On August 3rd, the Moscow City Court finished considering the sensational appeal in the case of ex-colonel-billionaire Dmitry Zakharchenko. The July 13 meeting was adjourned due to Markelov's death. The verdict to the businessman did not come into force, he did not admit his guilt, and due to bureaucratic delays and the position of the ex-judge of the Presnensky Court, Sergei Artemov, he was unable to start treatment in a timely manner. It is significant that after the verdict in the case of Zakharchenko, Artemov went for a promotion to the Moscow City Court.

On August 3, Valery Markelov's death certificate was presented to the Moscow City Court by his defense. Zakharchenko, who had lost a lot of weight and was unusually restrained, was brought to the meeting room in person, and his alleged accomplices Viktor Belevtsov and Vasily Kritinin were connected via videoconferencing. Markelov's brother Mikhail acted as the legal representative of Markelov, who declared Valery Markelov's innocence and asked to cancel the verdict.

Kritinin's defense immediately issued a statement about the death of his client's father, as well as the illness of his child. After that, the court proceeded to announce the appeals against the verdict, which the defenders called "inadmissible, unfounded, up to typos copied from the indictment", asking him to cancel and issue an acquittal.

After that, Zakharchenko took the floor. He emotionally spoke about the fact that he was never allowed to get acquainted with the evidence in the case, primarily with the "Platform", where, according to the prosecution, all the "black" cash transactions were reflected, and also questioned the qualifications and impartiality of those who spoke in the Presnensky court witnesses. In the end, he asked to acquit all the accused "due to the absence of a crime event."



State prosecutor Milana Digaeva predictably began to object, noting that no one prevented the defenders and the accused from studying the evidence, calling them exhaustive, sufficient and consistent, and also examined in court to the extent necessary.

She asked that the sentences of Zakharchenko, Belevtsov and Kritinin be left in force, and that the criminal case against Markelov be dropped in view of his death.

The cornerstone requirement of the defenders - the study of the laptop with the "Platform" was rejected by the court, citing the absence of such a need and supporting the corresponding petition of the state prosecution.

Zakharchenko, who started the debate, had to be stopped and, at the request of the presiding judge, “to explain to him the essence of the judicial debate.” “Your honor,” the ex-colonel said after a short break, “following your instructions, I will reduce my 118 arguments to a minimum.” After that, he talked for another half an hour about the fact that he paid for his vacation in Sochi himself, did not receive any bribes, and no one provided evidence to the contrary.

Lawyer Alexander Gofshtein in his speech pointed out that, in accordance with all legislative norms, Markelov's sentence should be canceled, and after that the criminal case against him should be dismissed. Separately, Gofshtein noted the unsubstantiated accusations, their stereotyped, inconsistent, groundless and "absurdity."

In a surprisingly short last word, Zakharchenko asked for "law and justice." To the amazement of those present, who expected that this would not happen until Friday, the judges went into the deliberation room to make a decision.



The troika of the Moscow City Court, chaired by Inna Tardzhumanyan, determined that the criminal case against Markelov should be terminated, the sentence canceled, and the seizure of property removed. The verdict against Dmitry Zakharchenko, Vasily Kritinin and Viktor Belevtsov was upheld.

Что напугало полковника-миллиардера из МВД РФ



Треькго августа Мосгорсуд закончил рассмотрение нашумевшей апелляции по делу экс- полковника-миллиардер-Дмитрия Захарченко. Процесс стартовал 15 ноября прошлого года, потом несколько раз переносился из-за протестов Захарченко, а также тяжелой прогрессирующей болезни бизнесмена Валерия Маркелова (рак поджелудочной железы в терминальной стадии), из-за которой он не смог участвовать в процессе.



Заседание 13 июля было отложено из-за смерти Маркелова. Приговор бизнесмену не вступил в силу, своей вины он не признал, а из-за бюрократических проволочек и позиции экс-судьи Пресненского суда Сергея Артемова не смог своевременно начать лечение. Показательно, что после вынесения приговора по делу Захарченко Артемов пошел на повышение в Мосгорсуд.

3 августа свидетельство о смерти Валерия Маркелова было представлено в Мосгорсуд его защитой. Изрядно похудевший и непривычно сдержанный Захарченко был доставлен в зал заседаний лично, а его предполагаемые подельники Виктор Белевцов и Василий Критинин были подключены по видеоконференцсвязи. В качестве законного представителя Маркелова выступил его родной брат Михаил, который заявил о невиновности Валерия Маркелова и попросил отменить приговор.

Защита Критинина сразу же выступила с заявлением о смерти отца своего подзащитного, а также болезни его ребенка. После этого суд приступил к оглашению апелляционных жалоб на приговор, который защитники назвали «недопустимым, необоснованным, вплоть до опечаток скопированным из обвинительного заключения», попросив его отменить и вынести оправдательный.

После этого слово взял Захарченко. Он эмоционально рассказал о том, что ему так и не дали ознакомиться с доказательствами по делу, прежде всего с «Площадкой», где, по версии обвинения, отражались все «черные» денежные проводки, а также усомнился в квалификации и беспристрастности выступавшим в Пресненском суде свидетелей. Под конец он попросил оправдать всех обвиняемых «за отсутствием события преступления».



Гособвинитель Милана Дигаева предсказуемо стала возражать, отметив, что никто не препятствовал защитникам и обвиняемым изучать доказательства, назвав их исчерпывающими, достаточными и непротиворечивыми, а также в необходимой мере исследованными в суде.

Она попросила оставить в силе приговоры Захарченко, Белевцову и Критинину, а уголовное дело в отношении Маркелова прекратить в виду его смерти.

Краеугольное требование защитников - исследование ноутбука с «Площадкой» суд отклонил, сославшись на отсутствие такой необходимости и поддержав соответствующее ходатайство гособвинения.

Начавшего прения Захарченко пришлось останавливать и по просьбе председательствующего судьи «разъяснить ему суть судебных прений». «Ваша честь, - заявил экс-полковник после небольшого перерыва, - выполняя ваши указания, я сокращу свои 118 доводов до минимума». После этого он еще полчаса говорил о том, что за свой отдых в Сочи заплатил сам, никаких взяток не получал, а доказательств противоположного никто не привел.

Адвокат Александр Гофштейн в своей речи указал, что в соответствии со всеми законодательными нормами приговор Маркелову должен быть отменен, а после этого прекращено уголовное дело в его отношении. Отдельно Гофштейн отметил бездоказательность обвинений, их шаблонность, противоречивость, безосновательность и «несуразность».

В на удивление коротком последнем слове Захарченко попросил «закона и справедливости». К изумлению присутствующих, ожидавших, что это произойдет не раньше пятницы, судьи ушли в совещательную комнату для вынесения решения.

Тройка Мосгорсуда под председательством Инны Тарджуманян определила, что уголовное дело в отношении Маркелова должно быть прекращено, приговор отменен, а арест с имущества снят. Приговор в отношении Дмитрия Захарченко, Василия Критинина и Виктора Белевцова оставлен в силе.

So, the current Deputy Minister of Transport Andrei Kostyuk began his career with the St. Petersburg Directorate of Transport Construction (DTS), and in 2006 he was pushed by the criminal lobby to the post of head of the FKU Sevzapupravtodor, responsible for all federal roads in the North-West region. And it started! Kostyuk's team stole billions on absolutely everything - from buying land plots for the construction of roads at an inflated price, to receiving bribes for approving exits to gas stations and installing billboards on the roadsides. The direct organizer of the schemes was the chief engineer of the organization, Valery Ivanov, who became its leader after Kostyuk left for a promotion to Moscow. Kostyuk was close family friends with him. Ivanov's "hands" were Timofey Meshcheryakov, ex-employees of the relevant departments of the Ministry of Internal Affairs, and Vladimir Chernukha, accepted into the team, who took control of the department of property relations of the FKU. A number of businessmen worked with them, including the aforementioned Konashenkov. We will tell about who exactly and how he worked in the next series, and now we note that in 2016 the St. Petersburg FSB, together with the OEB and the PC, carried out a high-profile implementation of this criminal group. Ivanov, Chernukha, Meshcheryakov and a number of businessmen were detained, the case went to the powerful Article 210 of the Criminal Code of the Russian Federation (organization of a criminal community). And then Moscow intervened. As a result, a huge case with multi-billion dollar damage fell apart and ended with a couple of suspended sentences. The merchant, who was involved in high-profile criminal cases of embezzlement at the FKU Sevzapupravtodor, successfully continues to work on the regional highways of the Leningrad region. We do not know for sure whether Andrei Kostyuk got into the Barmaley-Golubev authority team before his work at the St. Petersburg Directorate of Transport Construction (DTS), or already working there. As we already wrote, Timofey Meshcheryakov and Vladimir Chernukha came to the Department of Property Relations of the FKU as a working team. There are already neighborly ties here - Kostyuk, who was born in the Amur Tynda, settled in the St. Petersburg suburb of Peterhof since the 90s, and both of the above-mentioned comrades lived next door, on Shakhmatova Street. By the way, back in 2005, Chernukha received a 3-year suspended sentence for major fraud, but is this really a hindrance to the civil service?

Now let's show one trick. So, 2017, the implementation of the FSB and OEB and PC. Meshcheryakov and Chernukha were detained, as were a number of businessmen. Kostyuk has been in Moscow for a long time, Ivanov, who replaced him as head of the FKU, is rapidly leaving his chair and becoming ... the chairman of the transport committee of the Kursk region (we will tell about the Kursk region in detail in a separate series). А начнем мы с СЗФО и преступного сообщества, подконтрольного ставленнику криминального авторитета Бармалея замминистру транспорта РФ Андрею Костюку. Этот чиновник лоббирует передачу десятков миллиардов рублей подрядчику «ЕвроТрансСтрой» (ЕТС) бизнесменов Ракчеева и Локтионова. Эти коммерсанты знакомы с фигурантом очень громких дорожных уголовных дел Павлом Конашенковым по компании «СнабСтрой». Что же, давайте приоткроем дверь в мир титанического казнокрадства и фантастической безнаказанности.

Но разборки происходят и внутри коллектива, бывших сослуживцев.

Вот один из представителей однокурсников Костюка - Сергей Царьков. Вместе с Костюком заканчивал ВТУ в 2001 году, потом работал в Дирекции транспортного строительства, подведомственная Комитету по благоустройству, в то же время, когда там до 2007 работал Костюк.

Потом в 2013 году Царьков пришел на работу в ФКУ Упрдор «Волга» заместителем, затем в 2017 начальником ФКУ Упрдор «Прикамье».

В 2019 году облечен в «крысятничестве» (деньги у подрядчиков брал, а выше не относил), его попросили уволится с работы. А Генеральная прокуратура начата проверка в отношение него. И нашла дом около Охта парка в Ленинградской области, записанный на жену, и не указанный в декларации.

И начнем мы с подсказки коллегам – лучше бы они обратили внимание на другую фирму – «ПрофТехКонтракт», которой в 2010-2011 годах Ракчеев владел вместе с Марией Костюк. Да, это супруга Андрея Костюка!

Итак, нынешний замминистра транспорта Андрей Костюк начал свою карьеру с петербургской Дирекции транспортного строительства (ДТС), а в 2006 году был просунут криминальным лобби на пост руководителя ФКУ «Севзапуправтодор», отвечающего за все федеральные дороги Северо-Западного региона. И началось! Команда Костюка воровала миллиарды абсолютно на всем – от выкупа земельных участков под строительство дорог по завышенной цене, до получения взяток за утверждение съездов к автозаправкам и установку рекламных щитов на обочинах. Непосредственным организатором схем был главный инженер организации Валерий Иванов, ставший ее руководителем после ухода Костюка на повышение в Москву. С ним Костюк крепко дружил семьями. «Руками» Иванова стали принятые в команду экс-сотрудники профильных отделов МВД Тимофей Мещеряков и Владимир Чернуха, взявшие под контроль департамент имущественных отношений ФКУ. С ними работал ряд коммерсантов, включая вышеупомянутого Конашенкова. О том, кто именно и как работал мы расскажем в следующей серии, а сейчас отметим, что в 2016 году петербургская ФСБ, совместно с ОЭБ и ПК, провела громкую реализацию, по данной преступной группе. Иванов, Чернуха, Мещеряков и ряд коммерсантов были задержаны, дело шло к мощной 210 статье УК РФ (организация преступного сообщества). А затем вмешалась Москва. В итоге огромное дело с многомиллиардным ущербом развалилось и закончилось парой условных сроков. А все участники преступной схемы или продолжали в ней работать еще долгое время, или продолжают это делать до сих пор. Продолжение в следующей серии – «Неуязвимые в Росавтодоре».

Коллеги заметили очередной любопытный штрих. Проходивший по громким уголовным делам по хищениям в ФКУ «Севзапуправтодор» коммерсант успешно продолжает работать на региональных трассах Ленобласти. Что ж, мы же говорили – никто из коррупционеров команды Костюка серьезно не пострадал. О коммерсантах мы расскажем в следующий раз, а в сегодняшней серии «Неуязвимые в Росавтодоре» мы поведаем о чиновниках.


Бармалей-Голубев


Мы точно не знаем, попал ли Андрей Костюк в команду авторитета Бармалея-Голубева до своей работы в петербургской Дирекции транспортного строительства (ДТС), или уже работая там. Зато мы в курсе, что, уходя возглавлять «Севзапуправтодор», он захватил из ДТС своего друга Валентина Иванова, которого сделал главным инженером ФКУ. Главный инженер – ключевая фигура, ведь именно он знает заранее трассировку будущих дорог, а значит может подсказать, какие участки земли следует купить заранее, чтобы потом, в разы завысив оценку, продать их государству. Как мы уже писали, в качестве рабочей команды в департамент имущественных отношений ФКУ пришли Тимофей Мещеряков и Владимир Чернуха. Здесь уже соседские связи - родившейся в амурской Тынде Костюк еще с 90-х годов осел в петербургском пригороде Петергофе, а оба вышеупомянутых товарища жили по соседству, на улице Шахматова. Кстати, Чернуха еще в 2005 году получил 3 года условно за крупное мошенничество, но да разве это помеха госслужбе? Сейчас же покажем один фокус. Итак, 2017 год, реализация УФСБ и ОЭБ и ПК. Мещеряков и Чернуха задержаны, как и целый ряд бизнесменов. Костюк уже давно в Москве, сменивший его на посту руководителя ФКУ Иванов стремительно покидает свое кресло и становится…председателем комитета транспорта Курской области (про Курскую область подробно расскажем в отдельной серии). Его следы теряются летом 2019 года. Тем временем уголовное дело развалено, Мещеряков и Чернуха получают условные (разумеется) сроки по мелким эпизодам. Чем они заняты ныне? Верно, работают в Росавтодоре! Первый теперь замначальника ФКУ «Управление автомобильной магистрали Москва–Бобруйск», а второй руководит филиалом ведомства в Псковской области. Культовый вопрос «а так можно было» в данном случае риторический. В следующей серии под названием «Они пилили Родину» мы расскажем о вполне себе безоблачной судьбе коммерсантов из банды Костюка и объясним, как именно делались криминальные миллиарды.

As the VChK-OGPU telegram channel found out, in fact, the construction is another business project of Denis Popov, the prosecutor of Khakassia, who had already been appointed to Dagestan by that time, and now heads the Moscow prosecutor's office, through the company URAP LLC, registered in 2016 in Chernogorsk of the Republic of Khakassia, the founder and general director of which is Popov's trustee Borodulin Artem Viktorovich.

In 2022, URAP LLC forced the administration of the Idrinsky district to transfer a plot in the village of Korolevka with a size of more than 24,000 sq.m into ownership. And only in the Idrinsky and Balakhtinsky districts the prosecutor has tens of thousands of hectares of hunting grounds for shooting deer, musk deer, brown bear.



For the luck of Artyom Borodulin, an entrepreneur drowning in loans and courts from Chernogorsk, in 2015, the enterprising Denis Popov was appointed prosecutor of the Republic of Khakassia, they became close, their commercial relations begin here, Popov provides strategic leadership, patronage and the use of connections, in turn, Borodulin becomes the commercial arm of the prosecutor and helps to master the flow of corruption funds. Летом 2018 года в деревне Королевка Идринского района Красноярского края неизвестные развернули масштабную стройку ( 24:14:3504002:29 ) , закружили вертолёты, часть территории муниципального образования обнесли проволокой, пошли Камазы со стройматериалами.





Очевидцы из местных рассказывали, что поставили "блокпост" на въезде в деревню, ограничили обыденный свободный выпас скота, запретили фотографировать строительство и вообще как-то интересоваться происходящим.

К осени был залит фундамент под 4 дома, баню, гараж, ангарная конструкция для спецтехники, отведено место под вертолетную площадку.

Среди местных ходили варианты от стройки для министра обороны Шойгу, до обустройства нового места отдыха для Путина.

Как выяснил телеграм-канал ВЧК-ОГПУ, на самом деле стройка является очередным бизнес проектом Дениса Попова прокурора Хакасии к тому времени уже назначенного в Дагестан, а ныне возглавляющего прокуратуру Москвы, через компанию ООО "УРАП" зарегистрированную в 2016 году в Черногорске Республики Хакасия, учредителем и генеральным директором которой является доверенное лицо Попова Бородулин Артем Викторович.



В 2022 году ООО "УРАП" принудили администрацию Идринского района передать участок в д. Королевка размером более 24 000 кв.м в собственность. И только в Идринском и Балахтинском районах прокурор имеет десятки тысяч гектаров охотничьих угодий для стрельбы в марала, кабаргу, бурого медведя.



На удачу утопающему в кредитах и судах ИП Артёму Бородулину из Черногорска в 2015 году прокурором Республики Хакасия назначают предприимчивого Дениса Попова, они сблизились, тут начинаются их коммерческие отношения, Попов осуществляет стратегическое руководство, покровительство и применение связей, в свою очередь Бородулин становится коммерческой рукой прокурора и помогает осваивать поток коррупционных средств. В 2016 году учреждается ООО "УРАП" ведущая деятельность в Хакасии, Красноярском крае и Республике Алтай, в которую вкладываюся коррупционные доходы прокурора.
