representatives of the queer community.

How to identify corrupt contracts and assess the amount of damage. The most important element is the offer of the connection agreement and applications.




In the archive of OOO TsTP MOEK, PAO MOEK, DZHKHIB of Moscow, Mosgosexpertiza, Gosstroynadzor, in the archive of developers, in the supporting materials for approval of the connection tariff (or investment program) in the archive of DEPiR of Moscow, it is necessary to identify all concluded connection agreements with commercial developers with a heat load of more than 3 Gcal / h, necessarily offers of these agreements (offer - an issued standard form of a connection agreement after the initial application for connection with the initially calculated cost), applications for connection to these agreements and business correspondence to them from 2017 to 2022 (in 2017, the registration of construction projects with the issuance of connection agreements at the so-called "P1 rate" was completed due to a change in legislation and previously issued "free" technical specifications, and in 2022 Yerashov S.S. the senior became more careful after the publications of Rucriminal.info and VChK-OGPU). It is important to note the mandatory presence of initially registered applications for connection. It is with the help of the date in such applications, counting 20-30 days depending on the legislation in force at that time, that one can reliably identify the offer of the connection agreement (the offer was issued 20-30 days after receiving the application for connection). The cost of the agreement is needed specifically from the offer, since it is the offer that is the main link (Criminal Code of the Russian Federation, Article 30) in the corruption scheme and it is unlikely that PAO MOEK will voluntarily issue offers of agreements upon request (for example, the archive burned down or the program crashed due to sanctions, all data was lost). The offer of the connection agreement is essentially a tool for committing a crime and obtaining corruption income, the cost reflected in the offer is the starting point in determining the amount of commercial bribery. The presence of a significant difference between the offer and the concluded connection agreement indicates the commission of commercial bribery. After receiving the offer, applicants, as a rule, seeing the cost, through intermediaries raise the issue of reducing the cost and conclude contracts with a lower cost (most likely, PAO MOEK can provide the concluded contracts for connection applications, but what to do with the dates in these documents and the over-standard term for signing the contract is a question, you can only falsify). Next, we will use a simple method:




we compare the offers of connection contracts with already concluded contracts for cost. We identify contracts where there is a significant difference in cost (more than 50%). For example, an offer for 500 million rubles, and a concluded contract for 100 million rubles. Absolutely all contracts with Donstroy (Bagaev Andrey) and GC Tashir (Samvel Karapetyan), LSR were concluded under such a corrupt scheme, you don't have to look for long.




After identifying a list of objects with a significant difference between the cost of the concluded contract and the cost of the initial offer, you can calculate the corrupt income of the OPS Dzhamulatov and Rotenberg from a specific connection contract. We take at least 50% of the cost of the contract offer - this is the corrupt income of the OPS of Dzhambulatov and Rotenberg from a specific contract. We find in the offer the reconstruction of sections of heating networks - these are the heating networks that need reconstruction according to option 1) or the invented reconstruction according to option 2). Next, we sum up the corrupt income from all contracts and get a very impressive amount and get the total proven damage to PJSC Gazprom. Otherwise, how can we answer the question of where and why the so necessary initially included reconstructions disappeared? Why were they included in the contracts then?




Another OPS participant and "Rotenberg's protege", as he tells everyone, Vladimir Viktorovich Orlov in AO Mosvodoknal is pulling off approximately the same scheme.




Why does this still work?




The developers naively believe that they outplayed everyone by reducing the cost of the connection agreement and the cost of the construction project. The major developers, who have long known the price tag, the trusted persons of the Penza moths and their intermediaries (the OPS participants do not take cash in their hands), all the ins and outs, have been especially successful. This has turned into a system. The relations between the developers and the OPS participants have become interdependent and both parties will suffer in the event of possible investigative actions.

The officials of PAO Gazprom and other regulatory bodies are not interested in the schemes in PAO MOEK and, with all their desire, upon request can only receive concluded contracts without offers. The capitalization of PAO MOEK, worn-out heating networks and constant accidents in Moscow are definitely of no interest to them. Khomyakov Sergey Fedorovich and Fedorov Denis turn a blind eye to this for a fee.

Sobyanin and the heads of the relevant departments do not care at all about this, they "cannot influence this". Bers Dzhambulatov needs a constant replenishment of coins, like in the Mario game, as well as constant interviews to create the image of a "businessman", otherwise it is unclear where to get money after dad leaves Gazprom Energoholding LLC.

And how else to make money in PAO MOEK? No way! A simple shy guy became a director - is it not a success?

All actions to establish the events of the crimes can be carried out at any time, and given the current statute of limitations, the axe over the members of the Dzhambulatov organized crime group will hang indefinitely, and the coins collected for Bers can turn into a pumpkin. Most likely, after the publication of this information, members of the organized crime group will begin deleting documents proving the crimes from the archives of PAO MOEK and OOO TsTP MOEK.
